(Action Item) PUBLIC HEARING: The City Council of the City of Chubbuck, Idaho, will hold a public hearing for consideration of a proposed amended budget for the fiscal period October 1, 2018 to September 30, 2019: and an amended fiscal appropriation ordinance for said period, and pursuant to the provisions of Section 50-1002, 50-1003, 50-1106, Idaho Code, said hearing to be held at the Chubbuck Council Chambers at 5160 Yellowstone Ave, Chubbuck, Idaho, at 6:00pm Wednesday October 2, 2019. At said hearing, all interested persons may appear and show cause, if any they have, why said amended budget should not be adopted or why the fiscal appropriation ordinance as amended should not be approved in accordance there with. PROPOSED EXPENDITURES The following is an estimate, set forth in said amended budget of the proposed increases in expenditure of the City of Chubbuck, Idaho, for the period October 1, 2018 to September 30, 2019. All other expenditures shall remain without change as set forth in the original appropriation ordinance adopted August 15, 2018. Said amounts are set forth by fund as follows: Fund Original Expenditure Proposed Expenditure Net Increase Highway Streets & Rd $1,727,280 $3,074,798 $1,347,518 2. An application for a zone change to C-2 General Commercial for the western portion of the property that is currently zoned R-2 Limited Residential; the total property consists of approximately 2.38 acres. The subject property is located within the Northeast 114 of the Southwest 114 of Section 3, Township 6 South, Range 34 East, of the Boise Meridian, Idaho. Subject property is generally located on the northwest corner of Mingo and Yellowstone at 122 Mingo Lane. On September 10, 2019, following a public hearing and deliberation, the Land Use and Development Commission recommended approval of the application. GENERAL BUSINESS: 1. Approval to Amend the FY2019 Budget for Highway Streets & Road. (Action Item). (Council will discuss amending the FY2019 Budget to Increase highway streets and roads from $7,727,280 to $3,074,798 a net increase of $7,347,578). 2. Approval of Zone Change from Residential (R-2) to Commercial (C-2). (Action Item). (Council will discuss a change in land use from Residential (R-2) to Commercial (C-2)). 3. Approval of M & K Subdivision Preliminary Plat. (Action Item). (Council will discuss the application and if it meets City code). 4. Approval of the Property Contract for the New City Hall. Presentation on a Pine Ridge Mall Urban Renewal Revenue Bond. Rob Kingsbury represented the group from Farmer Holding Company. Farmer Holding Co. owns the Pine Ridge Property. Mr. Kingsbury presented to the council, an update, on what Farmer Holding is trying to do in asking the Chubbuck Development Authority to issue bonds, against the Pine Ridge Mall TIF revenue to free up new equity to further the improvement of the property. APPROVAL OF MINUTES: Council Meeting Minutes and Study Session Minutes from September 4, 2019. Councilmember Lewis motioned for approval of the minutes. Councilmember Evans seconded the motion for approval of the minutes. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes, motion passed. PUBLIC HEARING: To consider public comment regarding the Bannock County landfill per ton disposal charge, a permanent electrical service fee, a solar panel fee, a Master Services inspection fee, and a variance fee to planning services. City staff explained the fees. Mayor England declared the public hearing open. Niki Taysom, who lives at General Delivery, testified against the fees. There being no other comment, Mayor England closed the public hearing. GENERAL BUSINESS: 1. Adoption of Resolution 2019-07 City Fees. Councilmember Lewis motioned for the adoption of Resolution 2019-07 with the following changes. The resolution is to be effective from October 1, 2019 until next modified, Exhibit C Master Service Inspection fee would be $15 and Exhibit D would include a Residential Permanent Service Fee of $30. Councilmember Baumeister seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes Approval of the Falls PUD final Development Plan Amendment. Johnathan Vincent testified there has been no changes with the Falls PUD final development plan amendment. Don Matson stated that the PUD plan amendment is acceptable to the City, meets City Code and City staff recommends approval with the approval of construction drawing by City staff. Councilmember Baumeister motioned for the adoption of the Falls PUD final development plan amendment. Councilmember Evans seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes 3. Approval of the Falls Subdivision Final plat. Johnathan Vincent testified there has been no changes from the approved preliminary plat to the final plat. Don Matson stated that there are no changes from the preliminary plat to the final plat. There will be an expanded entrance and addition of sidewalks on the construction drawings. City Staff recommends approval. Councilmember Baumeister motioned for the approval of the Falls Subdivision Final Plat with an expanded entrance and the addition of sidewalks and contingent on the approval of construction drawings. Councilmember Hernandez seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes 4. Approval of the FY20 Health Plan Trust Contribution. Scott Gummersall presented the financial status of the City's Health Plan Trust and explained that the State Department of Insurance is requiring that the Trust carry 3 times the monthly contribution in the fluid balance. This will require the City transfer $200,000 to the Health Plan Trust, Councilmember Baumeister motioned for the approval of the Health Plan Trust Contribution. Councilmember Hernandez seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes S. Approval of Beer and Wine License for Family Dollar. Family Dollar has applied for a beer and wine license. They have been given a state and county beer and wine license. Councilmember Lewis motioned for the approval of a Beer and Wine License for Family Dollar. Councilmember Baumeister seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes 6. Acceptance of Chubbuck Elementary Child Pedestrian Safety Project Bids Rodney Burch explained that the current bids for the project came in much higher than expected. The City believes it can get more favorable bids in the spring and the grant administrator is willing to work around this time frame. No action was taken. 7. Approval of the New City Hall / Downtown Planning. Rodney Burch explained where the City is with the New City Hall project including the lot specifically for City Hall and the land surrounding the New City Hall lot that will be purchased by the Chubbuck Development Authority. Councilmember Baumeister motioned to authorize the Mayor to sign purchase agreement for the land in this project as presented. Councilmember Hernandez seconded the motion. Roll Call: Lewis -yes, Baumeister -yes, Evans -yes, Hernandez -yes Approval to seek Sole Source Procurement in accordance with IC 67-2808. Rodney Burch has ask for approval of sole source procurement for purchase of a CAT Backhoe. The City would like the new backhoe to be compatible with current equipment previously purchased from the sole vendor. Councilmember Hernandez motioned for the approval of sole source procurement. PLEDGE OF ALLEGIANCE Tyler Broadhead From Scout Troop 343 Stoddard asked if any commissioners had a conflict of interest within the items before the board tonight. Dan Stoddard stated that he worked for a competing company but didn't feel like there was a conflict of interest. II. APPROVAL OF MINUTES for August 6, 2019 and August 13, 2019 Stoddard entertained a motion to approve the minutes as emailed. Rebecca Berls had a correction to the August 13, 2019 minutes. TJ Budge motioned to approve the minutes of August 6, 2019 and August 13, 2019 with the correction request from Rebecca Berls; Rebecca Berls seconded. The full authority approved, motion passed. The applicant is requesting a zone change on the south west corner from residential to commercial to match the rest of the property. TJ Budge asked about Mingo Lane. Mr. Taylor stated that the applicant will be dedicating their portion of Mingo Lane to the City. City Planner Paul Andrus stated that City Staff had reviewed the application and believed it meets City standards and complies with the comprehensive plan. Brandon Jackson motioned that this board recommend that the City Council approve the rezone of approximately 2.38 acres from Limited Residential (R-2) to Commercial (C-2), as set forth in the application. An application for a Preliminary plat for M&K Subdivision to combine several unplatted parcels into one commercial lot consisting of approximately 2.38 acres. Subject property includes is generally located on the northwest corner of Mingo and Yellowstone at 122 Mingo Lane. Type of Action: Recommendation to City Council. (Action Item) Tom Taylor from Keller Associates represented the applicant. Mr. Taylor stated that this application will be combining four lots into one subdivision. Mr. Taylor also stated that the applicant will be providing a 20ft easement around the current utilities, and a loft public utility easement around the exterior of the subdivision. The applicant will also be dedicating the ground for Fern Street, and Mingo Lane to the City. City Planner Paul Andrus stated that City Staff had reviewed the application and believed it meets City standards and complies with the comprehensive plan. Mr. Andrus stated that City Staff recommends approval conditional upon a plan to be submitted for the north east corner water rights, and stamped construction plans with corrected certificates be submitted to City Staff with the final plat. Dan Stoddard asked about using the water rights for secondary irrigation. Mr. Andrus stated that it's difficult for these developments to get enough water and to manage the window for those rights to make that work. TJ Budge asked about Fern Street. Mr. Andrus stated that the applicant will continue to use and maintain the dedicated property on Fern Street, until the City deems it for public use. Stoddard entertained a motion. Brady Smith motioned that this board recommend that the City Council approve the preliminary plat for M&K Subdivision to combine several unplatted parcels into one commercial lot, with recommendations from City Staff.
