of Chubbuck, held in the Municipal Building of the Village of Chubbuck on
Narch 10, 1959.
Present-Valenty, Fenwick, ~ard, Hillman, Frasure and Christensen.
Called to order 8:30 P.~.
~inutes of the last regular and one recessed meeting then read and approved
as read.
The order of business was changed in order to allow Christensen to be excused
early.
Legal Matters- Hamilton had prepared a description of property to be annexed
by the Village. Valenty explained the boundary lines at the Village map. A motion
to instruct Christensen to draw up the ordinance was made by ~ard and seconded
by Hillman. All were in favor. Christensen explained that he would take Hamilton's
description to be true and correct and that he would not be responsible if
Hamilton had made a mistake.
East Evan's Lane- All residents were served notices about the dispute over
water connections by Hensley on February l?, 1959. Several of the residents on
that Lane were present and a lenghty discussion of the matter followed. The
decision reached by the Board and the residents was that the residents will have
to settle the property dis?ute first. The way it is now, there is no legal place
to put a water line, as the Village does not have an easement there. McOmber has
as easement and it is recorded at the Court House. The property owners are to
get together, hire an attorney, and sue McOmber to get it straightened out.
They are to do this in the very near future. The Board reserves its right to shut
off the water and proceed on the original papers served on the residents on
February l?, ~959. It was explained to the residents that all property on that
Lane is Private Property and the Village has no right there.
Kenneth Campbell - Christensen assumes that his check is still tied up. He has
not heard from the Railroad yet. As soon as Christensen gets any money on this
matter he ;~ll turn it over to the Village. Christensen was excused at 9:30
The meeting was continued with the regular order of business.
Bills for the month presented to the Board. ~otion to approve payment of bills
made by Hillman, seconded by Fenwick. All in favor. Bills as follows: C.Hensley-
133.05, C.Christensen-hO.O0, G. Valenty-h6.62, Guaranty Ins.-5.O0, C.Ed Flandor-~.50,
Phone-15.90,Idaho Power-68.12 & 95.17, Triangle Service-lO.99, Phillips-2.89
Continental Oil-2?. 79, A.J.Brennan-3?.O0 and J.Pierce-lh. 50. Financial ~eport for month then presented to Board.
Old Business- Briscoe Lane- Valenty checked that Lane and found three houses
on the west end are out of the Village Limits. The clerk has a list of thes® and
has notified them of the change in water rates for them.
~ex Coffin- hasn't paid that ~hird connection on East Chubbuck R~ad yet. The
clerk is to notify Cap Hillman that his water will be shut off if the connection
is not paid by April 10, 1959. Coffin wants to build more houses in that addition
and he intInds to use plastic line. He wants to use i inch plastic line for 3
houses. The Board will insist on a h inch line and they will not allow plastic
to be used.
Sewer Line- Hamilton is still working on the survey. A rough estimate of the
count of homes in the Village, and approximately 6 miles of main trunk line
the cost would be 5.00 per month for the initial work. They are still working on
the figures and this may change after they do more figur~n~.
Health Inspection- Explained again by Valenty. There will be no action on t_his
till the Board has had a discussion with Ivan Frazier about the matter. They want
to know just what it i~ all about.
Proposed Ordinance ~ h5, an Ordinance re~ating to the collection of delinquent
water accounts and providing for the shutting off of the water to any delinquent
water users, was then read in full by Valenty. A ~otion to suspend the rules,
read once in full and twice by title, was then made by~ard, seconded byFrasure.

The Ordinance was then read twice by title by Valenty.

Propose4 Ordinance # 46 then read in full by Valenty for the second time.
Proposed Ordinance # h6 is an Ordinance calling for a change of name of one
of the Village streets, namely Athol to be changed to Canal Avenue.
A Notion to suspend the rules and read once more by Title made by Hillman,
seconded by Frasure.

The Orainance was then read once again by Title.

New Business- The Drive In Theatre wants a water hook-up ~clth the Village water.
They would like for the Village Board to set a rate. ~ill pay a monthly rate
for a full year and not just when the theatre is open. They will want an l½ inch
connection. The Armstrong Laundrocenter also has an l½ inch connection and these
two rates were discussed by the Board~ after which a motion was made by Hillman,
and seconded by Fenwick to set the rates as follows: The Drive In Theatre is to
pay a flat rate of 15.00 per month the year around, and the Laundrocenter is to
pay lb.50 per month. All -~ere in favor.

P.S. On March 12, 1959 'at 10;O0 A.M., John Valenty, Chairman of the
Board stopped publication of Ordinance #h6, calling for a change of the
name of Athol Street to Canal Ave. Some of the people on the street
~ere complaining that they did not like the choice of name.
