ORDINANCE NO. 511 <br />AN ORDINANCE OF THE CITY OF CHUBBUCK, A MUNICIPAL CORPORATION <br />OF IDAHO, ENACTING A NEW SECTION 9.08.240 TO CHUBBUCK MUNICIPAL <br />CODE; PROHIBITING THE POINTING OF ANY LASER OR SIMULATED LASER <br />DEVISE AT ANOTHER PERSON OR ANIMAL FOR ANY PURPOSE OTHER THAN <br />IN AN EDUCATION, INSTRUCTIONAL, OR EMPLOYMENT PRESENTATION; <br />PROVIDING DEFINITIONS; PROVIDING OR THIS ORDINANCE TO BE IN FULL <br />FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND <br />PUBLICATION ACCORDING TO LAW, THE RULE REQUIRING THAT AN <br />ORDINANCE BE READ ON THREE SEPARATE OCCASIONS HAVING BEEN <br />DISPENSED WITH. <br />WHEREAS, there has been growing concern nation-wide over the misuse of both laser <br />pointer devises as well as simulated laser pointer devises; and <br />WHEREAS, even if the devises are of such low amplication and limited range that their <br />contact with human or animal bodies will not in itself cause physical harm, inasmuch as the light <br />projected resembles the light projected by laser sights on certain weapons, it is likely that the sight <br />of the light projected by the pointers will cause reactions which can be harmful to the public, <br />causing injury and even death; and <br />WHEREAS, the City Council has determined that it would be in the interests of public <br />welfare and safety to educate citizens concerning the dangers of use of the devices outside of an <br />educational, instructional, or employment presentation and to prohibit any such use; <br />NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE <br />CITY OF CHUBBUCK AS FOLLOWS: <br />Section 1: That a new Section 9.08.240 "Misuse of Laser Pointer Devices" be enacted to <br />read as follows: <br />ORDINANCE NO. 240 - Page 1 <br />dm chbbck06.255 <br />
