HomeMy WebLinkAbout001.09.18City of Chubbuck Land Use and Development Commission Meeting Minutes January 9, 2018 - 7:00 pm Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on January 9, 2018. Chairman Jason Mendenhall: Commission Members: Mike Schwartz, Dan Stoddard, Jay Buttars, Brady Smith, Thais Ayre, Brandon Jackson, Carrie Holm, and Bryan Nield. Planning and Development Director: Devin Hillam, Public Works Director: Rodney Burch, City Planner: Paul Andrus. Attorney: Tom Holmes, Office Administrator: Ranelle Simmons Chairman Mendenhall called the meeting to order at 7:00 pm. Mendenhall led the commission in the Pledge of Allegiance. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. Smith recused himself from item #1. APPROVAL OF THE MINUTES: December 12, 2017 Mendenhall entertained a motion to approve the minutes as emailed. Schwartz moved the minutes of December 12, 2017 meeting be approved as emailed; Holm seconded. The full authority approved. GENERAL BUSINESS 1. An application by Rocky Mountain Investing, LLC for PUD Final Development Plan for proposed Selder Meadows Apartments for Multifamily Infill Planned Unit Development, PUD. Located Northeast % of the Southeast % Section 4, Township 6 South, Range 34 East of the Boise Meridian, City of Chubbuck, Bannock County, Idaho. Location is on Hawthorne Road North of Chastain Drive, South of Canal Street. Mitchell Greer from Rocky Mountain Engineering and Survey, 600 East Oak Pocatello, ID 83204 was in attendance representing the applicant. Changes from original PUD were consolidating the park to one side of the street with storm water on the other side of the street. Amenities are on the south side of the park and 4 handicap accessible units were added. Nield asked City staff if the application meets City requirements. Andrus answered that City Council had requested for final plat and plan: • Striping and marking • No parking in the center area • No parking on the West end • If the West property develops a gate will be installed for emergency access J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2018\001.09.18.docx • 6'white vinyl fence around the project • Common areas and landscape be maintained Mendenhall entertained a motion for recommendation to City Council. Roll Call Vote: Jay Buttars, Yes; Brandon Jackson, Yes; Thais Ayre, Yes; Carrie Holm, Yes; Bryan Nield, Yes; Mike Schwartz, Yes; Dan Stoddard, Yes; Jason Mendenhall, Yes. The motion is approved. Application will be on City Council's agenda the first meeting in February. 2. Review and possible adoption of By-laws. Mendenhall stated all the changes that were requested by this board have been made. Mendenhall entertained a motion for approval or denial. Smith moved to approve the By-laws as presented. Jackson seconded. All voted in favor. 3. Discuss proposed changes to City Subdivision Process. Hillam wants the process to be more efficient. The documents in the meeting packet breaks down the changes Hillam is recommending. Preliminary Plat Public Hearings are not required by State Code. If the criteria is met the application is approved. Subdivision reviews are in the Planning Department now instead of Engineering. Final Plat phase will be reviewed by City staff for substantial conformity. If the application is deemed to be substantially conformed a memo to City Council for their approval will be on their meeting agenda. Comments and questions from commission. Mendenhall, 17.12.080 Section B #1, asked for clarification on additional fees. Hillam explained the additional fee will be a review fee. 17.12.080 Section E was discussed. After discussion it was decided that Holmes will review, State Code does not give much guidance. Section 17.12.120 Section A. Mendenhall suggested changing "must" to "may". Hillam explained City staff would like to see the Preliminary Plat show sewer and water locations. Jackson asked about a check list. Hillam explained there is one in place now and he will email a copy to the board. These applications will be on line in the near future. Burch stated this puts a heavier burden on City staff and the Land Use Commission. Hillam explained there is a time crunch on this because developer are coming into their busy season. He will get a copy of the changes emailed to the commissioners. The goal is that this will be moved to a Public Hearing at the March meeting. Holms agrees with the changes to the Preliminary Plat process. Mendenhall asked how a developer appeals a decision on a subdivision. Hillam explained that an appeal for a subdivision application denial is Request for Reconsideration to a decision making board. Mendenhall entertained a motion to adjourn; Jackson made the motion.
