HomeMy WebLinkAbout0006 Beer License 1951ORDINANCE NO. 6 AN ORDINANCE PROVIDING FOR THE LICENSING OF THE SALE AND DISTRIBUTION OF BEER; PROVIDING AN APPLICATION FORM; PROVIDING THAT A LICENSE BE REQUIRED OF ANY RETAILER; PROVIDING AN ANNUAL LICENSE FEE; PROVIDING CONDITIONS FOR THE ISSUANCE OF A LICENSE; PROVIDING FOR THE REVOCATION OF A LICENSE; AND PROVIDING AN 'EMERGENCY CLAUSE; AND REPEALING ALL OTHER ORDINANCES OR PARTS OF ORDINANCES INSOFAR AS THEY ARE IN CONFLICT WITH THIS ORDINANCE. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, STATE OF IDAHO; SECTION 1. No retailer shall sell, lend, deal in or dispose of, by gift, sale or otherwise, or keep or offer for sale, beer as defined in this Ordinance, within the Village of Chubbuck, without .first hq.ving a license therefor as hereinafter provided. SECTION 2. All applications for license to sell beer as a retailer shall be made on forms to be supplied by the village setting forth the name of the person asking for such license, his age, representations as to his character as may be required, his citizenship, the location which such business is to be carried on, the business in connection with which the proposed licensee will operate, whether the applicant is owner and in operator of said business, time such applicant has been /that business at that place, and such other information as the governing body may require from time to time. SECTION 3. All applications for retailers beer license shall be accompanied by a receipt from the Village Clerk for the required annual fee for the license, and such fee shall be paid into the general fund of the Village; upon rejection of any application for retailers beer license, the Treasurer shall refund the amount. The annual fee for a retailers beer license to sell beer within the Village of Chubbuck, Idaho, shall be 425.00. SECTION 4. All licenses granted hereunder shall be granted subject to the following conditions, and all other conditions of this ordinance, and subject to all other ordinances of the Village applicable thereto. No license shall be granted to any person under twenty -one years of age. No license shall be granted to any person who has been convictec of a felony or of violating the National Prohibition Act or any law of this State or local ordinance relating to manufacturing or transportation of intoxicating liquors. No license shall be granted for the sale on any premises where the licensee has been convicted of the violation of this ordinance or where any license hereunder has been revoked for cause for at least one year after the said conviction or revocation. No sale of beer as defined in this ordinance shall be made to any person under guardianship, nor to an Tweivf y person under years of age. All premises where any license hereunder is granted shall be open to inspection by any police or health officer, or other properly designated officer or employee of the Village, at any time during which the place so granted is open to the public for business. All licenses granted under this ordinance shall be issued to the applicant only and shall be issued for the premises described in the application. Such license shall not be transferred to another place without the approval of the Board of Trustees. Retailer's beer licenses shall expire on the last day of May of each year. SECTION 5. Any license granted hereunder may be revoked by the Board of Trustees without notice to the grantee or a hearing may first be held by the Board and the revocation then made for cause. Any violation of any provision or condition of this ordinance or any falsification of any statement in the application shall be ground for revocation. No portion of the license fee paid into the Village Treasury shall be returned upon revocation. SECTION 6. That all Ordinances or parts of Ordinances insofar as they are in conflict herewith, be, and the same are hereby repealed. SEC^lION 7. That an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect upon its passage, approval and publication according to law. PASSED This �� day of May, 1951.
