AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
ORDINANCE NO. 127 OF THE CITY OF CHUBBUCK~ IDAHO,
ENACTED ON THE 9TH DAY OF OCTOBER, 1973, BY ADDING
THERETO SECTION~3A, TO BE INSERTED FOLLOWING THE
EXISTING SECTION 3, PROVIDING EXEMPTIONS FROM COMPLIANCE
WITH THE FOREGOING REQUIREMENTS OF SAID ORDINANCE;
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Amendment. Ordinance No. 127 of the City
of Chubbuck, Idaho, enacted on the 9th day of October, 1973,
requiring construction bonds within the city, is hereby
amended by adding thereto Section 3A, to be inserted following
the existing Section 3 of said ordinance as follows:
SEC ION 3A. Exemption. The foregozng bond
requirement shall not apply to the owners
of improved properties {~ho personally
install curbs, gutters or sidewalks along
city streets or easements joining .or crossing
their properties. .P.r..0.vided, that zn order to
qualify for this exemption, said owners shall
prepay' any city inspection fees and execute
written agreements 'h~lding the city harmless
and indemnifyi'n'g the city from any claims or
losses arisihg from such work. The agreement
shall further obligate said owners to cause
the Work to be performed in accordance with
city standards, and shall.authorize the city
to remove, and require sazd owners forthwith
~oI replace at their expense~ any nonconforming
curbs~ gutt'ers or sidewalks." '
SECTION 2: EffeCtiVe' Date. This Ordinance shall
become effective upon ics passage, approval and publication
as provided by law.
PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR of the
City of Chubbuck, Idaho, this lO th day of June
1980.
