HomeMy WebLinkAbout09 27 1983 CMCOUNCIL MEETING MINUTES September 27, 1983 Minutes of regular council meeting held in the city municipal building September 27, 1983. Present: Mayor John 0. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, Leroy S. Quick, Thomas S. Nield, Attorney B. Lynn Winmill, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order by Mayor Cotant at 7:33 p.m. Approval of Minutes: Mayor Cotant asked for corrections and additions to the minutes of September 13, 1983. Councilman Kinghorn moved to accept minutes of September 13 as written. Councilman Nield seconded the motion. All councilmembers voted in favor of motion. 151 PUBLIC HEARING: A proposal by Arshad Ali, 525 South Main, Pocatello, Idaho for a change of land use district to General Commericial (C -2) and for a change of the City's comprehensive plan if necessary to allow construction of a super market at 225 E. Chubbuck Road. The existing land use district for parcel in question is Industrial (I). Mr. Ali is contract purchaser of property. Mayor Cotant opened the hearing and asked who was in favor of the proposal. A. J. Brennan, the seller of the property said he was in favor of the proposal. Mayor Cotant and Councilmembers looked at the map of the property. After discussion Mayor Cotant asked if anyone was opposed to the proposal. Councilman Nield stated there was no opposition to the proposal at the Land Use & Development Commission Meeting providing that it could be tied in with the existing property that is commercially zoned to the west. The only concern was that of spot zoning. Attorney Winmill read the Findings of Facts in full to the Mayor and Council. Councilman Nield made motion to approve the application, to rezone this piece of property from Industrial (I) to General Commercial (C -2) and to adopt the Finding of Facts. Councilman Kinghorn seconded the motion. Roll Call vote: Hopkins, yes; Nield, yes; Quick, yes; Kinghorn, yes. PUBLIC HEARING: AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING CHUBBUCK CITY ORDINANCE NO.241 (Land Use Ordinance) by motifying the schedule of General Controls in Section 2 -3(b), and to show Animal Care Sites and Commercial Kennels as conditionally permitted uses in an Agricultural Land Use District and to modify the provisions of Chapter 7 concerning hearing procedures for consideration of applications for variances, conditional use permits, amendments to the Land Use Ordinance and revisions to the city's Comprehensive Plan. Mayor Cotant declared this public hearing opened. 153 PUBLIC HEARING - ORDINANCE #246 con't) Discussion on where to allow duplexes and multi - dwelling homes. Discussion on Kennels. After discussion Councilman Nield made motion to dispense with the rule of reading Ordinance #246 (amending #241) on three separate days. Councilman Quick seconded the motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes; Nield, yes. Councilman Quick made motion to adopt Ordinance #246 (amending #241). Councilwoman Hopkins seconded the motion. Roll call vote: Hopkins, yes, Kinghorn, yes; Quick, yes; Nield, yes. BUSINESS LICENSE - John Putman, to conduct door to door selling of produce. Councilwoman Hopkins expressed concern of the door to door selling. After discussion Councilman Nield made motion to grant Mr. Putman a Business License to sell door to door. Councilman Quick seconded the motion. Roll call vote: Hopkins, yes; Kinghorn, No; Nield, yes; Quick,yes. BUSINESS LICENSE - Chong K Yun, at 4802 Yellowstone Ave., to sell Baby Strollers & tricycles. Mrs. Yun was present and explained how they were going to run the business. The Mayor and Council asked her questions they had. After discussion Councilman Kinghorn made motion to grant Mr. Yun a business license for one week. Councilman Nield seconded the motion. After discussion Councilwoman Hopkins made motion to grant Mr. Kalivas a Catering Permit October 14, 1983 from 7:00 p.m. to 11:00 p.m. at the El Ceilto. Councilman Kinghorn seconded the motion. All Councilmembers voted in favor of the motion: RESOLUTION #11 -83 - Appointing Election Judges and Clerks for the 1983 Election. Mayor Cotant read Resolution #11 -83 in full. Councilman Quick made motion to adopt Resolution #11 =83. Councilman Kinghorn seconded the motion. All Councilmembers voted in favor of the motion. AUDITOR - L13yd Monroe was present and presented a quote to the Mayor and Council. Mayor and Council discussed the Audit with Mr. Monroe. Councilman Kinghorn asked if the City was under contract with Mr. Carter. The Mayor said no. Councilman Nield made motion the Council direct Mayor Cotant to enter into contract with Lloyd Monroe to Audit the September to September 1983 books. Councilman Quick seconded the motion. All Councilmembers voted in favor. 155 CLAIMS - Handcheck claims presented to the Mayor and Council. After discussion Councilwoman Hopkins moved to approve the handchecks presented. Councilman Quick seconded the motion. All councilmembers voted in favor of the motion. RECIPROCAL FIRE FIGHTING ASSISTANCE AGREEMENT - Mayor Cotant read the agreement in full. This agreement is with Pocatello. Councilman Quick asked if the City gets reimbursed for fighting fires outside the Fire District. Mayor Cotant said the City does not and the City should look into this. Mayor Cotant stated the City should look close to see if the income from the Fire Agreeements is off setting the costs. Mayor Cotant suggested the City might get a better Fire Rating without the Agreements. Mayor and Council discussed the agreement at length. Mayor Cotant stated the City needed a contract before the Fire Department could make calls to the Pocatello Valley District. Councilwoman Hopkins made motion that Mayor Cotant enter into the Reciprocal Fire Fighting Assistance Agreement. Councilman Quick seconded the motion. All Councilmembers voted in favor of the motion. ORDINANCE #244 - Mayor and Councilmembers_ discussed and decided to table the matter until they could go take a look at the property. GENERAL DISCUSSION: 1) Police Department - Cabinet for Dark Room. 2) Trailer on Tree Valley Road. 3) Mayor Cotant and Councilman Kinghorn reported on the Joint Fire Meeting.
