COUNCIL MEETING MINUTES
March 12th, 2002
Minutes of a regular meeting held at the Chubbuck City Council Chambers, March 12th, 2002.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Brady Lawson.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of February 26th, 2002.
Councilman Kearns moved to approve regular meeting minutes of February 26th, 2002
with the following addition and correction; 1) Page 41, the City is asking the property
owners to deed an 8' easement to the City, 5' for construction of a sidewalk and 3' for
construction and utility easement. 2) Delete duplication in title of Ordinance #553,
(amending Section 17.16.240 to require execution of a development agreement),
Councilman Gunter seconded. All council members voted in favor of motion.
FINAL DEVELOPMENT PLAN - PARK MEADOWS DEVELOPMENT - Final Development
Plan for a planned unit development, (PUD) located in the NW 1/4, Section 9, Township
6 South, Range 34 East. B.M. containing 160 acres, more or less. This property is located
in Bannock County, Idaho north ofi-86, east of Philbin Road and south of West
Chubbuck Road.
Councilman England moved to accept the Park Meadows Development Plan as presented,
Councilman Kearns seconded. All council members voted in favor of motion.
PROPOSED FEE INCREASES FOR LAND USE APPLICATIONS - Asst Planning Director
Larry Kohntopp stated he reviewed the Land Use Fees the City of Pocatello charge, the
City of Chubbuck is charging a lot less than should be charged. APD Kohntopp presented
comparisons between the following cities: Blackfoot, Eagle, Idaho Falls, Pocatello and
Nampa.
Deputy Clerk Myma Crapo and APD Kohntopp explained how they came up with the
costs of Land Use applications.
Mary Harker, Land Use Development & Commission member suggested the City give
each developer a complete package of the actual costs of Land Use fees. Mrs. Harker
suggested there be a lower fee for an individual that wants to develop one or two lots.

Derek Leslie, President of Building Contractors Association stated his organization
would like to be involved in any study sessions regarding the proposed fee increases for
Land Use applications. Mayor Cotant said the City Staff will contact the Building
Contractors Association, advising them of any study sessions regarding the proposed fee
increases.
Darris Ellis agreed with Derek Leslie, he asked the Building Contractors Association be
invited to any study sessions regarding fee increases that affect their association.
Wally Wright, Land Use and Development Commission member spoke in favor of the
proposed fee increase. Mr. Wright felt the City of Chubbuck needs to charge the same as
Pocatello.
Council tabled the proposed fee increases for Land Use Applications until the March 26%
2002 Council Meeting.
ORDINANCE - Adopting Chapter 2.34, Tree Advisory Commission and Standards.
Mayor Cotant read by title only for the third reading by title.
Council tabled the ordinance until March 26th, 2002 Council Meeting.
BID - BENCH PUMP STATION PROJECT - Mayor Cotant and Council were given a letter
from Keller Associates summarizing an evaluation of the bid documents that were
submitted by the apparent low bidder for the City of Chubbuck Bench Pump Station
Project. The Bidders and their respective bids are summarized:

Based on the information supplied by the apparent low bidder, Harris Brothers
Construction, Inc, Keller Associates has determined the bids appear to be valid and
complete. Keller Associates further recommends that the City of Chubbuck make award
of the contract to Harris Bros Construction.

EAST BENCH BOOSTER STATION - (cont.)
Councilman Keams moved to authorize Mayor Cotant to enter into agreement with the
low bidder Harris Bros. Construction on the East Bench Booster Station Project,
Councilman England seconded. All council members voted in favor of motion.
PROCLAMATION - "GIRL SCOUT WEEK" - Mayor Cotant read the proclamation in full.
Councilman Quick moved to direct Mayor Cotant to proclaim March 10th through March
16th, 2002 as "Girl Scout Week" in the City of Chubbuck, Councilman Gunter seconded.
All council members voted in favor of motion.
BID - SELL OF THREE POLICE DEPARTMENT VEHICLES - City Clerk Conlin said the
three Police Department vehicles have been advertized in the Idaho State Journal as
required by Idaho Code, The City received one bid:

Acting Police Chief Richard Webb said he felt good about the $7,250.00 bid received..
Councilman England moved to authorize Mayor Cotant to accept the bid of $7,250.00 for
the three Police Department vehicles, Councilman Quick seconded. All council members
voted in favor of motion.
ACCEPTANCE OF OFFER OF DEDICATION - GARDEN PARK SUBDIVISION - On June
8th, 1999, the final plat of Garden Park Subdivision was approved by the Chubbuck City
Council.
Councilman Gunter moved to accept the Garden Park Subdivision Offer of Dedication as
presented, Councilman England seconded. All council members voted in favor of motion.
ACCEPTANCE OF OFFER OF DEDICATION - GARDEN OAKS DIVISION NO. 1 - On May
24th, 2000, the final plat of Garden Oaks Division No. 1 was approved by the Chubbuck
City Council.

ACCEPTANCE OF OFFER OF DEDICATION - GARDEN OAKS DIVISION NO 1 - (cont.)
Councilman Keams moved to accept the Garden Oaks Division No. 1 as presented,
Councilman Quick seconded. All council members voted in favor of motion.
ACCEPTANCE OF OFFER OF DEDICATION - GARDEN OAKS DIVISION NO. 2 - On May
8th, 2001, final plat of Garden Oaks Division No. 2 was approved by the Chubbuck City
Council.
Councilman Kearns moved to accept the Garden Oaks Division No. 2 as presented,
Councilman Quick seconded. All council members voted in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
Councilman England moved to approve computer print-out claims as presented,
Councilman Gunter seconded. All council members voted in favor of motion.
At 8:15 p.m., Councilman England moved, Councilman Gunter seconded, with full council
approval to adjourn meeting.
