HomeMy WebLinkAbout04 23 2002 CMi 87 COUNCIL MEETING MINUTE April 23rd, 2002 Minutes of a regular meeting held at the Chubbuck City Council �hambers, April 23`d, 2002. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Steven M. England was excused. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular Meeting Minutes of April 9th, 2002. Councilman Kearns moved to approve Regular Meeting Minutes of April 9t1i, 2002 as read, Councilman Gunter seconded. All council members present voted in favor of motion. PUBLIC HEARING - An application by Tom Holm, 5735 Sorrell Drive, Chubbuck, Idaho for a preliminary plat for Greener Pastures 1St Addition. Property is located at the SW 1/4, Section 34, township 5S, range 34E. (intersection of Lariat and Hawthorne Road). Mayor Cotant declared the public hearing open. The Council received a petition with 36 signatures opposed to the Greener Pastures 1St Addition Preliminary Plat. Tom Holm, 5735 Sorrell Dr. explained his plan and felt lie was in compliance with all City Code, etc. Mr. Holm stated the preliminary plat approval will not devalue property in the area. Mr. Holm ask the City Council to approve the preliminary plat as presented. Janet Williams, 5730 Sorrell Dr. stated her objection is she does not like the one acre lots being divided into half acre lots, Mrs. Williams said when Mr. Holm asked for the vacation of street easement, Mr. Holm said he was going to build one house. Mrs. Williams stated it might be legal, but the neighborhood does not want Mr. Holm's acre lot divided. Z ARY PLAT - (cont) Pasture Subdivision Councilman Quick moved to table the Greener Pastures Subdivision 1't Addition Preliminary Plat until the May 14`h, 2002 Council Meeting, Councilman Gunter seconded. All council members present voted in favor of the motion. PUBLIC HEARING - ORDINANCE #556 - Amending Section 8.12.040 (i) to conform this Section to 18.08.010 with respect to abutting zero lot line residences and the density restrictions under other provisions of the Chubbuck Mcipal Code. Attorney Holmes read Ordinance #556 in full for the firs and final reading. Mayor Cotant declared the public hearing open. Darris Ellis asked for an explanation of Ordinance #556. Attorney Holmes explained Ordinance #556. Mayor Cotant declared the public hearing closed. Councilman Quick moved to dispense with the rule of reading Ordinance #556 on three separate days, Councilman Kearns seconded. Roll Call VIote: Quick, yes; England, absent; Gunter, yes; Kearns, yes. FIRE DEPARTMENT REQUEST FOR RECOGNITION AND 13ARGAINING - A majority of the full time firefighters employed by the City of Chubbu k have selected International Association of Fire Fighters, Local Union 4155 as their sole and exclusive bargaining agent for purposes of collective bargaining regarding wages, rates of pay, working conditions and all other terms and conditions of employment. Pursuant to Idaho Code 44-1803, the Union hereby requests recognition from the City as the sole and exclusive bargaining agent for all of the City's full time firefighters. Councilman Gunter moved to recognize the International Association of Fire Fighters, Local Union 4155 as the City of Chubbuck's full time firefighters sole and exclusive bargaining agent, Councilman Kearns seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - Charles Homier, Homi r Distributing Company, Indiana has applied for a business license to sell tools from a tent at the Pine Ridge Parking Lot, 4155 Yellowstone Ave, May 16th, -May 19t'', 2002. Fire Inspector Merlin Miller stated the Fire Department has some building and fire issues with the tent. Councilman Quick moved grant a business license to Charles Homier, Homier Distributing Company to sell tools from a tent at the Pind Ridge Parking Lot, 4155 Yellowstone Ave, May 16th, 2002 -May 19th, 2002 subject to Fire and Building Department approvals, Councilman Gunter seconded. April 23`d, 2002 ORDINANCE - Providing for change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck from Agricultural, (A) to General Commercial, (C-2); declaring that the City Council finds that such change in Land Use District is compatible with the Land Use Pattern prescribed by the City's Comprehensive Plan. Council tabled the proposed ordinance until the May 14`h, 2002 Council Meeting. CITY OF CHUBBUCK SECOND ANNUAL SPRING CLEANUP WEEK - Mayor Cotant read the City of Chubbuck Second Annual Spring Cleanup Week proclamation in full. Mayor Cotant suggested all Church groups be notified as soon as possible. ORDINANCE #558 - Amending Section 6.04.150 of the Chubbuck Municipal Code to provide appropriate statutory references for criminal background checks for daycare providers or employees. Attorney Holmes read Ordinance #558 by title only for the first reading. Councilman Gunter moved to dispense with the rule of reading Ordinance #558 on three separate days, one of which will be in full, Councilman Quick seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Kearns, yes. Councilman Quick moved to adopt Ordinance #558 as read, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, absent; Gunter, yes; Kearns, yes. CLAIM - Computer print-out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print-out claims as presented, Councilman Kearns seconded. All council members present voted in favor of motion.
