AN ORDINANCE CF THE CITY OF CHU~i3UC{<, IDAHO,
PROVIDING A CURFEW FOR MIN~,RS UNDER THE AGE CF S Iig['EEN
(16) YEARS IN [~U[~LIC STREETS AND OTHER PLACES.
BE iT ORDAINED BY THE ~.~tYOR AND COUNCIL OF THE
CITY CF CHUBSUC?~':
Section 1. That Section 2 of ordinance 82 of the
City of Chubbuck, Idaho, is hereby re[~ealed in its entirety
and the following submitted.
Section 2. That the loitering of minors is prohibited
and it is hereby declared that it shall be unlawful for any
minor under the age cf 16 years to loiter, idle, wander,
stroll, or play in or upon the public s~creets, highways,
roads, alleys, parks, playgrounds, or other public grounds,
public places and public buildings, places of amusement and
entertainment, vacant lots or other unsu[Tervised places, between
the hours of 10:30 p.m. and 5:00 a.m. of the follow~.ng
day, official city time. Provided, however, that these
provisions shall not be applicable tc any such minor who is in
the performance of any errand or duty directed by his or~ her
parent, guardian or other adult }?erson having control of
such minor or to one who is actually at the time engaged in
legitimate employment for profif.. Any minor found upon the
streets, alleys or public places afte~ the hour herein
designated shall exhibit to any polic~ officer demanding
the same such written permit unless properly attended as in this
section provided. Each violation of the provisions of this Section
shall constitute a separate offense.
Responsibility of Parents. It shall be unlawful
for the parent, guardian, or other adult person having the care
and custody of a minor under the age of 16 years to knowingly
permit such minor t() loiter, idle, wander, stroll, o~ play
in or upon the public streets, highways, roads, alleys, ~arks,
playgrounds, public places and public buildings, places of
amusement and entertainment, vacamt l(~ts or other unsupervised
places, between the hours cf 10:30 p.m. and 5:00 a.m. of
the following day, official c~-y tim~; .PKOVIDED, HCWEVE~.~,
that the provisions of this Section do not apply when the =~nor is accompanied
by his or her parent, guardi;~n, or other adult person having the care and
custody of the minor, or where the ~.nor is upon on emergency errand or legit-
imate business directed by his or her parent, guardian, or other adult person
having the care and custody of the minor. Each violation of the provisions
of this Section shall constitute a separate offense.
Enticing minors from parents or guardians prohibited. It shall be
unlawful for any person by the doing of any act or the exercise of any influence
or otherwise to entice or persuade any minor, male or female, under the age
of 16 years from his or her parent or parents, guardian or other person having
charge of custody of such minor without the conse~t of such I~rent or ~rents,
guardian or custodian.
Penalties. Any minor violating the provisions of this Section shall
be dealt with in accordance with Juvenile Court law and procedure. Any parent,
guardian, or other adult person having the core an~ custody of a minor violating
this Section shall be fined not ].ess than $25.00, nor more than $i00.00, or
confined in jail not more than 30 days or f-,~mished by both said fine and
imprisonment for each ol'fense.
}~epeal of conflicting ordinances. Ail existing ordinances of the
City of Chubbuck are hereby repealed insofar as they may be inconsistent
with the provisions of this ordinance.
Separability of provisions. It, is the intention of the City of
Chubbuck that each separate provision of this ordinance shall be deemed in-
dependent of all other provisions herein and it is futher the intention of
the City of Chubbuck that if any provisions of this ordinance be declared
invalid, ali other provisions thereof shall remain w~lid and enforceable.
