Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr., Engineer Steven H. Smart and City Clerk Vera C. Armstrong. Meeting called to order at 8:00 p.m. by Havor Cotant. ~iavor Cotant asked for corrections or additions to minutes of AuGust ll, 1981. Councilwoman Hopkins asked that her comment, second paraqraph from bottom of page 95 be changed to "dogs that start killinq animals could possibly do harm to humans." Councilman Romriell moved to approve minutes of August 11, 1981 with corrections noted. Councilman Quick seconded motion. Unanimous vote in favor of motion. HEARING: Garland Henry, 4929 Yellowstone has received notice from the police department to remove weeds, older vehicle and trailer from his lot, and has requested the hearinq. Mr. Henry was presen~ and stated he had cut weeds around his business, that he stores parts in the mobile trailer and would like to keep for that purpose, and that he would like to restore the older vehicle. Chief Stone said perhaps there was a misunderstandinq about the cleanin~ up of weeds on Mr. Henry's property, that the intent of the cleanup notice was to clean up ali the weeds which are on his property. Mayor Cotant explained to Mr. Henry that the city ordinances prohibit junk automobiles, and city also has a weed ordinance which prohibits weeds to become offensive. Mr. Henry asked that he be given two weeks to dispose of or repair the automobile, stated he would move his mobile trailer and utility trailer immediately behind his shop for a heater appearance. Mr. Henry also said he would be glad to clean up the weeds on his property if everyone else in city did the same. Attorney Burnett asked that the minutes reflect that the letter sent by the police department to Mr. Henry clearly means that all the weeds need to be cleaned off his property and the car removed. The matter was tabled for a two week oeriod, to be reviewed again at September 8 meeting. TELEPHONE SYSTEM - Mayor and Council reviewed an advertisement to bid on a new telephone system together with the specifications for same. After reviewing, Councilwoman Hopkins moved to advertise for bids on a telephone system. Councilman Romriell seconded motion. Roll call vote: Hopkins, yes; Kinqhorn, yes; Romriell, yes. Councilman Quick abstained from voting as his company will be bidding. 105 CLAIMS - Three additional claims were presented to Mayor and Council for consideration. Councilwoman Hopkins moved to approve the following claims, 1) $50.00 to Malad City Little League for a tournament fee, 2) $14.25 to Richard Webb, to reimburse the expense of three luncheons at a crime prevention meeting, and 3) $7222.82 to Idaho Bank & Trust Co. as a payment on the 1977 FMC Mini Pumper Fire Truck. Councilman Romriell seconded motion, vote was unanimous in favor of motion. SALARIES FOR MAYOR AND COUNCIL - Mayor and Council discussed an increase in salaries for the Mayor and Council positions. The proposal being $300.00 per month for council members and $700,00 per month for the mayor. The matter was fully considered with the general feeling that the increase in salary was in order. ORDINANCE #227 - Establishing salaries for Mayor and Council read in full by Mayor Cotant. Councilwoman Hopkins moved to dispense with the rule of reading ordinance on three separate days. Councilman Romriell seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes; Romriell, yes. Councilman Romriell moved to adopt Ordinance #227, establishing salaries for the Mayor and Council to $300.00 for councilmembers and $700.00 per month for Mayor. Councilman Quick seconded motion. Roll call vote: Hopkins, yes; Kinghorn, no; Quick, yes; Romriell, yes. TRENTHAMS PEACOCKS AND ANIMALS - Mr. Orson Trentham, 137 Mingo has been sent a letter from the police department asking him to remove the peacocks from his property. The police having declared the noise, etc. a nuisance. Mr. Trentham gave written notice for a hearing, however, Chief Arnold J. Stone reported at 8:45 p.m. in this meeting that Mr. Trentham had with- drawn his request for the hearing. Chief Stone reported that Mr. Trentham had removed his peacocks as of this day, Tuesday afternoon, August 25 at 4:00 p.m. Mr. Don Stinger, 147 Mingo, was present at meeting and reported that Mr. Trentham's animals were a nuisance because of their noise and smell, and the vermins brought about with feeding of the animals, After a lenghthy discussion, Attorney Bulnett asked to have the City, through the city police department, monitor the situation over the next few days and see in terms of other nuisance factors; odor, presence of vermin, etc, whether or not that situation substantially improves as a result of the peacocks being moved out and other improvements he may make, if it does no~ that the city attorneys office would be prepared to start citing him for criminal, or filing complaints for civil actions to clean up the rest of the problem. Councilman Kinghorn made motion that city find that there is no action warranted at this time on weed condition and appearing not to need remedial action, and as to animals kept on premises, that city take no action under the animal control ordinance at this time, nor under zoning ordinance, but city continue to monitor the situation from nuisance standpoint. Council- woman Hopkins seconded motion. All councilmembers voted in favor of motion. *ADDITION : The mayor and council were conderned about the lack of modern sanitation facilities at Mr. Trenthams home. 107 TENTATIVE BUDGET CONSIDERATION -A tentative budget has been worked up through several budget workshops and was reviewed by the mayor and council. Councilwoman Hopkins moved to approve the tentative budget as worked up and authorize city clerk to publish a public hearing notice on the final budget to be held September 8, 1981. Councilman Romriell seconded motion. All councilmembers voted in favor of motion. GENERAL DISCUSSIONS: 1) Sewer alarm on Hiway Avenue. Council felt the alarm on Hiway Avenue should be installed. 2) Conversion to propane fuel on city vehicles, mayor and council feel the city should advertise for bids. 3) Heat bid on the shop, mayor and council feel city should advertise for bids on the heating of shop.
