Council Meeting Minutes
September 3, 2014
6:00 p.m.
Minutes of a regular Council Meeting held at the City of Chubbuck Council Chambers,
September 3, 2014. The meeting was called to order at 6:OOpm by Mayor Kevin England.
Rich Morgan called the roll. Mayor Kevin England -present, Councilmembers: Josh Ellis -
present, Ryan Lewis -present, Brent Marshall -present, Kermit Morrison -present.
The Pledge of Allegiance to the Flag was led by Councilmember Lewis.
The Invocation was given by Norman Reece.
Approval of Minutes. Councilmember Lewis moved to approve the regular meeting minutes of
August 20, 2014 with the correction of the second for approval of the minutes of August 20,
2014 being councilmember Ellis. Councilmember Morrison seconded. Roll call vote: Ellis -yes,
Lewis -yes, Marshall -yes, Morrison -yes.
Mayor England read a proclamation and declared the Month of September Recovery Month in
the City of Chubbuck. Kevin Wakeman, 562 Euclid, accepted the proclamation.
A public hearing was held on the application by Bobcat Properties LLC, for a PUD located at
207 Briscoe Road. Nate Evans explained the PUD request. Bobcat Properties is seeking
approval for 12 units in 3 buildings. All requirements are met but the 100 feet of private outdoor
space. They will be providing a common area with a concrete pad and several picnic tables.
Mayor England opened the public hearing. Niki Taysom, 4640 Burley Drive would like to see
each space provided a spot for gardening. Mayor England declared the public hearing closed.
The council considered the application by Bobcat Properties for the PUD located at 207 Briscoe
Road. Councilmember Ellis asked what the parking requirement was. Steve Smart stated that
they would be required to have a least two parking stalls per unit. The plans exceed the
requirement. Councilmember Lewis verified that all requirements but the 100 square feet of
personal space has been met and that City Staff would recommend approval. Steve Smart
answered in the affirmative. Councilmember Ellis moved to approve the application by Bobcat
Properties for a PUD located at 207 Briscoe Road with the waiver of the requirement of 100
square feet of personal outside space. Councilmember Lewis seconded. Roll Call Vote: Ellis -
yes, Marshall -yes, Morrison -yes, Lewis -yes.
A public hearing was held on the application by Bobcat properties for approval of a Bobcat PUD
Preliminary Plat. The plat, or lot, was explained to the council. Mayor England opened the
public hearing. There being no comment, Mayor England closed the public hearing.
There being no further comment from staff or the Council, Councilmember Ellis moved to
approve the preliminary plat. Councilmember Marshall seconded. Roll Call Vote: Ellis -yes,
Marshall -yes, Morrison -yes, Lewis -yes.

The council considered the final plat for Bobcat PUD. Staff explained there were no differences
between the preliminary plat and the final plat. There being no further comment from staff or the
Council, Councilmember Marshall moved to approve the final plat. Councilmember Lewis
seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes.
A public hearing was held on the application by The Academy Charter School for annexation
into the city with a zoning of Agricultural and a request to modify the comprehensive plan urban
service boundary in include the said annexed land. Hal Jensen explained the project. Mayor
England opened the public hearing. Gerald McNabb 12973 North Philbin spoke in favor of the
project and explained how Alpine Road will run through the project connecting Hawthorne Road
to Philbin Road. John Vanhorn 8612 West Barton Road spoke in favor of the project. His
children have attended The Academy. The harbor method of teaching The Academy uses has
been a great tool in his children's education. He believes The Academy will be a great addition
to the Chubbuck community. Georgia Hagler 629 Brent spoke in favor of the project and would
encourage the council to approve the application. Niki Taysom opposes the project. It's close
proximity to the Simplot plant will cause in the children, a high incidence of cancer because of
the pollutants from the plant. There being no further comment Mayor England closed the public
hearing.
Councilmember Ellis moved to approve the application for annexation with a zoning to
agricultural and the request to modify the comprehensive plan urban service boundary to include
the said annexed land. Councilmember Lewis seconded. Roll Call Vote: Ellis -yes, Marshall -
yes, Morrison -yes, Lewis -yes.
A public hearing was held on the application by The Academy for The Academy Preliminary
Plat. An explanation of the plat was given to the council. The Mayor opened the public hearing.
Niki Taysom opposes the plat. She would like to see the water, sewer and taxes kept private.
There being no other comment, Mayor England closed the public hearing.
Councilmember Ellis asked for an explanation of access to the property and how the final access
will change from the construction access. The final access will be on the north side of the plat.
The construction access will be where Philbin crosses the canal. Councilmember Lewis moved
to approve the preliminary plat for The Academy. Councilmember Morrison seconded. Roll
Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes.
A public hearing was held on Resolution 2014-01 which is the proposed increase in wastewater
fees beginning October 1, 2014. City Clerk Rich Morgan explained the increase in fees for
treatment of the wastewater. This increase in fees will be going directly to the City of Pocatello
for the treatment of our waste water. Mayor England declared the public hearing open. Aaron
Merzlock, 1019 Lexington spoke in opposition of the fee increase. He asked the Council to
please find a way to keep costs down.

Niki Taysom, 4604 Burley Drive spoke in opposition to the fee increase. She is worried about
checks and balances at the City of Pocatello. She believes this cost should be Simplot's. She
thinks this fee increase is unconstitutional. She would like to point out the people with boots like
hers cannot afford the fee increase. With no further comment Mayor England closed the public
hearing.
Councilmember Marshall asked what would happen if the fee was not increased. It was
explained to councilmember Marshall that without the increase the City of Chubbuck would
default on the sewage treatment agreements with the City of Pocatello and likely end up in court.
Councilmember Ellis asked for staff to look for ways to decrease the North West Sewer
Interceptor Fee. Councilmember Ellis moved to approve Resolution 2014-01. Councilmember
Morrison seconded. Roll Call Vote: Ellis -yes, Marshall -no, Morrison -yes, Lewis -yes.
The Acceptance of Offer of Dedication for G&J Ratliff subdivision was presented to the council.
Councilmember Lewis verified with staff that all items concerning the subdivision are acceptable
and in conformity with applicable code. Staff confirmed. Councilmember Lewis moved to
accept the Offer of Dedication. Councilmember Marshall seconded. Roll Call Vote: Ellis -yes,
Marshall -yes, Morrison -yes, Lewis -yes.
Public Works Director Steve Smart explained the opportunity the City has to contract with
Bannock County to overlay West Chubbuck Rd. between the intersection at Philbin and
Brookstone subdivision. Councilmember Ellis moved to enter into an agreement to have
Bannock County overlay West Chubbuck Rd. between the intersection at Philbin and Brookstone
subdivision. Councilmember Marshall seconded. Roll Call Vote: Ellis -yes, Marshall -yes,
Morrison -yes, Lewis -yes.
Computer print-out claims for September 3, 2014 were presented to the Mayor and Council for
approval and payment. Councilmember Morrison moved to approve the claims for September 3,
2014 as published. Councilmember Lewis seconded. Roll Call Vote: Ellis -yes, Marshall -yes,
Morrison -yes, Lewis -yes.
At 7:06pm Mayor England adjourned the meeting.
