COUNCIL MEETING MINUTES
April 9th, 2002
Minutes of a regular meeting held at the Chubbuck City Council Chambers, April 9th, 2002.
Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, B.
Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin. Councilman Leroy S. Quick was excused.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Nolan J. Briscoe.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Special
Meeting Minutes of March 26th, 2002 and Regular Meeting Minutes of March 26th, 2002.
Councilman Kearns moved to approve Special Meeting Minutes of March 26th, 2002 and
Regular Meeting Minutes of March 26th, 2002 as read, Councilman England seconded.
All council members present voted in favor of motion.
BUSINESS LICENSE APPLICATION - Nolan J. Briscoe, 5178 Stuart Ave, Chubbuck, Idaho,
Briscoe's Sno Shack has applied for a business license to sell shaved ice drinks at 4837
Yellowstone Ave, (in front of Papa Murphy's Pizza).
Councilman Kearns moved to grant Nolan J. Briscoe a business license to sell shaved ice
drinks in front parking lot at 4837 Yellowstone Ave, Councilman Gunter seconded. All
council members present voted in favor of motion.
LAND
USE & DEVELOPMENT COMMISSION MEMBER APPOINTMENT - Mayor Cotant
presented the name of Jason Mendenhall to serve on the Land Use & Development
Commission, his term expires on June lst, 2004.
Councilman England moved to direct Mayor Cotant to appoint Jason Mendenhall to serve
on the Land Use & Development Commission until his term expires on June 1 ~t, 2004,
Councilman Kearns seconded. All council members present voted in favor of motion.
ORDINANCE #555 - annexing certain lands to be included within the boundaries and
jurisdictional limits of the City of Chubbuck, Idaho; specifying the zoning classification
which shall be applied to said lands newly annexed to the City of Chubbuck; directing the
Chubbuck City Clerk to comply with the filing requirements contained in Idaho Code
Section 63-2215; repealing prior conflicting ordinances.
Attorney Holmes read Ordinance #555 in full for the first and final reading.

Councilman Gunter moved to dispense with rule of reading Ordinance #555 on three
separate days, Councilman Gunter seconded. Roll Call Vote: Quick, absent; England, yes;
Gunter, yes; Kearns, yes.
Councilman England moved to adopt Ordinance #555 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, absent; England, yes; Gunter, yes; Kearns, yes.
ORDiNANCE - Providing for a change of Land Use District with respect to certain lands within
the boundaries of the City of Chubbuck from Agricultural, (A) to General Commercial,
(C-2); declaring that the City Council finds that such change in Land Use District is
compatible with the Land Use Pattern prescribed by the City's Comprehensive Plan.
Knudsen property south of Redman Lateral and North of 1-86.
Attorney Holmes read ordinance in full for the first reading.
Council tabled the ordinance until the April 23~d, 2002 Council Meeting.
PROCLAMATION ~ "A DAY OF REMEMBRANCE" - Mayor Cotant read the proclamation in
full.
Councilman Kearns moved to direct Mayor Cotant to proclaim February 19th, 2002 a
"Day of Remembrance" in the City of Chubbuck, Councilman England seconded. All
council members present voted in favor of motion.
PROCLAMATION - "MOTORCYCLE AWARENESS MONTH" - Mayor Cotant read the
proclamation in full.
Councilman England moved to direct Mayor Cotant to proclaim the month of May to be
"Motorcycle Awareness Month", 2002, Councilman Kearns seconded. All council
members present voted in favor of motion.
REQUEST FOR APPROVAL OF DESTRUCTION OF SCANNED POLICE REPORTS -
Police Department presented a list of scanned police department documents to be
destroyed.
Councilman Gunter moved to authorize destruction of scanned police documents as
presented, Councilman Keams seconded. All council members present voted in favor of
motion.

EAST
CHUBBUCK ROAD CONSTRUCTION ~ City received signed petitions from the
residents on E. Chubbuck Road from Hiline Road to City Limits that will be affected by
the road expansion project the City proposes. The petition states the residents want the
City to either do the project complete by obtaining enough property to install curb, gutter
and sidewalks along both sides, or not do the project at all. There were one or two people
that might not be willing to give the easement to have the sidewalk, curb and gutter
installed.
Mayor Cotant suggested the City proceed with the reconstruction orE. Chubbuck Road.
The Council present felt the City should proceed.
Councilman England moved to instruct the Staff to proceed with the E. Chubbuck Road
construction project from Hiline Road to east City Limits, Councilman Gunter seconded.
All council members present voted in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
Councilman Keams moved to approve computer print-out claims as presented,
Councilman Gunter seconded. All council members present voted in favor of motion.
At 8:05 p.m, Councilman England moved, Councilman Gunter seconded with full council
approval to adjourn meeting.
