Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, LeRoy S. Quick, Earl L. Romriell, Attorney Donald L. Burnett, Jr., Engineer Steven M. Smart and City Clerk Vera C. Armstrong. Meeting called to order at 8:00 p.m. Mayor Cotant asked for corrections or additions to minutes of the two meetings held January 13, 1981. Councilman Kinghorn moved to accept minutes for both meetings held January 13, 1981. Councilman Romriell seconded motion. Voting was unanimous in favor of motion. PROPOSED SUBDIVIDING OF LAND WITHIN ONE MILE OF CITY LIMITS - Gene Hancock discussed informally with Mayor and Council subdividing a parcel of property on the southeast corner of Philbin and West Siphon Road. Mr. Hancock questioned the council as to the requirement of sub- dividing if four lots were sold with size of two lots being 8.8 acres each and two lots being 10.12 acres each, and the possibility of a 5.4 acres lot being sold or purchased back by original owner. Attorney Burnett told Mr. Hancock the City Land Development Ordinance required property to be platted when, l) a parcel of land is sub- divided into three or more smaller parcels, any one of which is less than than five acres~ unless such subdivision results from a decree distributing the estate of a decedent or from the exercise of the power of eminent domain as defined and authorized in the Idaho Code, 2) Creation of any street to which the general public may have access, regardless of whether or not such street is intended by the landowner to be dedicated to the public~ 3) Undertaking a project of construction, installation or placement of any structure upon land, except for agricultural purposes, and further excepting the construction, installation or placement of one single family dwelling on a single parcel of land. Councilman Kinghorn told Mr. Hancock it would be necessary for the 5.4 acre lot to go to one or the other lots bordering the 5.4 acre lot so the parcel would not be left as an island piece of property without access to same. Mr. Hancock assured the council that if property owners on the north did not purchase the lot it would be offered with the 8.8 acre lot to the south. 13 CONSIDERATION OF TIME EXTENSION OF FINAL PLAT - Mr. Klane F. Forsgren, former owner of a parcel of property on the northwest corner of East Chubbuck Road and Whitaker Road has requested by letter an extension of time to March 30-to file final plat of K. Subdivision. The preliminary and final plat were both previously approved by the Land Use Commission and the City Council. Mr. and Mrs. Kent Kunz have purchased the piece of property. Mrs, Kent Kunz and Mr. Dan Kunz were present at meeting, Mrs, Kunz stated the sales contract included an agreement that Mr. Forsgren would file the plat. However, they were not aware Mr. Forsgren had asked to extend the time to file the plat and would like to talk to Mr. Forsgren before city takes action on this request. Councilman Romriell moved to table this matter of business until February 20 council meeting. Councilman Quick seconded motion, vote was unanimous in favor of motion. LICENSING OF DOGS - Jane Bird, Animal Control officer, discussed dog licensing with mayor and council, also issuance of citations without giving notice. Our present ordinance now covers this, but is not perfectly clear to police department. Attorney Burnett reviewed the animal control ordinance and told council he would write an amendment which would make clear the section to allow citations to be issued without giving notice. Mayor and council further discussed raising the dog license fee, making a discount if licenses are purchased the first sixty days of each year, making it a misdemeanor to give false information about whether a dog has been spayed or neutered. DISANNEXATION CONSIDERATION REQUEST - Bob Hart, 4848 Pleasantview, owns approximately 50 acres of farmland south of East Chubbuck Road and West of 1-15 within the city limits. Mr. Hart told council he would like this farmland disannexed from the city because of the higher taxes. Mr. Hart also informed council that the family intends to keep this property classified as farmland for a least fifteen years. Mayor and council voiced opinion that the city would have no objections to disannexing his property. Councilman Hopkins moved to adjourn until 7:00 p.m., February 3. Councilman Quick seconded motion.
