HomeMy WebLinkAbout009.18.18 City of Chubbuck Land Use and Development Commission Meeting Minutes September 18, 2018, 2018-7:00 pm Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on September 18, 2018. Chairperson Jason Mendenhall: Commission Members: Mike Schwartz, Rebecca Berls, Brady Smith, Brandon Jackson, Carrie Holm, and Ti Budge. Public Works Director: Rodney Burch, City Planner: Paul Andrus. City Attorney: Tom Holmes, Office Administrator: Ranelle Simmons Chairperson Mendenhall called the meeting to order at 7:00 pm. Mendenhall led the commission in the Pledge of Allegiance. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. Mendenhall lives within the 300' boundary. He has no interest financially or in any other way. Smith works for Rocky Mountain Engineering and Survey who prepared a legal description for the exhibit tonight. Will not recuse himself. APPROVAL OF THE MINUTES: Mendenhall entertained a motion to approve the minutes as emailed. Berls stated on Page 5 when talking about the Daybreak subdivision wanted noted that the permeable soils were not addressed. Mendenhall entertained a motion. Schwartz moved the minutes of September 11, 2018 meeting be approved as emailed; Holm seconded. The full authority approved. PUBLIC HEARING 1. A request for a Category A annexation into the City of Chubbuck which consists of approximately 680 acres with Agricultural (A) and Commercial General (C-2) zoning designations. The subject property is located within all quarters of section 35, Township 5 South, Range 34 East; and the N 1/2 and SE 1/4 of section 2, Township 6 South, Range 34 East, of the Boise Meridian, Idaho. Subject property includes the following Bannock County tax parcels: R3853002405, R3853001305, R3853001306, R3853001308, R3853001307, R3853000509, R3853000504, R3853000506, R3853000801, R3853000507, R3853000508, R3803057101, R3803055601, R3803056207, R3803056208, R3803056205, R3803056001, R3803056003, R3803056002, R3803056404, R3803056403, and R3803056601. The general location is east of the railroad tracks, west of Interstate 15, south of Tyhee Road, and north of Chubbuck Road. City is a co-applicant because of property owned by the city in the potential annexation and right-of-ways and easements associated with the Northgate Interchange.This is a Category A annexation which means it is voluntary at the sole discretion of the landowners. The city is not seeking any annexation of property that does not desire to be part of this process. It is largely driven by two components. The first is that these land owners when and if they develop want to do so to city standards and be part of the City of Chubbuck. Second is that these parcels want to participate in the tax increment or TIF District Eligibility Study. Without annexation of item #1, item #2 cannot happen. Andrew Stoddard has removed his property from this application. Applicants are seeking from the board a recommendation to City Council for approval. Mendenhall ask for city staff to comment with additional information. Paul Andrus City Planning stated this application does qualify in the Comprehensive Plan and the Land Use map along with City Impact. Mendenhall opened the public hearing. Lyn Yost 13982 North Rio Vista Road Pocatello, ID 83204. Partnership has been established with the other property owners. There is a significant need for development right now. They are asking for recommendation for approval. TJ Merzlock has been a realtor for 40 years. Small acreage lots are in demand. In favor of the development. Mendenhall closed the public hearing bringing the meeting back to the commission. This is a recommendation to City Council. No further discussion by commission. Mendenhall entertained a motion. Schwartz moved to recommend approval to City Council for the request for a Category A annexation into the City of Chubbuck which consists of approximately 680 acres with Agricultural (A) and Commercial General (C-2) zoning designations as described in item #1. A request for a Category A annexation into the City of Chubbuck which consists of approximately 832 acres with Agricultural (A) zoning designation. The subject property is located within the E 1/2 of section 35 and the W 1/2 and SE 1/4 of section 36,Township 5 South, Range 34 East; in the E 1/2 of section 2 and N 1/2 of section 1,Township 6 South, Range 34 East; in the NW 1/4 of section 6,Township 6 South, Range 35 East, of the Boise Meridian. Subject property includes the following Bannock County tax parcels: R3853000516, R3853000409, R3853000413, R3853000411, R3851001402, R3803057106, R3803055602, R3803057200, and R3853000514, and including all Interstate 15 right-of- way or other lands otherwise owned by the State of Idaho, or one of its agencies, which J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2018\009.18.18 special mtg..docx 2 would connect the subject property to the property described in previous public hearing item. The general location is approximately 1/2 mile north of Chubbuck Road and east from the western boundary of Interstate 15. Action Item: Recommendation to City Council Lavell Rupp 4869 Independence Avenue Chubbuck, ID 83202.The land has been in the family since 1923 when the grandparents came from New Zealand. For a time with cousins involved the family owned property on both sides of the interstate. In the past Mayor Steve England didn't think it was feasible at that time. Mayor Kevin England met Mr. Rupp approx. 3 to 4 months after he was elected. Mayor England suggested waiting. With Northgate Interchange coming Pocatello staff and Chubbuck staff had been given a tour of the family land by Mr. Rupp. Rodney called to ask Mr. Rupp to meet and in the meeting with Rodney, Mayor, Devin and Bridger Rodney asked if he would like to annex. into Chubbuck. Mr. Rupp's answer was where do I sign and how fast can we get it done. His mom's wishes was for the family property to be in Chubbuck. Family had no interest being in the City of Pocatello Impact Area. Mr. Rupp was told by Pocatello that they could not service the Rupp property with sewer unless the Rupp family spent 4-5 million dollars for a lift station over on Buffalo Creek Road, lift it over to Little Pocatello Creek Road, in turn put it in a temporary lift station and pump to Olympus Drive. Chubbuck suggested using gravity flow, having it flow under 1-15 at the cost of$400,000 to $500,000. Chubbuck has had an engineering firm look at the water situation and the plan would enhance the water system on the east side of the freeway. The irrigation well on their land is very pure with a possibility of another water source in the future. Mr. Rupp commented what they have to offer will only enhance the City of Chubbuck. No questions from commission. Mendenhall asked city staff to comment. Andrus stated with annexation in item #1 this will be possible and will be good for the city. City recommendation in the staff report will still need to be addressed. Mendenhall opened the public hearing. Lyn Yost 13982 North Rio Vista Road, Pocatello, ID 83202. Interest is for land owners to make their own decisions on what happens with their land. Supports the application. Mendenhall closed the public hearing bringing the meeting back to the commission. This is a recommendation to City Council with two recommendations by city staff. That the Future Land Use Designation Map must be adopted to include the subject property and Annexation Application for the property west of 1-15 be approved in order to create a border that will be contiguous to the City of Chubbuck. Smith appreciates the ability for individual property owner to work together on an agreement. Also appreciates the turn out tonight for this meeting. Holm seconded. Item #2 was approved. Ground breaking for Chubbuck Medical Campus on Friday September 21st from 4-7 pm on Knudsen Blvd. Mendenhall entertained a motion to adjourn;Jackson made the motion.
