COUNCIL MEETING MINUTES
FEBRUARY 21,2018—6:00Pm
CALL TO ORDER: Mayor England
PLEDGE ALLEGIANCE TO THE FLAG: Taysom Lewis Troop 330
COUNCIL PRESENT: Melanie Evans, Roger Hernandez, Annette Baumeister, and Ryan Lewis.
STAFF MEMBERS PRESENT:Mayor Kevin England, Public Works Director Rodney Burch, City
Attorney Tom Holmes, Fire Chief Merlin Miller, Police Chief Bill Guiberson, City Planner Paul
Andrus, City Clerk Rich Morgan, and Deputy Clerk Joey Bowers.
APPROVAL OF MINUTES: February 7, 2018
Councilmember Evans motioned for approval of the Study Session and Council meeting.
Minutes,with the approved correction to the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes with correction.
Roll Call: Hernandez-yes, Evans-yes, Lewis-yes, Baumeister-yes,motion passed.
GENERAL BUSINESS:
1. Approval of Whitewater No. 1 Final (Short) Plat.
Tom Taylor from Keller&Associates presented a car wash to be constructed off of
Yellowstone Ave. Mr. Taylor stated that the applicant will be cleaning up the property
boundaries by bring them back to the City right of way. The applicant will be dedicating
land to the public on Central Way, and at the corner of Burnside Ave. and Central Way.
Jaden Jackson from Keller Associates stated that this will be a drive through car wash
with a conveyer belt to pull the cars through. Mr. Jackson stated that the applicant will be
demolishing all the existing structures and will be building/constructing new structures.
Councilmember Baumeister wanted to know if it was going to be a drive through car
wash. Councilmember Lewis wanted to know if the applicant was going to keep any of
the current structures. Councilmember Lewis also wanted to know if the rest of Central
Way was dedicated to the City, and if the application complies with sections 16, 17, and
18 of City Code.
City Planner Paul Andrus stated that staff recommends approval on the condition that
construction plans be approved by staff. Mr. Andrus stated that the rest of Central Way
had previously been dedicated to the city, and that this application meets all City Codes.
Councilmember Lewis motioned for approval of Whitewater No.l Final (Short) Plat, conditioned
upon final approval of construction plans by City Staff.
Councilmember Baumeister seconded motion for approval with condition.

2. Acceptance of Offer of Dedication for Bilyeu Estates Div. 2.
Public Works Director Rodney Burch stated that all requirements had been meet and
infrastructure inspected by staff, and recommended approval. Mr. Burch also on the
request from Councilmember Lewis gave an explanation to the audience of what the
Council was approving and why.
Councilmember Baumeister motioned for acceptance of offer of dedication for Bilyeu Estates Div.2.
Councilmember Lewis seconded motion for approval

3. Waiver and Readopting of Ordinances 769, 770, and 771.
Mayor Kevin England explained that these Ordinances were passed without waving
the rule of three readings with the first reading in full, and asked the Council to waive the
three readings and re-adopt these three Ordinances.
Councilmember Lewis asked for a reminder of what these ordinances was about.
Deputy Clerk Joey Bowers stated that Ordinance 769 established the FY2018 budget, 770
amended the snow removal policy, and 771 was a change in land use districts for
Jensen's Cove, Lucky Lane, and Antler Ridge.
Councilmember Lewis motioned for the waiver of three readings, including the reading of one
time in full for Ordinances 769, 770, and 771.
Councilmember Evans seconded motion for waiver.
Roll call: Evans-yes, Hernandez-yes, Lewis-yes, Baumeister-yes,motion passed.
Councilmember Lewis motioned for adoption of Ordinances 769, 770, and 771.
Councilmember Hernandez seconded motion for approval.

4. Update on Northgate Interchange and Siphon Utility Crossing.
Public Works Director Rodney Burch gave an update on the Idaho Transportation
Departments decision to fund the remaining$4.6 million for the Northgate interchange.
Mr. Burch also presented ITD construction plans for those in the audience.
CLAIMS:
1. City of Chubbuck claims for February 21, 2018 as presented to Mayor England and
Council.
Councilmember Evans wanted to know what the expenditures was for on the City
wells. My Burch stated that these are maintenance expenditures that come out of the
normal water funds.
Councilmember Lewis wanted to know about the title expenditures. Mr. Bowers
stated that this expenditure is to replace missing titles for City vehicles.
Councilmember Lewis also wanted to know about the water rights review
expenditure. Mr. Burch stated that it was to review property owner's water rights for
potential city acquisition.
Councilmember Baumeister motioned to approve City of Chubbuck claims.
Councilmember Evans seconded motion for approval.

2. Chubbuck Development Authority claims for February 21, 2018 as presented to
Mayor England and Council.
Councilmember Lewis wanted to know if the CDA board had approved these
expenditures. Mr. Burch stated that these expenditures had been previously approved
by the board.
Councilmember Baumeister motioned for approval of Chubbuck Development Claims.
Councilmember Evans seconded motion for approval.
Roll Call: Lewis-yes, Evans-yes, Baumeister-yes, Hernandez-yes,motion passed.
3. Chubbuck Impact Area Wastewater Collection Authority(NWSI) claims for
February 21, 2018 as presented to Mayor England and Council.
Councilmember Lewis wanted to know if the Chubbuck Impact Area Wastewater
Collection Authority Board had approved this expense. Mayor England stated that
the board had not seen this expense, due to a meeting cancelation. But stated that this
was an annual expenditure that the board had always approved, and the board had
already approved the audit to be performed.
Councilmember Baumeister motioned for approval of the Chubbuck Impact Area Wastewater
Collection Authority(NWSI) Claims.
Councilmember Evans seconded motion for approval.
