COUNCIL STUDY SESSION MINUTES
APRIL 3, 2019 — 4:00PM

COUNCIL PRESENT: Ryan Lewis, Roger Hernandez, Melanie Evans, and Annette Baumeister.
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works
Director Rodney Burch, Police Chief Bill Guiberson, Fire Chief Merlin Miller, Planning and
Development Director Devin Hillam, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
GENERAL BUSINESS:
1- Discussion on Current Building Permit Valuations and Fees. (Proposal).
Planning and Development Director Devin Hillam gave an update on building
evaluations and fees, and gave some stats for 2019. Mr. Hillam stated that the building
department would like to update its construction evaluations from the 1997 statistics set
in City Code 15.04.90 to more current statistics. The building department will put a
proposal together for the Council to consider at a future meeting.
2- Discussion on Building Permits, Parks Impact Fee, and the NWSI Connection Fee.
Mayor England stated the he had talked to the members of the Chubbuck Impact Area
Wastewater Collection Authority Board (CIAWCA) about the NWSI connection fee, and
the board members are open to a recommendation from the Council. Mayor England
suggested that the Council make sure their recommendation is done properly.
Public Works Director Rodney Burch compared different connection fees and the
affect the connection fee would have on replacement costs, reserve costs, reduction in
debt, and full build out of the NWSI. The Council felt like the City needed to do a full
rate study before moving forward with a recommendation.
Mr. Burch went over how the parks impact fee was calculated. Mr. Burch stated that
the parks impact fee will not fund the parks master plan. The City will still need to look
for grants and other funding mechanisms to accomplish that vision.
Councilmember Baumeister wanted to offset the Police and Emergency Services
impact fees from the parks impact fee. Councilmember Evans stated that the quality of
the park is the most important (smaller foot print/better product). Councilmember
Hernandez felt like parks would either be funded on the frontend/impact fees or the
backend/taxes.
Mayor England read aloud an email from developer Dave Adams that was sent to
Public Works Director Rodney Burch and forwarded to the Mayor and Council.
The Council agreed that a parks impact fee was needed, and asked City Staff to set up
a meeting with Dave Adams and Lyn Yost to talk about their experiences with impact
fees in other cities.

PROCLAMATIONS:
1. Young Child Week
Mayor England read aloud a proclamation and then presented a copy to Captain Jean Higgins.
PUBLIC HEARING:
1. An application for Vacation of a Cul -de -Sac and corresponding 15 foot utility easement located at the
North end of Burley Drive being a part of Ratliff Subdivision Division No. 1 located in the South East
Quarter of Section 3, Township 6 South, Range 34 East, Boise Meridian, Bannock County, Idaho.
Mitch Greer Rocky Mountain Engineering represented the applicant. Mr. Greer stated
that Burley Dr. will end as a hammer head intersection. This application will have a
permanent easement attached for public use, a water line will be extended through the
property and fire hydrants will be installed. Mr. Greer also stated that the applicant is
asking for a utility and power easement to be vacated at the end of Burley Dr.
City Planner Paul Andrus stated that city staff recommends approval to be done with
the preliminary plat at the next council meeting. Mr. Andrus also stated that Idaho Power
had inspected the vacation request and had no concerns with this application.
Mayor England declared the public hearing open for public comment.
Leonard Jensen 609 Gary St. was concerned about Laurel Lane not connecting to Burley Dr.,
to allow better access for sanitation and emergency vehicles onto Laurel Ln. Mr. Jensen stated
that when he built his first building in 1994 on Laurel Ln. that it was his understanding that
Laurel Ln. would eventually connect into Burley Dr. for better public access.
Due to no more public comment Mayor England closed the public hearing.
Mr. Greer addressed Mr. Jensen's concern and stated that when this extension of Burley Dr.
was plated in the late 90s it was plated to end as a cult de sac and not to connect into Laurel Ln.
2. An application for a change in Land Use District from Limited Residential (R-2) to General Commercial
(C-2) on 1.46 acres of land. Location is in the NE 1/4 of Section 10, Township 6 South, Range 34 East of
the Boise Meridian, Idaho, generally located at 4526 and 4528 Burley Drive in Chubbuck, Idaho. The
Comprehensive Plan Future Land Use map designates this area as Employment. Following a public
hearing on March 14, 2019, the Land Use and Development Commission recommended approval of
the petition.
Stuart Ward of Dioptra represented the applicant. Mr. Ward presented a rezone change
from Limited Residential (R-2) to Commercial (C-2), and stated that this change
conformed to the surrounding properties.
Senior Planner Don Matson stated that this application meets the standards of the
comprehensive plan for a Commercial (C-2) zone.
Mayor England declared the public hearing open for public comment.
Brandon Jackson 1042 Lexington, was in favor. Mr. Jackson also represented the applicant
and stated that this location would be used for dry storage with minimal traffic. The applicant
will be doing a land scape buffer between this property and the neighbors.
Niki Taysom, General Delivery, was in favor of the zoning change. But was concerned about
the impact the gravel lot would have on the surrounding properties.
Hal Overby, Mccammon, was concerned about construction hours for his renters.
Due to no more public comment Mayor England closed the public hearing.
Mr. Jackson responded to Mr. Overby's concern, and stated that the applicant will limit
construction time to normal business hours.
3. An application for annexation in the City of Chubbuck which consists of approximately 45 acres
and with designation for Limited Commercial (C-1) zoning. The subject property is located within
the southeast 1/4 of section 34, Township 5 South, Range 34 East, of the Boise Meridian, Idaho.
Location: Subject property includes the following Bannock County tax parcels: R3803055503,
R3803055500, and R3803055504. The general location is north and west of the intersection of
Siphon Road and Whitaker Road, extending west to and including the Union Pacific Railroad
Right -of -Way, and north approximately 1,743 feet. Following a public hearing on March 14, 2019
the Land Use and Development Commission recommended the approval of Limited Commercial (C-
1) zoning on the applicant's property (Bannock County parcel R3803055503), and recommended
approval of the petition for annexation with the condition of obtaining written consent from the private
owner of the railroad parcel (Bannock County parcel R3803055504).
Lyn Yost represented the application. Mr. Yost presented 39.4 acres to be annexed
into the City of Chubbuck as Commercial (C-1) zoning. Currently in the County as
Industrial (I) zoning.
Senior Planner Don Matson stated that the Land Use Commission recommended
including the railroad with this application. Staff is working with the land owner and will
present the railroad annexation at a future meeting.
Mayor England declared the public hearing open for public comment.
Justin Jones 543 Taylor, was in favor. Mr. Jones stated that this development will be great for
the future of the City.
Niki Taysom, General Delivery, was in favor of the annexation.
Betty Jo Sorensen 428 Pocano, was concerned about the increase in noise and wondered if
there would be a sound barrier installed.
Due to no more public comment Mayor England closed the public hearing.
Mr. Yost responded to Ms. Sorensen's concern and stated that this application is for an
annexation, and the annexation itself will not create an increase in noise.
GENERAL BUSINESS:
1. Adoption of Ordinance XXX Ratliff Subdivision Div. 1 Vacation.
(Council will discuss the application and if it meets City code).
Councilmember Baumeister motioned to move general business item #1 to the same meeting as
the preliminary plat as recommended by city staff.
Councilmember Hernandez seconded motion.
Roll Call: Evans -yes, Baumeister -yes, Lewis -yes, Hernandez -yes, motion passed.
2. Adoption of Ordinance 786 Change of Land Use District.
(Council will discuss a change in land use from Residential (R-2) to Commercial (C-2)).
Councilmember Evans motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 786.
Councilmember Hernandez seconded motion for waiver.
Roll Call: Baumeister -yes, Lewis -yes, Hernandez -yes, Evans -yes, motion passed.
Councilmember Evans motioned for adoption of Ordinance 786 change in land use district.

3. Adoption of Ordinance 787 Annexation.
(Council will discuss the annexation of 45 acres with Commercial (C-1) zoning designation).

4. The Swearing in of Joey Bowers as City Clerk and Rich Morgan as City Treasurer.
Rich Morgan and Joey Bowers were sworn in by Mayor Kevin England.
5. Adoption of Ordinance XXX Parks Capital Plan and Impact Fee.
(Council will discuss changes to 17.16 and adding 17.24 to City code).
Councilmember Evans motioned to move general business item #5 to April 17, 2019.

6. An application for a preliminary plat for Northside Crossing Division 1. Applicant
proposes to subdivide 7.2 acres into 1 commercial lot. Property is located in the southeast
y of section 34, Township 5 South, Range 34 East, of the Boise Meridian, Idaho. The
general location is north and west of the intersection of Siphon Road and Whitaker Road,
extending west approximately 700 feet, and north approximately 452 feet. Current zoning
designation is Industrial (Bannock County), and is under application for annexation to the
City of Chubbuck in the Limited Commercial (C-1) zoning district. Application will be
evaluated against criteria established for preliminary plats in section 17.12. 100 of
municipal code. After discussing the item on March 14, 2019, the Land Use and
Development Commission recommended approval.
(Council will discuss the application and if it meets City code).
Lyn Yost represented the application. Mr. Yost presented a 7.2 acre development on
the corner of Siphon Rd. and Whitaker Rd.
Senior Planner Don Matson stated that this application will build a 40ft section of
road with the ability to widen Whitaker road to the east in the future. Mr. Matson stated
that this application meets City Code and recommended approval.
Councilmember Lewis motioned for approval of the Northside Crossing Div. 1 preliminary plat.
Councilmember Hernandez seconded motion for approval.

7. Adoption of Resolution 2019-02 to Accept TIF Eligibility Study West of I-15.
(Council will discuss acceptance of final eligibility study).
Public Works Director Rodney Burch presented a resolution for the Council to
accept the TIF eligibility study and direct the Chubbuck Development Authority to
prepare the urban renewal plans.
Councilmember Lewis motioned based upon the eligibility study for the Siphon/Northgate
interchange east urban renewal area, and based upon the recommendation and findings of this
study, to adopt resolution 2019-02 to accept the TIF eligibility study west of 1-15, and direct the
creation of an urban renewal area.
Councilmember Baumeister seconded motion for adoption.

technologies to reduce our carbon footprint already exists; and
WHEREAS, local communities can do much to contribute to building a health society by
addressing issues such as energy use, transportation, personal habits and
consumption; and
WHEREAS, there are sound economic, environmental, and social reasons for local governments
to initiate energy efficiency and renewable energy practices; and
WHEREAS, the environmental realities of our time require humans to make a dramatic shift in their

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, TO VACATE THE CUL
DE SAC AND ASSOCIATED UTILITY EASEMENT IN LOT 5 OF RATLIFF
SUBDIVISION DIVISION NO. 1; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. History. Lot 5 of Ratliff Subdivision, Division No. 1 includes a cul de sac
and associated utility right of way that the Owner has determined is no longer necessary and will
be replaced by a hammerhead in the proposed Intermountain Subdivision, a replat of Lots 3, 4
and a portion of Lot 5 of Ratliff Subdivision Division 1.
Section 2. Vacation. The cul de sac and associated utility easement that is in Lot 5
of Ratliff Subdivision Division No. 1, the legal description of which is more particularly
described on the attached Exhibit is hereby vacated.
Section 3. Recording. The Chubbuck City Clerk is hereby directed to cause the
ordinance to be recorded in the records of Bannock County.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall

AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, TO VACATE THE CUL
DE SAC AND ASSOCIATED UTILITY EASEMENT IN LOT 5 OF RATLIFF
SUBDIVISION DIVISION NO. 1; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. History. Lot 5 of Ratliff Subdivision, Division No. 1 includes a cul de sac
and associated utility right of way that the Owner has determined is no longer necessary and will
be replaced by a hammerhead in the proposed Intermountain Subdivision, a replat of Lots 3, 4
and a portion of Lot 5 of Ratliff Subdivision Division 1.
Section 2. Vacation. The cul de sac and associated utility easement that is in Lot 5
of Ratliff Subdivision Division No. 1 is hereby vacated.
Section 3. Recording. The Chubbuck City Clerk is hereby directed to cause the
ordinance to be recorded in the records of Bannock County.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.

Re: Partial relinquishment of the Public Utility Easement (PUE) located in Ratliff
Subdivision in Bannock County, Idaho.
Dear Paul:
This is in response to the relinquishment request submitted to Idaho Power Company dated
March 13, 2019, regarding the possible partial relinquishment of the above noted PUE. The
attached Display Map (Exhibit A) more specifically identifies the "easement area".
Idaho Power's review of the relinquishment request indicated that there are facilities within the
above noted easement area. However, based on the preliminary replat of Ratliff Subdivision
(Exhibit B) our facilities will be covered. Idaho Power agrees to relinquish the public utility
easements within described easement area in the attached documents on the condition the
purposed Replat of Ratliff Subdivision is fully executed.

Staff Report: The final plat
for Park Meadows 15th Addition is compliant with the preliminary
plat approved by the City Council on November 28, 2018. The final plat application has been
reviewed by staff and appears to meet the standards of Titles 16, 17, and 18 of City Code.
Specifically:
17.12.130: The final plat application was submitted within the twelve months validity period
17.22.220: The Public Works Director has reviewed the final plat and finds that is substantially
conforms to the approved preliminary plat;
• There is no increase in the number of lots nor any additional streets
• This is no significant change in the configuration of lots or street alignment
• There is no significant change in the size or location of open space
• No other changes have occurred which have affected the reviewed preliminary plat
Recommend condition of approval that construction plans/drawings be accepted by the City

Offer of Dedication
On November 1, 2017, the final plat of Antler Ridge Apartments was approved by the Chubbuck City
Council, and said plat is recorded as Instrument No. 21809272 in the official records of Bannock County,
Idaho. Said approval of the final plat does not, under the provisions of Title 17 of the Chubbuck City Code,
constitute an acceptance of the offer of dedication contained therein.
The Chubbuck City Council has found that all structures and improvements relating to the dedicated
lands, streets or utilities have been completed and approved and, directed the Mayor of the City of
Chubbuck to execute this Instrument accepting the offer of dedication contained in the final plat of
Antler Ridge Apartments, City Code 17.12.250. This acceptance does not relieve the owner and/or
contractor of their responsibility to guarantee the quality of the improvements for a three year period as
provided in Chubbuck Code 17.16.070.
The City of Chubbuck hereby accepts and confirms the dedication and offer of dedication, as contained in
the final plat of Antler Ridge Apartments, of all streets, utilities, dedicated lands, easements, pedestrian
ways, parks and recreation areas depicted therein.

LEWIS
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF CHUBBUCK,
IDAHO, DETERMINING A CERTAIN AREA WITHIN THE CITY TO BE A
DETERIORATED AREA OR A DETERIORATING AREA AS DEFINED BY
IDAHO CODE SECTIONS 50-2018(9) AND 50-2903(8); DIRECTING THE
URBAN RENEWAL AGENCY OF THE CITY OF CHUBBUCK, IDAHO,
ALSO KNOWN AS CHUBBUCK DEVELOPMENT AUTHORITY TO
COMMENCE THE PREPARATION OF AN URBAN RENEWAL PLAN
SUBJECT TO CERTAIN CONDITIONS, WHICH PLAN MAY INCLUDE
REVENUE ALLOCATION PROVISIONS FOR ALL OR PART OF THE
AREA; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council ("City Council") of the city of Chubbuck ("City") found
that deteriorating areas exist in the City; therefore, for the purposes of the Idaho Urban Renewal
Law of 1965, Chapter 20, Title 50, Idaho Code, as amended (the "Law"), by Resolution No. 4-
92, dated April 11, 1992, created an urban renewal agency pursuant to the Law, authorizing the
urban renewal agency to transact business and exercise the powers granted by the Law and the
Local Economic Development Act, Chapter 29, Title 50, Idaho Code, as amended (the "Act")
upon making the findings of necessity required for creating the Urban Renewal Agency of the
city of Chubbuck, also known as the Chubbuck Development Authority (the "Agency");
WHEREAS, the City Council, after notice duly published, conducted a public hearing on
the Urban Renewal Plan Chubbuck Downtown Improvement Project (the "1992 Plan") to
redevelop a portion of the City, pursuant to the Law and the Act;
WHEREAS, the City Council, in response to the public hearing on October 27, 1992, by
Resolution No. 11-92, amended City Council Resolution No. 4-92 and 7-92, to reduce the
geographic boundaries of the revenue allocation area, which resulted in removal of the northern
parcels from the proposed revenue allocation area;
WHEREAS, following said public hearing, the City Council adopted its Ordinance
No. 385 on October 27, 1992, approving the 1992 Plan, and making certain findings;
WHEREAS, the revenue allocation area boundaries were further administratively
adjusted at the request of the Bannock County Assessor's Office by City Council Resolution No.
1-93, dated January 19, 1993, to avoid splitting parcels;

WHEREAS, on or about November 23, 1998, the Agency, City, and the Bannock County
Board of County Commissioners (`BOCC") and the Bannock County Assessor ("Assessor")
(collectively, the BOCC and Assessor may be referred to as "Bannock County") entered into the
Intergovernmental Agreement With Respect to the Chubbuck Development Authority and its
Urban Renewal Plan (the "IGA"), to address concerns generally related to the geographic size
and value of the 1992 Plan revenue allocation area;
WHEREAS, the parties to the IGA agreed to an informal partial deannexation from the
1992 Plan revenue allocation area by specifically listing the parcel numbers of the properties to
remain within the revenue allocation area; all other parcels not listed were to be disregarded for
purposes of calculating tax increment (revenue allocation). The Assessor continues to track the
parcels included in the 1992 Plan revenue allocation area consistent with the terms of the IGA;
WHEREAS, the boundary map and legal description of record with the State Tax
Commission ("STC") were not updated to reflect the agreed upon changes in the IGA;
WHEREAS, the City Council, after notice duly published, conducted a public hearing on
the First Amendment to the Urban Renewal Plan Chubbuck Downtown Improvement Project
(the "First Amendment"), which sought to deannex parcels from the 1992 Plan revenue
allocation area commonly referred to as the "Old CarMike" parcels;
WHEREAS, following said public hearing, the City Council adopted its Ordinance No.
758 on August 3, 2016, approving the First Amendment and making certain findings;
WHEREAS, the City Council, after notice duly published, conducted a public hearing on
the Pine Ridge Mall Urban Renewal Area and Improvement Plan (the "Pine Ridge Mall Plan");
WHEREAS, following said public hearing, the City Council adopted its Ordinance No.
759 on August 3, 2016, approving the Pine Ridge Mall Plan and making certain findings;
WHEREAS, the Agency Board retained J Foster & Associates LLC and authorized
Renee Magee to commence an eligibility study and preparation of an eligibility report of an area
approximately 325 acres in size located generally east of Interstate 15 and adjacent to the
proposed Northgate Parkway roadway (the "Study Area") to analyze and determine whether the
Study Area is eligible for urban renewal planning, and provide the Agency Board with a report
and recommendation;
WHEREAS, the Agency obtained an eligibility report entitled Eligibility Study for
Siphon Interchange East Urban Renewal Area, dated October 2018 and Modified in February,
2019 to reflect annexation (the "Report"), which examined the Study Area for the purpose of
determining whether such area is a deteriorating area and/or a deteriorated area as defined by
Idaho Code Sections 50-2018(9) and 50-2903(8);
WHEREAS, the Report was submitted to the Agency, a copy of which is attached hereto
as Exhibit A;
WHEREAS, pursuant to Idaho Code Sections 50-2018(9) and 50-2903(8), which define

the qualifying conditions of a deteriorating area and a deteriorated area, several of the conditions
were found in the Study Area, i.e.,
a. outmoded street patterns/inadequate street layout;
b. obsolete platting and faulty lot layout in relation to size, adequacy, accessibility,
or usefulness; and
C. unsafe conditions;
WHEREAS, the Study Area is predominantly open;
WHEREAS, under the Act a deteriorated area includes any area which is predominantly
open and which, because of obsolete platting, diversity of ownership, deterioration of structures
or improvements, or otherwise, results in economic underdevelopment of the area or
substantially impairs or arrests the sound growth of a municipality;
WHEREAS, Idaho Code Sections 50-2018(9), 50-2903(8) and 50-2008(d) list the
additional conditions applicable to open areas, which are the same or similar to the conditions set
forth above;
WHEREAS, such additional conditions regarding open areas are present and are found in
the Study Area;
WHEREAS, the effects of the listed conditions cited in the Report result in economic
underdevelopment of the area, substantially impairs or arrests the sound growth of a
municipality, constitutes an economic or social liability, and is a menace to the public health,
safety, morals, or welfare in its present condition or use;
WHEREAS, the Agency, on February 19, 2019, adopted Resolution No. 2019-02 (a copy
of which is attached hereto as Exhibit B, without attachments thereto) accepting the Report and
authorizing the Chair or Vice -Chair of the Agency to transmit the Report to the City Council
requesting its consideration for designation of an urban renewal area and requesting the City
Council to direct the Agency to prepare an urban renewal plan for the Study Area, which plan
may include a revenue allocation provision as allowed by law, as well as guidance on the
boundary of the proposed project area, which may be geographically smaller than the area
reviewed in the Report;
WHEREAS, the Report includes a preliminary analysis concluding the base assessment
roll value for the Study Area, together with the adjusted base assessment roll values for the
existing revenue allocation areas, collectively do not exceed 10% of the current assessed
valuation of all taxable property within the City;
WHEREAS, under the Law, Sections 50-2903(8)(f) and 50-2018 (8) and (9), the
definition of a deteriorating area shall not apply to any agricultural operation as defined in
section 22-4502(1), Idaho Code, or any forest land as defined in section 63-1701(4), Idaho Code,
absent the consent of the owner of the agricultural operation or the forest landowner of the forest
land, except for an agricultural operation or forest land that has not been used for three (3)
consecutive years;

WHEREAS, the Study Area includes parcels subject to such consent. While the
necessary consents have not been obtained, any consents shall be obtained prior to submittal of
any urban renewal plan for the Study Area to the City Council;
WHEREAS, pursuant to Idaho Code Section 50-2008, an urban renewal project may not
be planned or initiated unless the local governing body has, by resolution, determined such area
to be a deteriorated area or a deteriorating area, or combination thereof, and designated such area
as appropriate for an urban renewal project;
WHEREAS, Idaho Code Section 50-2906 also requires that in order to adopt an urban
renewal plan containing a revenue allocation financing provision, the local governing body must
make a finding or determination that the area included in such plan is a deteriorated area or a
deteriorating area; and
WHEREAS, it is desirable and in the best public interest that the Agency prepare an
urban renewal plan for all, or a portion, of the geographic area identified in the Report located in
the city of Chubbuck, county of Bannock, state of Idaho.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF CHUBBUCK, AS FOLLOWS:
Section 1: That the Mayor and City Council finds and declares:
(a) That the Study Area described in the Report is a deteriorated area or a
deteriorating area, as defined by Chapters 20 and 29, Title 50, Idaho Code, as amended, within
the city of Chubbuck, Idaho;
(b) That there is a need for the Agency, an urban renewal agency, to
function in accordance with the provisions of said Chapters 20 and 29, Title 50, Idaho Code, as
amended, within a designated area for the purpose of establishing an urban renewal plan; and
(c) That the geographic area identified in the Report is determined to be a
deteriorated area or a deteriorating area, as defined in Chapters 20 and 29, Title 50, Idaho Code,
as amended, or a combination thereof, and such area is designated as appropriate for an urban
renewal project.
Section 2: That the Agency is hereby directed to commence preparation of an urban
renewal plan for consideration by the Agency Board and, if acceptable, final consideration by the
City Council in compliance with Chapters 20 and 29, Title 50, Idaho Code, as amended.
Section 3: That the Agency will obtain any agricultural operation consents from the
real property owners, as may be necessary, prior to formally submitting the proposed urban
renewal plan to the City Council for its consideration.
Section 4: That this Resolution shall be in full force and effect immediately upon its
adoption and approval.
