CALL TO ORDER: Mayor England
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Evans
COUNCIL PRESENT: Melanie Evans, Roger Hernandez, and Norman Reece.
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Public Works
Director Bridger Morrison, Planning Manager Don Matson, Human Resource Director Scott
Gummersall, Police Chief Nick Sasser, City Treasurer Rich Morgan, and City Clerk Joey
Bowers.
Mayor England excused Councilmember Dan Heiner from the meeting.
APPROVAL OF MINUTES: November 19, 2025.
Councilmember Reece motioned for approval of the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes.
Roll Call: Evans -yes, Hernandez -yes, Reece -yes, motion passed.
GENERAL BUSINESS:
1. Approval of the 2026 Beer, Wine and Liquor Licenses.
(Council will discuss if all City, State and County requirements have been completed).
Councilmember Hernandez motioned to approve the 2026 Beer, Wine, and Liquor Licenses as
presented. Councilmember Reece seconded motion for approval.
Roll Call: Hernandez -yes, Reece -yes, Evans -yes, motion passed.
2. Approval of Items for Auction or Disposal.
(Council will discuss City property for auction or disposal).
Councilmember Reece motioned for approval of items for auction or disposal.
Councilmember Evans seconded motion for approval.
Roll Call: Reece -yes, Evans -yes, Hernandez -yes, motion passed.
3. Approval to Appoint Brandon Desfosses to the Chubbuck Development Authority.
(The council will discuss an appointment to the CDA Board).
Mayor England presented Brandon Desfosses to serve on the CDA Board.
Councilmember Hernandez motioned to approve the appointment of Brandon Desfosses to the
Chubbuck Development Authority Board.
Councilmember Evans seconded motion for approval.
Roll Call: Evans -yes, Hernandez -yes, Reece -yes, motion passed.
4. Acceptance of the City Clerks Declaration of Elected for Roger Hernandez to Council
Seat #2 pursuant to Idaho Code 50-405. (Council will discuss that such candidates are duly
elected for their respective terms, and will be installed at the first city council meeting in January).
Councilmember Evans motioned for approval of the City Clerk's Declaration of Elected for
Roger Hernandez Council Seat #2 pursuant to Idaho Code 50-405.
Councilmember Reece seconded motion for approval.
Roll Call: Hernandez -yes, Reece -yes, Evans -yes, motion passed.
5. Acceptance of 2025 Election Results.
(Council will discuss the official election results from the county)
Councilmember Reece motioned for acceptance of the 2025 Election Results.
Councilmember Hernandez seconded motion for approval.
Roll Call: Reece -yes, Evans -yes, Hernandez -yes, motion passed.
6. Discussion about the December 17, 2025 Council Meeting.
CLAIMS:
The December 17, 2025 Council Meeting will be canceled.
City of Chubbuck claims for December 3, 2025 as presented to Mayor England and
Council.
Councilmember Reece motioned to approve the City of Chubbuck Claims as presented.
Councilmember Hernandez seconded motion for approval.
Roll Call: Evans -yes, Hernandez -yes, Reece -yes, motion passed.
ADJOURN: Mayor Kevin England adjourned at 6:08.

Declaration of the City Clerk
I, Joey Bowers, City Clerk for the City of Chubbuck, pursuant to Idaho Code § 50-405 do hereby
declare the following individual elected, and to be installed at the first city council meeting in 2026: for
Seat No. 2 Roger Hernandez for a term of 4 years, This Declaration is made based on the following:
Idaho Code § 50-405 states, inter alia, that "(1) A general election shall be held in each city
governed by this title, for officials as in this title provided, on the Tuesday following the first Monday of
November in each odd -numbered year. All such officials shall be elected and hold their respective
offices for the term specified and until their successors are elected and qualified. All other city elections
that may be held under authority of general law shall be known as special city elections." Idaho Code §
50-405(2)(a) then states that "No city election shall be held for an office if, after the deadline for filing a
declaration of intent to be a write-in candidate for the office, it appears:...
(ii) For the office of city council member in cities that have established designated seats, as
provided in section 50-707, Idaho Code, only one (1) person has filed a declaration of candidacy
or a declaration of intent to be a write-in candidate for a particular seat up for election for a two
(2) year term or a four (4) year term;....
Since the City of Chubbuck has established designated seats, and the time for filing a declaration
of candidacy or a declaration of intent to be a write-in candidate for a particular seat has run, and only
one person has declared for Seat No. 2 (Roger Hernandez), it is appropriate pursuant to Idaho Code §
50-405(2)(b), to make the above declaration that these candidates are to be declared elected, receive a
certificate of election and be installed at the first city council meeting in January following the election.

that the attached is a full, true and complete copy of the abstract of votes
for the City of Chubbuck Mayor and Council Seat 4 Election as they
appeared on the ballot on November 4th, 2025 as shown by the record of
the Board of Canvassers filed in my office this 13th day of November,
2025.
