ORDINANCE NO. 234 <br /> <br />CITY OF CHUBB~CK, IDAHO <br /> <br />AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING <br />SECTION 6(4) OF ORDINANCE NO. 180 OF THE CITY OF CHUBBUCK, <br />IDAHO, TOPROVIDE THAT ALL TEMPORARY FIREWORK STANDS SHALL <br />BE PROVIDED WITH ABC DRY CHEMICAL TYPE FIRE EXTINGUISHERS <br />AND FURTHER AMENDING ORDINANCE NO. 180 BY THE INSERTION <br />OF A NEW SUB'SECTION 6(12) REQUIRING THAT ALL TEMPORARY <br />FIREWORKS STANDs BE PROVIDED WITH FIFTY-FIVE (55) GALLON <br />BARRELS WHICH SHALL BE KEPT FULL OF WATER AT ALL TIMES; <br />REPEALING ALL PRIOR ORDINANCES IN CONFLICT WITH THIS <br />ORDINANCE TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR <br />THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND <br />PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. <br /> <br /> BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF <br />CHUBBUCK, IDAHO: <br /> <br />City <br /> <br />SECTION 1: Section 6(4) of Ordinance No. 180 of the <br /> <br />of Chubbuck, Idaho, is hereby amended to read as follows: <br /> <br />SECTION 6: Temporary Fireworks Stands. Ail permitted <br />activities shall be conducted from within a temporary <br />fireworks stand, and the conduct of such activities <br />from any other building, structure, or site is prohibited. <br />Temporary fireworks stands shall be subject to the <br />following regulations: <br /> <br /> (4) Each stand shall be provided with two (2) <br />two and one-half (2½) pound ABC Dry Chemical type fire <br />extinguishers, in good working order, and easily <br />accessible for use in case of fire. <br /> <br /> SECTION 2: Section 6 of Ordinance No. 180 of the City of <br />Chubbuck, Idaho, is hereby amended by the insertion of new <br />Sub-section 6(12) to read as follows: <br /> <br /> (12) Each stand shall be provided with one (1) <br />two (2) gallon bucket and one (1) fifty-five (55) <br />gallon open top barrel with removable lid. The fifty-five <br />(55) gallon barrel shall be kept full of water and <br />covered at all times. This requirement may only be <br />waived by written order of the Fire Chief of the City of <br />Chubbuck. <br /> <br /> SECTION 3: Ail prior ordinances and parts thereof, which <br />contain provisions in conflict with the provisions of this <br />ordinance, are hereby repealed to the extent of such conflict. <br /> <br /> SECTION 4: If any provision of this ordinance is held <br />invalid, for any reason, by any court of competent jurisdiction <br />such holding shall not affect the validity or enforceability, <br />of any of the remaining provisions. <br /> <br /> <br />
