HomeMy WebLinkAbout07 16 2014 CMCITY OF CHUBBUCK 83 Council Meeting Minutes July 16, 2014 6:00 p.m. Minutes of a regular Council Meeting held at the City of Chubbuck Council Chambers, July 16, 2014. The meeting was called to order at 6:OOpm by Mayor Kevin England. Rich Morgan called the roll. Mayor Kevin England -present, Council members: Josh Ellis - present, Ryan Lewis -present, Brent Marshall -present, Kermit Morrison -present. The Pledge of Allegiance to the Flag was led by Mayor England. Approval of Minutes. Council member Morrison moved to approve the regular meeting minutes of July 2, 2014 and the study session minutes of July 9, 2014. Council member Marshall seconded. Roll call vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes. A public hearing was held on the application by Doug Briscoe for Briscoe Subdivision 8th Addition Preliminary Plat. Mayor England declared the public hearing open. Niki Taysom, 4604 Burley Drive opposes the subdivision. Ms. Taysom would like to see larger lots that allow citizens to have animals, large gardens and orchards. Ms. Taysom would like the city to allow septic systems and wells for each lot. Jack Hilby, 5414 Canterbury has several concerns about the subdivision. Mr. Hilby is concerned about the difference in the grade between the existing subdivision on the north and the proposed subdivision. Mr. Hilby is concerned about two shops that have been built with homes in Briscoe Subdivision #7. Mr. Hilby believes businesses are being run out of these buildings. Verlyn Ashton, 5369 Whitaker, Mr. Ashton asked for clarification on the number of lots. Mr. Ashton could not tell on the plat where the park was. It was explained that the park is on the plat as one of the lots. Mayor England declared the public hearing closed. Council member Ellis is concerned about the current zoning being R1. The builder has stated that the intention is to build R1 structures, however, with the current zoning it would be possible to build R2 structures. Council member Ellis would like a review of city ordinances and a discussion on ordinance requirements concerning accessory structures and lighting. Council member Marshall asked if the builder was doing anything to alleviate drainage problems or traffic hazards along Hiline Road. The developer is changing the grade of the lots that back Hiline Road in an effort to address these issues. Council member Marshall ask the developer is there was any intention to build twin homes along Hiline Road and the developer answered at this time there is no intention to build twin homes. Council member Marshall would like more time and more information on the project before making a decision. Council Meeting Minutes Continued 85 July 16, 2014 Council member Lewis asked about City lighting requirements and restrictions. There currently are no lighting requirements or restrictions in the City of Chubbuck. Council member Lewis commented that the application meets all applicable code requirements. However, with the questions and concerns raised Council member Lewis stated that it might be current city ordinances are not managing the process properly. Council member Marshall moved to postpone the approval of the application. There being no second the motion dies. Council member Lewis moved to approve the application by Doug Briscoe. Council member Ellis seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes. A public hearing was held for consideration of the City of Chubbuck's Fiscal Year 2015 proposed budget. Mayor England declared the public hearing open. Niki Taysom, 4604 Burley, explained to the council that she believes the budgeting process is unconstitutional and violates a citizens' rights. Rodney Burch, 5402 Stuart, asked for an explanation of the L2 and if the new construction amount on the L2 was set or an estimate. Boyd Byrd, 5036 Kevin, said that overall he thought the budget was a good one. His concerns continue to be around the insurance issues the city faces. Rich Rommell, 5764 Eden, would like the city to pay insurance for employees only. If the employee would like their family covered then the employee should pay for that. He expressed some concerns over the consultant hired to represent the City in Washington DC and his concern about the CDA's expenditures for the tennis courts in Capell park. Mayor England declared the public hearing closed. The council expressed their desire to have the road seal coat line item increased to $250,000. The expenditure for the consultant to represent the City in Washington DC added to the general fund, and the estimated payment for a 5 year loan to upgrade the fire departments breathing apparatus added back into the fire departments budget. The council would like city managers to look at taking the review process and raises for employees in the direction of a pay for performance model and finally, the council expressed their desire to have this done without raising the levy rate in Chubbuck. Rich said he believes this is possible and will be ready to present a budget with these requests at the next meeting. Council Meeting Minutes Continued July 16, 2014 87 Computer print-out claims for July 16, 2014 were presented to the Mayor and Council for approval and payment. Council member Morrison moved to approve the claims for July 16, 2014 as published. Council member Marshall seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes.
