Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Thomas S. Nield, Steven M. England, Engineer Steven M. Smart, Attorney B. Lynn Winmill and City Clerk Ron C. Conlin. Meeting called to order at 4:30 p.m. by Mayor Cotant. PURPOSE OF MEETING is to consider the following: 1) Group W Cable Agreement. 2) School District #25 - Whitaker Road. 3) Discussion of allocation of fines on withheld judgements. ORDINANCE #262- An ordinance of the City of Chubbuck, Idaho, repealing former cable TV ordinance nubers 76,84, and 158 and reenacting a new cable TV ordinance granting a nonexclusive franchise for the operation of a communication system to Group W Cable, Inc. Mayor Cotant read Ordinance #262 by title. After discussion Councilman Quick moved to suspend the -rule of reading Ordinance #262 on three separate occasions and the rule requiring that one of the readings must be of the full text. Councilman England seconded. Roll Call Vote: Quick, yes; Hopkins, yes; Nield, yes; England, yes. Councilman Quick moved to adopt Ordinance #262 as read. Councilman Nield seconded. Roll Call Vote: Quick, yes Hopkins, yes; Nield, yes; England, yes. DISCUSSION OF ALLOCATION OF FINES ON WITHHELD JUDGEMENTS - Attorney Winmill stated he was at a meeting discussing allocation of fines on withheld judgements. Attorney Winmill stated the statute is clear in requiring that any fine or forfeiture for a misdemeanor originating out of the city is to be allocated 90% to the city and 10% to the state. Attorney Winmill stated they have not been doing this on with- held judgements. Attorney Winmill stated he would check with other district courts, to see how the budgets compare and report back to Mayor Cotant and Council. SCHOOL DISTRICT #25 - WHITAKER ROAD PROJECT - Mayor Cotant reported he had met with Bob Myers, School District #25 and discussed some ideas. Mayor Cotant reported School District #25 can provide a deed for ten acres at Cotant Park. Mayor Cotant said the city could accept the deed in liew of $60,000.00. He said the School District expected to be billed the approx. $7,000.00 for the hook-up fee. Mayor Cotant and Engineer Smart suggested the city complete the entire project, with the city being the contractor. The city would recoup all of the development costs and the School District #25 would give to the city the deed to the 10 acres at Cotant Park. The School District #25 would pay an approx. $7,000.00 hook-up fee. The alternative is; the School District would take over the project and reimburse the city the money that has been expended so far and they would become the contractor. Conlin, City Clerk CALL OF SPECIAL MEETING CITY OF CHUBBUCK Pursuant to Idaho Code Section 50-604, the undersigned Mayor of the City of Chubbuck, Idaho, hereby calls a special meeting of the City Council to be held at the Chubbuck City Municipal Building, 5160 Yellowstone, at the hour of 4:30 p.m., on this date the 29th of January, 1985. The object of the special meeting shall be to consider the following: 1) Group W Cable Agreement 2) School District #25 - Whitaker Road. 3) Discussion of allocation of fines on withheld judgements. ate: J hn'0.
