COUNCIL MEETING MINUTES
January 28, 2014
7:00 p.m.
Minutes of a regular Council Meeting held at the City Council Chambers, January 28, 2014.
Present: Mayor Kevin England, Council Members: Josh Ellis, Ryan Lewis, Brent Marshall,
Kermit Morrison, Attorney Thomas Holmes, Deputy City Clerk Danielle Swan.
The meeting was called to order at 7:00pm by Mayor Kevin England.
The Pledge of Allegiance to the Flag was led by Mayor Kevin England.
The Invocation was offered by Bishop Briscoe from the North Pocatello Idaho Stake of the
Church of Jesus Christ of Latter Day Saints.
Approval of Minutes. Council Member Morrison moved to approve the regular meeting
minutes of January 14, 2014. Council Member Ellis seconded. Roll call vote: Ellis -yes, Lewis -
yes, Marshall -yes, Morrison -yes.
Discussion on Dell Road Reconstruction.
Steve explained the Dell Rd. reconstruction project and the requirement by city code, that those
residents along the road will be required to connect to the city waste water collection system.
Steve explained the options to the council regarding the required time frame and connection fee
and the payment of connection fee. Council Member Lewis asked for clarification on the input
given from the home owners on Dell Rd and some of the requirements in the code. There was
discussion among the council on the total cost estimate for the residents, how the fees will be
imposed and collected, the required time frames available and the different combinations of
options the council could consider.
Council Member Morrison moved to table the item until the next council meeting. Council
Member Ellis seconded. Roll call vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes.
Ordinance # 729 to eliminate the bond and liability insurance requirement for construction
trade contractors. Steve Smart explained the bond and liability insurance requirement in our
ordinance. Contractors would still be required State and City licensing.
Council Member Ellis moved to waive the rule requiring the ordinance be read on three separate
occasions, one reading being in full. Council Member Morrison seconded. Roll call vote: Ellis -
yes, Lewis -yes, Marshall -yes, Morrison -yes.
The ordinance was read by title.
Council Member Ellis moved to adopt ordinance #729. Council Member Marshall seconded.
Roll call vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes.

January 28, 2014
Ordinance # 730 to conform the City of Chubbuck's pretreatment ordinance with the City
of Pocatello's pretreatment ordinance. Steve Smart explained the contractual obligation for
our pretreatment ordinance be in conformity with the City of Pocatello's pretreatment ordinance.
Council Member Morrison moved to waive the rule requiring the ordinance be read on three
separate occasions, one reading being in full. Council Member Lewis seconded. Roll call vote:
Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes.
The ordinance was read by title.
Council Member Lewis moved to adopt ordinance #729. Council Member Ellis seconded. Roll
call vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes.
Computer print out claims for January 28, 2014 were presented to the Mayor and Council.
Council Member Morrison moved to approve the claims as published. Council Member Lewis
seconded. Roll Call Vote: Ellis -yes, Lewis -yes, Marshall -yes, Morrison -yes.
At 7:52pm Council Member Ellis moved to adjourn. Council Member Lewis seconded and the
full Council approved.
