Bannock Gmmt¥, Idaho THIS A~J~, ~ade and entered into this ~7.~da~ of ~, 1962, by and between the State of Idaho, Department of Highways, Party of the First Part, hereinafter called the State, and the Village of Chubbuck, Idaho, Party of the ~ee~nd Part, hereinafter called the Village. WlTNESSETH: WHEREAS, the Parties have mutually agreed that it is in the public interest to construct a part of U.S. Interstate Highway 15W with connections to local streets, within the corporate limits of the Village of Chubbuck, Ban- nock County, Idaho, which improvements are to be made in accordance with the attached plans entitled Exhibit ,A", Federal Aid Interstate Highway Project 1-15W-4(~)71, which plans are made a part of this agreement; and WHEREAS, The State, in acquiring property for the project, will be- come the ~ner of certain domestic water facilities consisting of a well, pump and distribution lines located within the ri?hr of way to be used for relocat- ing Burnside Road; and WHEREAS, the State will be oblif~.ted to assure uninterrupted water service to the properties now serviced by the ~aid water ~tem~ and WHEP~$, the State is not organized or equipped to install or main- tain the said water systems and WHEP~EA$, the said water ~ystem is within the Village of Chubbuck but is not a part of the Villa~,e ~ystem; and WHEREAS, the existing pump and well are not capable of furnishing a safe and constant flow of water to the said water system. WNERFA$, it is in the public interest to connect the said water system to the Village water system; and WHEREAS, it will be the responsibility of the State to pay for all costs associated with the extension of the Village water system; and WHEREAS, the public interest will best be served if the Village owns and operates the ~aid water system.
