SS.
A special meeting of the City Council (herein
"Council"), of the City of Chubbuck (herein "City") in the
County of Bannock and State of Idaho, was held on Saturday ,
the 12t.h day of February, 1972, at the hour of 5:00o'clock
_R.m., at the City Hall, 5160 Yellowstone in the
City, being the regular meeting place of the Council, at
which meeting there were present and answering the roll call
the following, who constitute a quorum:

Absent: None
constituting all the members thereof.
There were also present:
City Clerk: Vera C. Armstronq
City Attorney: Joseph G. Wise
Thereupon, the following proceedings, among others
were duly had and taken:
Councilman Romriell introduced and moved
the adoption of an ordinance entitled: "An ordinance relating
to the sewer system of the City of Chubbuck, Idaho; providing
for a special election at which there shall be submitted to
the electors qualified to vote thereon the question of issu-
ing sewer revenue bonds of the City for the purpose of defray-
ing in part the cost of constructing a sewerage system; pre-
scribing details in connection therewith; ratifying action
previously taken concerning said sewer system and said bonds;
and providing the effective date hereof."
The motion was made by Councilman Menard
and seconded by Councilman Taylor that the rules re-

quiring ordinances of a general and permanent nature to be
fully and distinctly read on three different days be dis-
pensed with and that said ordinance be read in full and at
length and placed upon its final passage.
Thereupon, the Clerk was ordered to call the roll
on said motion and the roll call upon said motion was as
follows:

The Mayor thereupon declared that the motion, having
been duly passed by not less than one-half (1/2) plus one (1)
of the members of the full Council, had been duly carried.
The ordinance was then read by the Clerk in full and at length
as follows:

ORDINANCE NO. ;~) ~
AN ORDINANCE RELATING TO THE SEWER SYSTEM OF
THE CITY OF CHUBBUCK, IDAHO; PROVIDING FOR A
SPECIAL ELECTION AT WHICH THERE SHALL BE SUB-
MITTED TO THE ELECTORS QUALIFIED TO VOTE THERE-
ON THE QUESTION OF ISSUING SEWER REVENUE BONDS
OF THE CITY FOR THE PURPOSE OF DEFRAYING IN
PART THE COST OF CONSTRUCTING A SEWERAGE SYS-
TEM; PRESCRIBING DETAILS IN CONNECTION THERE-
WITH; RATIFYING ACTION PREVIOUSLY TAKEN CON-
CERNING SAID SEWER SYSTEM AND SAID BONDS; AND
PROVIDING THE EFFECTIVE DATE HEREOF.
WHEREAS, the City of Chubbuck (herein "City")
in the County of Bannock and State of Idaho, is a municipal
corporation duly organized and existing as a City under
the general laws of the State of Idaho; and
WHEREAS, the City is presently without any sewage
collection and treatment facilities; and
WHEREAS, the City Council (herein "Council") has
determined and does hereby determine that the interest of
the community and the public interest and necessity require
the construction and acquisition of a municipal sewerage
system (herein the "Project"); and
WHEREAS, for the purpose of defraying a part of
the cost of acquiring the sewer Project, the Council further
deems it necessary to issue its sewer revenue bonds in the
aggregate principal amount of $1,000,000.00, or so much
thereof as may be necessary, payable solely from the reve-
nues of said sewer system as so constructed pursuant to the
Revenue Bond Act cited as Sections 50-1027 through 50-1042,
Idaho Code, and all laws thereunto enabling; and
WHEREAS, the City has never pledged the revenues
derived from the operation of the sewer system for the redemp-
tion of revenue bonds payable from such revenues, or other-
wise, with the result that the net revenues to be derived
from the operation of the system may be pledged lawfully
and irrevocably to secure the repayment of said revenue bonds
herein authorized pursuant to the Revenue Bond Act; and
WHEREAS, said revenue bonds shall not be a debt
of the City and it shall not be liable thereon, nor shall
said bonds be payable out of any funds other than the revenue
from said system pledged to the payment thereof; and

WHEREAS, said revenue bonds cannot be issued
without the assent of two-thirds (2/3) of the qualified
electors of said City voting at an election held for the
purpose of authorizing or refusing to authorize said liabil-
ity or obligation; and
WHEREAS, neither the question herein set forth nor
any question for a similar purpose, has been defeated at an
election which has been held in the City within six (6)
months of the date of the adoption of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND
COUNCIL OF THE CITY OF CHUBBUCK, IDAHO:
Section 1. All action heretofore taken (not in-
consistent with the provisions of this ordinance) by the
Council and the officers of the City, directed toward:
a. The Project; and
b. The issuance of sewer revenue bonds therefor
be, and the same hereby is, ratified, approved and con-
firmed including the authorizing of bonds at an election
and the giving of notice thereof.
Section 2. Subject to the assent of two-thirds
(2/3) of the electors voting on the question, it is hereby
ordered that the Project be acquired and constructed and
that the sewer revenue bonds of the City, in the aggregate
principal amount of $1,000,000.00, or so much therefor as
may be necessary, be issued pursuant to the Act to defray
in part the cost thereof.
Section 3. The Project briefly and generally
described shall consist of the construction and acquisition
of a municipal sewerage system, including, without limitation,
collection lines, transmission lines and outfall and trunk
lines to the sewage treatment facility of the City of Poca-
tello, Idaho.
Section 4. The details of constructing the system
are more specifically shown and described in the preliminary
engineering report and 1972 addendum thereto prepared therefor
by Foregren, Perkins and Associates (herein "Engineer"). For
further details, reference is hereby made to said report and
addendum, which is now on file and available for inspection
in the office of the Clerk of the City.
Section 5. The cost of the Project, including all
incidental expenses, has been estimated by the Engineer to

be approximately $2,175,000.00. The City contemplates
issuing revenue bonds in the aggregate principal amoun~
of $1,000,000.00 or so much thereof as may be necessary.
The City anticipates that the balance of the cost will be
defrayed by federal grants of approximately $965,000.00
and a grant from the State of Idaho in the amount of approx-
imately $210,000.00. The amounts of these grants may vary
from these estimates depending upon the availability of
funds.
Section 6. Such sewer revenue bonds shall bear
interest at a rate or rates not exceeding 6% per annum,
payable annually, or at such lesser intervals as may here-
after be prescribed by ordinance; shall mature serially
(or in ~nstallments if one bond is issued representing the
entire principal amount of the bond issue) commencing 1
year and ending 40 years from the January 1 following delivery;
shall be payable solely from the revenues of the sewer system;
and may be made subject to prior redemption at such time or
times, with or without a premium, and upon such terms and
conditions as may be determined by the Council in the ordin-
ance authorizing said bonds.
Section 7. A special municipal bond election be,
and the same hereby is, called to be held on Tuesday, the
7th day of March, 1972, between the hours of 12:00 o'clock
noon and 8:00 o'clock p.m., on said day, for the purpose
of enabling the qualified electors of said City to vote upon
the question of issuing said sewer revenue bonds set forth
in the notice of election, the form of which is prescribed
by this ordinance.
Section 8. There shall be one voting precinct
with boundaries conterminous with those of the City.
Section 9. At said election the voting place and
officials serving thereat shall be as follows:

Section 10. The polls and ballot boxes shall
open at the hour of 12:00 o'clock noon on said day and
shall remain open continuously until the hour of 8:00
o'clock p.m. of said day, at which time the polls shall be
closed.
Section 11. The voting at such election on the
question of issuing sewer revenue bonds, shall be by
ballot substantially in the following form:

Section 12. The Clerk shall cause to be printed
not less than 15 days before the election, sample ballots
conta~ining the question to be submitted, which sample bal-
lots~shall be in the same form as the official ballots to
be used, except they shall have printed thereon the words
"sample ballot", shall be on paper of a different color than
the Official ballot and shall not be numbered, and the Clerk
shall furnish copies of the same on application at her office,
to anyone applying therefor. Said sample ballot shall be pub-
lished at least twice in the official newspaper of the City,
the last time to be within 5 days of the election.
Section 13. Ballots shall be furnished by the
City Clerk to the judges of the election to be by them
furnished to the voters. At said election only those per-
sons who are qualified to vote, as aforesaid, shall be per-
mitted to vote on said question.
Section 14. That notice of such municipal bond
election shall be given prior to said election by publish-
ing notice of election in Bannock County News a news-
paper published weekly in Chubbuck, Idaho, and of
general circulation in the City and the official newspaper
of the City, for at least once a week for two successive
weeks prior to such election, which notice shall be in sub-
stantially the following form:

PUBLIC NOTICE IS HEREBY GIVEN that a special
municipal bond election will be held in the City of Chub-
buck, Bannock County, Idaho, on Tuesday, the 7th day of
March, 1972, for the purpose of voting on the following
question:
SEWER REVENUE BOND QUESTION SUBMITTED:
Shall the City of Chubbuck, Idaho, issue and
sell its sewer revenue bonds in the aggregate
principal amount of $1,000,000.00, or so much
thereof as may be necessary, for the purpose
of providing funds with which to construct and
acquire a sewerage system, said bonds to mature
serially commencing 1 year and ending 40 years
from the January 1 following delivery and to
bear interest at a rate or rates not to exceed
6% per annum, as more fully provided in Ordin-
ance No. , signed and approved the
day of February, 1972, the principal of and
the interest on said bonds to be payable solely
from the net revenues to be derived from the
operation of the municipal sewerage system?
At such election only registered qualified elec-
tors of the City will be permitted to vote on the question
submitted.
A qualified elector shall be eighteen years of
age or older on the date of the election, a citizen of the
United States, and a resident of the State of Idaho for the
six months,~ and of the City of Chubbuck and County of Bannock
for the three months, immediately preceding said election.
The polls will open at the hour of 12:00 o'clock
noon on said day, and will be open continuously until the
hour of 8:00 o'clock p.m., at which time the polls will be
closed.
There shall be one voting precinct with boundaries
conterminous with those of the City. The polling place for
the qualified electors and the officials serving thereat shall

Registrar of said City. The place of registration is the

Except as provided by Section 50-412, Idaho Code,
it shall be necessary to register in order to vote at such
bond election. When once so registered for a general city
election, thereafter an elector shall not be required to
again register for the special bond election so long as he
shall have continued to reside at the same address, or with-
in the same precinct in which he is registered except as
hereinafter provided. If such elector shall have moved to
another precinct within the City, he shall notify said Clerk
of such change of address, and such Clerk shall thereupon
strike the name of such elector from the electors' list in
which he is registered and shall register him in such elec-
tors' register at the new address in the precinct to which
the elector shall have moved. If an elector shall have
failed or neglected to vote at any general biennial elec-
tion, the Clerk shall strike the name of such elector from
the electors' register, and such elector, in order to vote
at the special bond election, must again register. Persons
who are not currently registered may register on each day
at any time during the office hours of said Clerk until and
including the Saturday next preceding the election; and
on Thursday, Friday and Saturday next preceding the election
persons may register between the hours of 9:00 o'clock a.m.
and 5:00 o'clock p.m. and between the hours of 7:00 o'clock
p.m. and 9:00 o'clock p.m.
The voting at said election shall be by ballot.
The ballots to be supplied the voters for their use at said

election shall be in the form set out in said Ordinance No.
Said Ordinance No. was adopted for the pur-
pose of ordering the construction and acquisition of a
municipal sewerage system, and ordering the issuance of sewer
revenue bonds, subject to the assent of two-thirds (2/3) of
the qualified electors voting on said question.

Section 15. If at such election the necessary
percentage of the qualified electors of the City voting at
such election assent to the issuance of the sewer revenue
bonds, they shall be sold, executed and delivered in the
same manner provided by the "Municipal Bond Law" of the
State of Idaho.
Section 16. The officers of the City be, and they
hereby are, authorized and directed to take all action neces-
sary or appropriate to effectuate the provisions of this
ordinance.
Section 17. If any section, paragraph, clause or
provision of this ordinance shall for any reason be held
to be invalid or unenforceable, the invalidity or unenforce-
ability-of such section, paragraph, clause or provision shall
not affect any of the remaining provisions of this ordinance.
Section 18. This ordinance shall be in full force
and effect from and after its passage, approval and publica-
tion, as provided by law.
PASSED by the City Council of the City of Chubbuck,

Councilman Kinghorn moved that the City
Council resolve itself into a canvassing board to canvass
the returns of the special municipal sewer revenue bond
election held in said City on Tuesday, the 7th day of March,
1972. The motion was seconded by Councilman Menard
and was carried by the unanimous vote of all Councilmen present.
Said Council immediately resolved itself into a
canvassing board, and the Clerk having produced the returns,
the City Council proceeded to open and canvass the votes in
the manner required by law.
After completing the canvass of the votes cast, the
Council found the returns to be regular and in all respects
made in the manner and form required by law, and thereupon

bond election, which said abstract was in words and figures

NOTICE AND CALL OF SPECIAL MEETING
TO THE CITY COUNCIL OF
CITY OF CHUB~UCK, COUNTY OF BANNOCK
STATE O~ IDAHO:
NOTICE IS GIVEN that a special meeting of the
City Council (herein "Council") of the City of Chubbuck,
Idaho (herein "City"), will be held at 5160 Yellowstone
in the City at5:00 o'clock p.m., on Saturday,
the 12thday of February, 1972. The object of said meeting
is to consider the adoption of an ordinance calling an
election on the question of issuing the City's sewer reve-
nue bonds, and for the transaction of such other business
incidental to the foregoing as may come before said meeting.
ACKNOWLEDGMENT OF NOTICE
AND CONSENT TO SPECIAL MEETING
We, the undersigned Mayor and members of the
Council acknowledge receipt of the foregoing notice of a
special meeting, and waive any irregularities in such notice
and in the manner of service thereof upon us, and consent
