HomeMy WebLinkAbout0199 Annexation Siphon/Union Pacific RR 1979CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 199 ~ ORDINANCE, OF THE CITY OF CHUBBUCK,, IDAHO, REPEALING AND IN SUBSTITUTION FOR CHUBBUCK CITY ORDINANCE NO. 195, ~NEXING CERTAIN LANDS ~OWN AS THE "NORTHSIDE PLAZA" TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO: SPECIFYING THE ZONING CLASSIFICATION WHICH SILALL BE APPLIED TO SAID L~DS; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-2215; AND PROVIDING Wt~N THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: Repeal and Substitution. Ordinance No. 195 of the City of Chubbuck, Idaho, passed and approved on March 13, 1979, is hereby repealed and this ordinance substituted therefor. SECTION 2: Annexation. The following described lands, located within Bannock County and contiguous to the existinK boundaries of the City of Chubbuck, Idaho, are herebv annexed and included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: A parcel of land situated in the East 1/2 of Section 34, Township 5 South, Range 34 East, Boise Meridian, Bannock County, Idaho, more particularly described as follows: Commencing at the South quarter corner of said Section 34, said South quarter corner being a 1/2 inch iron pin; thence North 0° 01' 13" West, along the meridional centerline of Section 34- 39.93 feet, more or less, to the Northerly line of Siphon Road, the same being the True Point of Beginning; thence continuing along the said meridional centerline North 0° 01' 13" West, 1711.41 feet, more or less; thence South 89° 31' 57" East, 1529.71 feet, more or less, to the Westerly right-of-way line of the Union Pacific Railroad; thence South 1° 26' 18" East, along said Westerly right-of-way line, 1703.72 feet, more or less, to the Northerly right-of-way line of Siphon Road; thence N~rth 89° 31' 57" West, along said Northerly right-of-way, 1568.36 feet, more or less, to the True Point of Bezinning. SECTION 3: Zoning. The above-described lands newly annexed to the Citv of Chubbuck, Idaho, shall be subject to the zoning classification of light industrial (M-I). SECTION 4: Filing. The Chubbuck City Clerk is hereby directed to comply with the filing requirements contained in Idaho Code section 63-2215. SECTION 5: Effective Date. The requirement that ordinances be read on three separate occasions is hereby dispensed with and this ordinance shall become effective upon its passage, approval and publication as provided by law.
