HomeMy WebLinkAbout11 27 2012 CMCity of Chubbuck 191 Council Meeting Minutes November 27, 2012 7:00 p.m. Minutes of a regular Council Meeting held at the Chubbuck City Council Chambers, November 27, 2012. Present: Mayor Steven England, Council Members: Josh Ellis, Kevin England, Brent Marshall, Kermit Morrison, Attorney Thomas Holmes, Public Works Director Steven Smart, City Clerk Rich Morgan. The meeting was called to order at 7:00pm by Mayor Steven England. The Pledge of Allegiance to the Flag was led by Mayor Steve England. Approval of Minutes - Council Member Morrison moved to approve the regular meeting minutes of November 13, 2012. Council Member Marshall seconded. Roll call vote: England - yes, Ellis -yes, Marshall -yes, Morrison -yes. Fire Department Water Tender Discussion - Chief King reviewed possible contributing factors to the Water Tender accident that happened November 8, 2012. The water tender had been built on site. The tank was not baffled like it should have been. The speed turning the corner was a factor. Although the driver has a CDL, and is a 27 year veteran with the department, familiarity with this particular piece of equipment was low. Fatigue could have also been a factor. Chief King also address the staffing concerns facing his department. The departments pay call numbers are down and they are in the process now of hiring. Chief King explained the roll of a water tender in the fire department as an on site water source. Chief King has asked the two Fire Districts the City has contracts with how much they would be able to contribute toward the fire tender purchase. A response has not been received as of tonight. Council Member Ellis asked about the contracts with the county districts. The two districts contribute approximately $200,000 for their fire suppression. Council Member Ellis asked that we bring the fire districts to the table and make sure those contracts pay for themselves. Chief King explained the water carrying capacities of each of the departments apparatus. Chief King reported that the insurance payout on the water tender is $65,000. Chief King has been researching the replacement of this truck and has found that a used truck will run approximately $195,000 and a new truck will run approximately $250,000. During the last week Chief King identified a used and new truck as possible purchases by the department. As of this council meeting both trucks have been purchased by other fire departments. Chief King asked the council to consider an emergency purchase declaration on a used truck as the City will need to move quickly. If the Council decided to order a new truck with specifications it would be advisable to use the bid process required by state statute. To build a new truck will be approximately eight months out. Council Member Marshall asked if there was anything salvageable on the truck. Chief King responded nothing was salvageable and he does want his apparatus used or new to be NFPA compliant. It was stated that financing is available through Council Meeting Minutes - Continued 193 November 27, 2012 Citizens Community Bank at 3 %. On a 6 year loan the payment would be approximately $35,000 annually. Chief King was directed to keep his feelers out on the possibility of purchasing a used truck and develop specifications to initiate the bidding process for a new one. III -A Rates and Assessments Discussion - Mayor England explained the background of the III - A. In August of 2011 the City of Chubbuck joined the III -A and the III -A started performing administrative duties for the member cities in March of 2012. In September of 2012 the Department of Insurance, notified the III -A that the DOI considered the III -A insolvent and that by Idaho code they had 90 days to cure the insolvency. That 90 day deadline is December 6, 2012. In October of 2012 the III -A raised the premium rates by 19% and announced that in January of 2013 an additional raise in rates of 36% would take effect. On November 20, 2012 an assessment was made by the III -A of its member cities of $2,160 per employee. This assessment is a total of $177,120 for the City of Chubbuck. The City's position on the board has been that the trust should be liquidated. However, our position is the minority position at this time. The City's Attorney has suggested it would be prudent to remit the assessment and see where the trust is on December 6, 2012. Council Member Ellis asked if there was a way to submit the assessment with conditions. The City Attorney suggested that this would put the City at risk. The City needs to remit the assessment in accordance with the assessment invoice. Council Member Ellis moved to remit the assessment to the III -A. Council Member England seconded. Roll call vote: England -yes, Ellis -yes, Marshall -no, Morrison -yes. Computer printout claims for November 27, 2012 were presented to Mayor England and Council. Council Member Morrison moved to approve the claims. Council Member Marshall seconded. Roll call vote: England -yes, Ellis -yes, Marshall -yes, Morrison -yes.
