HomeMy WebLinkAbout11 24 1981 CMCOUNCIL MEETING MINUTES November 24, 1981 149 Minutes of regular council meeting held in the city municipal building November 24, 1981. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr., Public Works Director Steven M. Smart and City Clerk Vera C. Armstrong. Councilman Dwain A. Kinghorn was excused. Meeting called to order at 8:00 p.m. by Mayor Cotant. Mayor Cotant asked for any corrections or additions to minutes of the November 10 and November 17 meetings. Attorney Burnett asked for correction of November 10 minutes, that the 3rd paragraph from bottom of page 139 should read "definition of animal care site" instead of kennel. Councilman Romriell moved to approve minutes of November 10 and November 17 with correction as requested in regard to definition of animal care site. Councilman Quick seconded motion with an unanimous vote in favor of motion. DEPARTMENT OF HIGHWAYS - Mr. Bryant Brown and Mr. Bob Harrison of Idaho Division of Highways were present to discuss with council the Department of Highways Proposed Functional Street Plan for Urban Development Planning with the Metropolitan Planning Organization. Mr. Brown told council the Metropolitan areaclassification has been de- signated to this area as a result of the last census and total population of area being over 50,000. Mr. Brown told council some Federal Highway Aid is available for Urban Development Planning. Urban Development takes in collector and arterial streets. Mayor Cotant thanked Mr. Brown and Mr. Harrison for coming out to the meeting. It was the consensus of council that Attorney Burnett could prepare a resolution explaining any street classification differential of any consequence. DESIGN REVIEW - William McKee, McKee's Feed & Seed, 130 Evans Lane. Mr. William McKee was present and stated he was not aware of the fact that he was to present a design review or plan of proposed green area, and that he would need to present the plan and have it approved prior to securing his complete building permit. Mr McKee was instructed to bring his design review plans into the city office for council review. CLAIM DENIAL - Robert Newsome, 581 Chickadee, has presented a claim for replacement of a shed damaged during a police arrest made of a neighbor and the claim was denied by the city's insurance. Mr. Newsome told council he felt the city has a liability as to the damage of his shed due to the police arrest of his neighbor. Mr. Newsome also said he had never been notified by the city that his shed had been damaged during the arrest. 151 CLAIM - cont'd - Attorney Burnett told Mr. Newsome he would personally check out the disposition of the court order on Mike Hall. Police informed the City Clerk that Mr. Hall was to make restitution on damage to shed within a 60 day will-pay period. Attorney Burnett said he would check out what the will-pay period is and let Mr. Newsome know. Councilwoman Hopkins suggested council wait and find out what information Attorney Burnett can find regarding the situation. Mayor, Councilmembers and Attorney Burnett said that all city employees should accept the responsibility of notifying the city and also the affected party when any damage has been done as a result of any city employee involvement. PIGS ZN CITY - Mr. Mrs. James Worthen, 730 E. Chubbuck Rd.~ were present at meeting. Mr. Worthen said he owned property on Tree Valley Road and asked if there was any way he could keep pigs on his property. Mr. Worthen was informed he could not keep pigs on his property within the city. CONSIDERATION OF TELEPHONE BIDS - Bids were received for a telephone system at the November lO council meeting. Bids were taken under advisement, and are being considered again this evening. Councilman Quick stepped down from the council table and deemed himself disqualified to vote on the telephone bid matter. Public Works Director Steven Smart recapped the specifications and reviewed with council and bidders the different options of the bids. Councilman Romriell moved to table action on telephone bids, Councilwoman Hopkins seconded motion, with an unanimous vote in favor of motion. TRANSFERS - Certain fund transfers are needed to balance out budget year 1980-81 fiscal budget. ~ Councilwoman Hopkins moved to approve the following fund transfers to balance out fiscal budget year 1980-81. GENERAL FUND TRANSFERS: $432.68 from 10-4904-900 Governmental General Fund Balance to 10-4229-350 Law Enforcement Gasoline, $632.61 from 10-4904-900 Governmental General Fund Balance to 10-4320-310 Engineering Supplies, $2,587.05 from 10-4904-900 Governmental General Fund Balance to 10-4381-110 Park Salaries. SANITATION FUND TRANSFERS: $2,389.99 from 30-4339-900 Sanitation Fund Balance to 30-4338-610 Sanitation, Equip, Repairs & Maintenance. Councilman Romriell seconded motion. All councilmembers present voted in favor of motion. 153 GENERAL DISCUSSION ITEMS: l) Consideration of Dog License and Control Ordinance. 2) Representative Rusty Barlow was present at latter portion of meeting and remarked he has appreciated working with Mayor Cotant and expressing the needs of Chubbuck. RENEWAL OF BEER, WINE AND LIQUOR LICENSE - Councilman Romriell moved to approve the license renewal of all present beer, wine and liquor licensees. Councilwoman Hopkins seconded motion, all councilmembers voted in favor of motion.
