HomeMy WebLinkAbout05 21 2014 CMCITY OF CHUBBUCK 63 Council Meeting Minutes May 21, 2014 6:00 p.m. Minutes of a regular Council Meeting held a the city of Council Chambers, May 21, 2014. The meeting was called to order at 6:OOpm by Mayor Kevin England. Wendy Butler called the roll. Mayor Kevin England -present, Council Members: Josh Ellis - present, Ryan Lewis -present, Brent Marshall -present, Kermit Morrison -present. The Pledge of Allegiance to the Flag and Invocation was led by Bishop Kim Guyman of the Chubbuck 2nd Ward of the Church of Jesus Christ of Latter -Day Saints. Approval of Minutes. Council Member Morrison moved to approve both the regular meeting minutes of May 7, 2014 and the Work Study Session minutes of May 14, 2014. Council Member Ellis seconded. Roll call vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes. Sheila Cellan appealed the denial of her license to work at a counseling center. Captain Ken Quinn stated that Chief Severe was unable to attend the council meeting, but had emailed the council members a copy of the explanation, city ordinance and determination for the denial of Sheila Cellen's license due to her background check uncovering the charges of grand theft in 2010. Sheila Cellan, 5033 Hawthorne Rd. #21, Pocatello, ID then addressed the council. Sheila stating that she had received her letter from Chief Severe and was being denied application for licensing as a behavioral mental health worker. Sheila stated that she was employed by Tueller Counseling as an office manager, not a behavioral mental health worker. Sheila stated that she had paperwork from the courts showing that the felony grand theft charge was dismissed. Councilman Marshall asked Sheila for more detail in regards to the charges. Sheila stated she had been accused of embezzling from her previous employer. Mayor England asked if Sheila's current employer would like to make a statement. Michelle Tueller, 883 E. 1300 N., Shelly, ID 83274 stated that she had called Chief Severe and discussed Sheila's background check and license denial. Chief Severe told Michelle that he would be willing to testify to the council that for the past 4 lh years Sheila's record has been clean. Mayor England assured Michelle that Chief Severe had done that in his email. Councilman Lewis stated that one of the reasons the ordinance has been written the way it has is that employees of the center, counselors or not, could find themselves alone with clients. He then asked if that would be the case in Sheila's capacity as the office manager. Michelle Tueller explained that Sheila would not necessarily be alone with children, but didn't feel like the charges were anything pertaining to being dangerous to a client. Councilman Lewis asked Michelle if there was anything in her understanding of Sheila or Sheila's background that would pose any sort of threat. Michelle stated "not at all". Councilman Lewis asked Sheila if anything in her history would pose a threat to children that wasn't otherwise disclosed in her application. Sheila stated "no sir". Councilman Lewis then asked Captain Ken Quinn if there was anything that would identify a concern with her working around children. Captain Quinn stated that there Council Meeting Minutes Continued 65 May 21, 2014 was nothing that would indicate a problem with Sheila working with children. There were some questions and discussion in regards to the city ordinance. Council Member Lewis moved to grant Sheila Cellan's appeal and allow her license. Council Member Ellis seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis - yes. Discussion of possibly bringing a Special Assistant United States Attorney to the area. Mayor England explained he first heard of this program at the AIC meetings last year in Boise. The Boise area has implemented their SAUSA project and it is working well. This program is for cities and counties to hire a special assistant to work directly with local police and law enforcement from this area to prosecute crimes on a federal level. There is a cost share plan that would be approximately 75% paid by the State and 25% paid by the cities and counties that choose to participate. Mayor England stated that Chief Severe thought this was worth considering. Discussion of canceling the regularly scheduled meeting on June 181h, 2014. Council Member Ellis moved to cancel the regularly scheduled meeting due to AIC Conference in Boise. Council Member Morrison seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes. Computer print out claims for May 21, 2014 were presented to the Mayor and Council. Council Member Morrison moved to approve the claims as published. Council Member Ellis seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes. Executive Session Council Member Ellis moved to go into Executive Session pursuant to Idaho code Section 67- 2345(1)(f) to discuss potential litigation. Council Member Marshall seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes. Council Member Ellis moved to go out of Executive Session. Council Member Morrison seconded. Roll Call Vote: Ellis -yes, Marshall -yes, Morrison -yes, Lewis -yes. At 7:43pm Council Member Morrison moved to adjourn. Councilmember Ellis seconded and the full council approved.
