COUNCIL MEETING MINUTES
August ll, 1981
Minutes of the regular council meeting held in the city
municipal building, August 14, 1981.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky
A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell,
Attorney Donald L. Burnett, Jr., Engineer Steven M. Smart
and City Clerk Vera C. Armstrong.
Meeting called to order at 8:00 a.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to minutes
of July 28, 1981.
There being none, Councilman Quick moved to approve minutes
as written of July 28, 1981. Councilman Kinghorn seconded
motion, vote was unanimous in favor of motion.
HEARING: Jeffery T. Mills, 210 Briscoe, has requested a
hearing, Mr. Mills was present and requested that his
dog not be destroyed.
Chief Arnold Stone said city has picked up the dog and
the dog is being held as a nuisance dog. Mr. Mills has
attempted to contain dog and has been unable to do so
and he believes if dog is released, Mr. Mills will continue
to be unable to contain him.
Helen Burry, 201 W. Siphon, said the dog had been out
and killed two of their sheep, she did not see the dog
kill the sheep, but saw blood and sheep wool on the dog.
Duane Paulsen, 209 Siphon, testified he was sure the dog
had killed Mrs. Burry's sheep~ which were in his yard,
also had killed some rabbits of his and he had some chickens
come up missing.
Councilman Kinghorn and Councilman Romriell both made
comments that they loved dogs, but were both fearful of
allowing a dog to be kept that has done harm numerous
times.
Councilwoman Hopkins made statement that it has been her
observation that dogs that start killing animals w411 could
eYen~a~y do harm to humans.

Attorney Burnett advised council, prior to any action
taken, not to dispose of the dog Wednesday morning but
to wait for 24 hours after Wednesday morning, if the action
is in favor of disposing of the dog.

Councilwoman Hopkins moved to have Jeffery T. Mill's dog
put away. Councilman Kinghorn seconded motion. Vote
was unanimous in favor of motion.
DOGS BEING KEPT AT JOHN STODDARD RESIDENCE, 211 Hiway Avenue.
Mr. and Mrs. John Stoddard and Mrs. Judy Stoddard with
the Bannock Humane Society were present.
Mrs..Judy' Stoddard, Bannock Humane Society, explained that
they pick up unwanted dogs and take care of the dogs at
her son's residence, 211 Hiway Avenue.
Animal Control Officer Jane Guidinger related that she has
had inquiries about the dogs at the Stoddard residence
for the past two years and asked the Stoddards to come
to the meeting so the Council could decide what should
be done about the keeping of so many dogs at the Stoddard
residence.
Attorney Burnett explained to Mr. and Mrs. Stoddard that
it sounds to him that they are running a kennel. He further
added a kennel is allowed only in commercial and industrial
zones and that Mr. and Mrs. Stoddard should come into
the city clerk's office and make application for a variance.
City Clerk Vera Armstrong questioned if the ordinance
allowed for a variance application to operate a kennel
in a residential zone.
Attorney Burnett informed Mr. Stoddard it was the duty
of the city clerk to process any application received.
After further discussion, Attorney Burnett suggested to
Mr. and Mrs. Stoddard, that in making their application,
to make it very broad, e.g., a variance, conditional use
permit or rezoning, whichever is applicable.

Councilman Quick moved to approve the Design Review applications
on the following permanent signs, signs which are already erected
and require a design review to allow non-conforming signs to
remain in place; 1) Idaho Bank & Trust Co., 4730 Yellowstone,
2) Shelby Outdoor Advertising, Pole Line Rd. and Quinn Intersection;

TV Service, 5003 Yellowstone; 6) Gregory Romriell, Dental
Clinic, 4544 Yellowstone. Councilwoman Hopkins seconded
motion. Roll call vote; Hopkins, yes; Kinghorn, yes;
Quick~ yes. Councilman Romriell abstained from voting
because of a personal interest in the application from
Gregory Romriell.
Councilman Quick moved to approve the Design Review application
from Fred Martin, Highland Motors, 4803 Yellowstone Avenue,
the application being for a new sign to be placed on the
building. Councilman Romriell seconded motion. Vote
was unanimous in favor of motion.
Councilman Quick moved to accept the Design Review application
of Rax Roast Beef on Yellowstone, within the Pine Ridge
Mall. Councilman Kinghorn seconded motion with all council-
members voting in favor of motion.
FIRE DEPARTMENT JAMBOREE- Fire Chief Bart Parrish and Training
Director Earl Cluff were present. Chief Parrish requested
financial aid from the city to put on the jamboree.
After discussing, Councilman Romriell moved for the city
to approve up to $12000 for the Volunteer Fire Jamboree,
provided there is proper requisitions for proper functions
and expenditures. Councilman Quick seconded motion with
all councilmembers voting in favor of motion.
WATER SUPPLY AT RURAL FIRES - Chief Parrish told Mayor and
Council that it was his understanding the Fire Department
were supposed to be able to use the city water truck
whenever necessary.
Mayor and Council assured Chief Parrish that the city
water truck is to be at their demand for use at any time
needed.
RESPONSE TO FIRES Chief Parrish related to council the
circumstances regarding a fire call that was delayed by
the dispatch unit of the Bannock County Sheriff's office.
Council suggested that Chief Parrish visit with Bill Lynn
of t.he Bannock County Sheriff's office concerning the
dispatch problem.
GENERAL DISCUSSIONS: 1) Ordinance enforcement.
2) Gas for fire trucks at night.
3) New police officer, police to advertise for applications.
4) Bid process on police car.
5) Chubbuck Newsletter on Crime Prevention, etc., Officer
Webb had requested $150.00 from city towards this
newsletter.

HEARING:
PROPOSED USES OF FEDERAL REVENUE SHARING FUNDS
Mayor Cotant opened the hearing on the proposed uses of
federal revenue sharing funds.
There was no oral or written comment from the public on
the proposed uses of Federal Revenue Sharing funds for
the upcoming fiscal budget year of 1981-82.
Mayor Cotant declared the hearing closed.
CLAIM Ruby Johnson, 754 Washington, has presented a claim
against the city because of hot oil splattering on her
car after driving on a street in Chubbuck after cracks
in street had been filled with hot oil.
Councilman Quick moved for city clerk to forward claim
to the insurance company for consideration. Vote was
unanimous in favor of motion.
CLAIMS TO BE PAID IN AUGUST presented to Mayor and Council.
After reviewing, Councilman Kinghorn moved to
claims, Councilwoman Hopkins seconded motion.

AMENDED SEWER AGREEMENT FOR TREATMENT of sewage by Pocatello
City for area lying south of Interstate 86.
Councilman Romriell moved to authorize Mayor Cotant to
enter into this amended agreement. Councilman Quick seconded
motion. Vote was unanimous in favor of motion.
Councilwoman Hopkins moved, Kinghorn seconded, with full
council approval to adjourn meeting at 12:00 midnite.
