STAFF MEMBERS PRESENT: City Attorney Tom Holmes, Public Works Director Rodney Burch,
Planning and Development Director Devin Hillam, City Clerk Rich Morgan, and Deputy Clerk
Joey Bowers.
Council President Ryan Lewis excused Mayor Kevin England from the meeting.
GENERAL BUSINESS:
1- Discussion on Future Urban Renewal Area Qualifying Costs.
Public Works Director Rodney Burch gave a history of the Chubbuck Development
Authority (CDA). The CDA was created in 1992. In 2008 by Resolution 2008-5 the CDA
and City established reimbursement percentages for infill projects at 90% and non in -fill
projects at 80%. In 2010 those reimbursements were expanded to qualifying
improvements defined as beneficial to the public and ultimately maintained by the City
(water, sewer, streets, etc.), and defined non -qualifying cost as power, cable, gas, general
overhead, design costs, and permits. Also with the enhancement of the economic base of
the City, developers could receive 100% of annual increment generated; but must be
commercial or industrial use only (no reimbursements for residential). In 2013 the CDA
approved the Redman Lateral that relocated the Fort Hall Canal across property on the
north side of Knudsen Blvd (not a City infrastructure), to promote economic development
and optimal use of property. Mr. Burch also stated that in 2017 the CDA approved a TIF
district for Patriot Square reimbursement, and the Pine Ridge Mall URA Plan. The Pine
Ridge Mall plan negotiated for parking lots, site work, pad sites, lighting, and to include
soft costs (financing and engineering) to be eligible for 100% reimbursement less
$15,000 for an annual administration fee. Mr. Burch stated that City staff has had
discussions with land owners about potential TIF plans and reimbursements around the
Northgate Interchange. Mr. Burch also stated that City Staff recommends making these
TIF reimbursements apply only if the developer agrees to and builds under the Creative
Community Zone. All items required by this type of development would qualify (paths,
parks, public spaces, lighting, public art, street furniture, etc.). Local street and normal
infrastructure may not qualify, and the developer still bears the cost of traditional
infrastructure to avoid conflicts with normal residential developers. The developer would
determine if the additional upfront costs is worth creating a TIF district.
Councilmember Lewis felt like the City needed to use these districts as an incentive
and not always create a 20 year plan. Mr. Burch stated that these districts will end as soon
as the goals of the individual district had been accomplished.
City Attorney Tom Holmes recommended adopting a resolution to set standards.
