November 10, 1981
Minutes of the regular council meeting held in the city municipal building
November 10, 1981.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain
A. Kinghorn, LeRoy S. Quick, Attorney Donald L. Burnett, Jr., Engineer
Steven M. Samrt, City Clerk Vera C. Armstrong. Attorney Lynn B. Winmill
was also present. Councilman Earl L. Romriell was excused.

Mayor Cotant asked for corrections or additions to minutes of October 13,
October 20 and November 4th.
Councilman Kinghorn moved to approve minutes of October 13 with the addition
on page 123, Heading Public Hearing of John Stoddard, that Councilmembers
Kinghorn and Romriell stepped down and disqualified themselves to vote,
and also under heading McArthur Design Review Permit, that required
(instead of entire) parking area be paved within one year. Councilman
Quick seconded motion with an unanimous vote in favor of motion.
Councilman Quick moved to approve October 20 minutes as written. Councilman
Kinghorn seconded motion with all councilmembers voting in favor.
Councilman Quick moved to approve November 4 minutes. Councilwoman
Hokins seconded motion with an unanimous vote in favor of motion.
PUBLIC HEARING - Continuation on Conditional Use Permit application, or
change of Land Use District to operate a kennel at 211 Hiway Avenue
by Mr. and Mrs. John Stoddard.
Mayor Cotant reviewed the public hearing held October 13th. Councilm~mbers
Ki~ghorn and Romriell disqualified them~el~ve~s to vote on matter and
became participants in hearing. Councilwoman Hopkins was not present
on October 13. Councilwoman Hopkins has listened to tapes of hearing
and is present at this meeting for continuation of hearing matter.
Councilwoman Hopkins commended Mr. Stoddard on the clean manner in
which they care for the dogs and for the service they are providing,
but also said she weighed the matter very carefully and felt this being
a residential area, needed consideration in her decision.
Councilwoman Hopkins seconded the motion made by Councilman Quick at
the October 13th meeting. Councilmembers Hopkins and Quick both voted
in favor of motion.
Councilman Quick's motion was to deny the conditional use permit and
also to deny the request for a land use change.
Mr. Stoddard said he would like a definition clarifying exactly what
a kennel is in relation to what a dog shelter is for personal care
of dogs.

Attorney Burnett read definition of a k~, and further explained
a dog shelter for personal care of ones own dogs.
Mr. Stoddard said he would license and continue to keep several dogs,
that he had nine dogs at the present time.
Mr. Dwain Kinghorn said he would like this matter taken care of once
and for all at this meeting.

PUBLIC HEARING - JOHN Stoddard cont'd - Councilman Quick told Mr. Kinghorn
the action has been to deny the operation of a kennel as a conditional
use permit and also to deny the request for change of zone, if Mr.
Stoddard continues to keep dogs and they become a nuisance, then proper
action will need to be taken.
DESIGN REVIEW - William McKee, McKee's Feed and Seed, 130 Evans Lane, for a 60 ft. x 48 ft. addition to existing building.
Mayor Cotant said he felt the council should consider requiring some
blacktopped area and a green area.
After review, Councilwoman Hopkins moved to approve McKee's Design
Review Permit following the recommendations of the Land Use Commission
with additional condition of requiring parking area directly in front
of store be blacktopped within one year, that a green area be developed,
that until a plan or design review is presented and approved by council
that an excavation and foundation building permit only be issued.

DESIGN REVIEWS - NON-CONFORMING EXISTING S~GNS - The following design
review permits have been received.

After reviewing, Councilman Quick moved to approve the Design Review
Permits of Jackson's Sales and McKnights, Inc. Councilman Kinghorn
seconded motion. All councilmembers voted in favor of motion.
RESOLUTION #7-81 - Ratifying formation of North Bannock Metropolitan Planning
Organization.
Rodney Watkins, Director of Southeast Council of Governments and Engineer
Steven Smart explained the formation of the Planning Organization.
Mayor Cotant read Resolution #7-81 in full.
Councilman Kinghorn moved to adopt Resolution #7-81, Councilman Quick
seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Quick,
yes.
Attorney Burnett advised city to be sure the functional classification
system was not inconsistent with city plan, and if there is any difference,
the city should adopt resolution along with the functional classification
system explaining any classification inconsistentcy with city plan.
CLAIM - Robert C. Newsome, 581 Chickadee, has presented a claim for replacement
of storage shed that was damaged during police arrest of a neighbor.
After consideration, Councilman Quick moved to deny the claim to Robert
C. Newsome, 581 Chickadee, since there appears to be no liability on
city's behalf and the city being concerned that any payment on behalf
of city would set a precedence that could jeopordize the city in any
future claims. Councilwoman Hopkins seconded motion with an unanimous
vote in favor of motion.

CLAIM - Marilyn Price, 1779 W. Quinn, presented a claim of $200.00 to
reimburse her for the deductible she pai. d to have a family member's
car fixed as a result of being hit by a Chubbuck Fire Department Fire
truck while she was stopped at stop light at the intersection of Pole
Line & Quinn Rd.
Councilman Quick moved to table claim of Marilyn Price on the understanding
the matter is being taken care of by the city's insured, or until such
time as may be necessary for further action. Councilman Kinghorn seconded
motion, vote was unanimous in favor of motion.
TELEPHONE BIDS - Ci. ty has again called for bids on a telephone system,
Councilman Quick deemed himself disqualified to take part in opening
of bids or to vote on any action to be taken and stepped down from
council table. Start Hales, BCS; LeRoy Quick, Executone; and Sharon
Fougerouse with Mountain Bell were present and all presented bids.

SERVICE CHARGE is the installation costs and Mountain Bell presented a monthly
pay out rate. City cannot purchase Mountain Bell equipment but can pay
a fixed rent up front and then a monthly charge, a monthly schedule for
the balance is also entered on the bid.

TELEPHONE BIDS cont'd - Attorney Burnett reported all telephone bids
have adequate security.
Councilwoman Hopkins moved to table any action on bids pending
a recommendation report of Engineer Smart. Councilman Kinghorn
seconded motion, with an unanimous vote in favor.
CONSIDERATION OF ADVERTISING FOR BIDS FOR LADDER AND PUMPER FIRE ENGINE.
After some discussion, Councilwoman Hopkins moved to prepare invitation
to bid for a Ladder and Pumper Fire Engine. Councilman Quick seconded
motion, all councilmembers voted in favor of motion.
CONSIDERATION OF SHOP HEATING BIDS - Bids have been received previously
from Luxaire Heating for a Co-Ray Vac Natural gas 3-burners, installed
complete for $7242.00, Greene Plumbing bid the same system installed
complete for $9780.00.
Councilman Kinghorn moved to declare the bid of Luxaire Heating
as the lowest responsible bidder and authorize the mayor to enter
into a contract. Councilman Quick seconded motion, with all council-
members voting in favor of motion.
ORDINANCE #230 - relating to business license fees and beer and wine
license fees was read in full by Mayor Cotant.
Councilman Quick moved to dispense with the rule of reading ordinance
on three separate days. Councilwoman Hopkins seconded motion.
Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes.
Councilman Kinghorn moved to adopt Ordinance #230, Councilman Quick
seconded motion. Roll call vote: Hopkins~ yes; Kinghorn, yes;
Quick, yes.
CLAIMS - Mayor and council reviewed claims.
Councilwoman Hopkins moved, Kinghorn seconded at 11:30 p.m. to
adjourn meeting until Tuesday, November 17, at 7:00 p.m.
