Minutes of the regular meetin~ of the Board of Trustees of the Village of
Chubbuck, held in the Municipal Building of the Village of Chubbuck on
August 11, 1959.
Present-Davis, Hillman, Mitchell, Ward and McDevitt.
Absent- Frasure, excused, out of town on vacation.
Called to order 8:10 P.M.
Minutes ~ the last regular and one recessed meeting then read and approved

Hensley requested the Chairman and the Board to ask to see the affadavits
mentioned in the previous mind,res. McDevitt said that if the Board so desired
they could request to see the affadavits and he suggested that the Clerk
write a letter to that effect and then the Board could decide on the matter
themselves. Ward said that as Board members, they have a right to know the truth.
Motion was made by Hillman, seconded by Ward, all in favor to have the Clerk
write a letter requesting that the affadavits be produced and presented to the
Board for imepection and stue~.
Bills for the month then presented to Board. Motion to approve payment made

Financial and Police reporte for the month then presented to Board.
Attorney ~etainer Fee-After a discussion between Mcdevitt and the Board they
all agreed on a ~0.00 per month re~ainer fee for the Village attorney. This ~0.OO
imcludes all work except court cases, bond issuea, and annexation orCinances
that require a lot of legal descriptions.
Audit Contract- was approve~ by all Board members an~ signed by the Chairman.
Mill levy for the fiscal year of ~959. A resolution adopting the following
mill levy, namely, Ail general fund expenses 23 mille, Fire Dept. Expenses 2 mille,
General obligation bonds, sinking and interest-fund 8 mills, for a total o~
33 mill~, was read in full by the Clerk. Roll call v~te for adoption of the
resolution as follows: Ward - yes, Hillma~ - yes, Davis - yes, Mitchell - yes.
A copy of the resolution is herewith attache~ to these minutes.
Neider Adebition- Residents still complaining of the water pressure in that
area. After a discussion between the Board and Brennan it was e~c~ed that the
solution to the problem is to put in a time clock. Motion to purehaae amd have
installed a time clock with magnetic starter, made by ~°ard, seconded by Mitchell,
Ail in favor.
Hawthorne Road - Ward reminded the Board that when the Main line was laid
on Hawthorne ~ad, the Village ~id not ~ave the mone~ to pay for it and that
Roy Neider and some of his neighbors paid for it with the unders%aadiog that
when the Village could afford it they would repay Neider for ~he main lime.
It is an estimated 6~O feet of 6 inch pipe and 2 tees. The Board asked Bre~nan
to help them figure out just how much we owe Neider and then we will have to
work out some method with Neider for payments on the main line.
Keist on South Yellowstone Ave.- Wants a 2 inch lime laid in front of his
property so they can put ima motel. After a discussion the Board decided that
if they do have $o la~ a line there it should be a ~ inch line and then they
woul~ be reap~for~ap~ other developments further south of the one in questiom
ROWe
~ater hook-ups- Coleman has paid 25.00 each on 6 mcr. hook-ups in the
Stuart Additiom. The people bu~ing the houses will have to pay the balance of
50.00 on each of these hook-ups. The Board decided that all hook-ups must be
paid in full before the water is turned on. An~ one turning on Village water
without permission will be subject to a 100.O0 fine and 30 days in jail.
Railraod ~aw Suit- McDevitt explained in detail to the Boar~ just what he
has done on the case so far, such as ~aving Judge Carver disqualified and also
asking for a dismissal of the case. The moti¢.n for dismissal is to be heard by
Judge Brows on August 2a, 1:~59.
Knotty Pine Licenses- the store and beer licenses have been transferred.
Colonial Motel- Hensley explained the water n~,~up there t~Athe Board.
