AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
10.08.050 TO PROVIDE FOR A FIFTEEN MILE AN HOUR SPEED LIMIT IN THE
RACHEL'S RAINBOW SUBDIVISION AND IN THE ROUNDABOUT AT HILINE ROAD
AND MOUNTAIN PARK ROAD AND A 35 MILE PER HOUR SPEED LIMIT ON SIPHON
ROAD BETWEEN YELLOWSTONE AND HILINE; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS OF CHAPTER 10.08 NOT
AMENDED SHALL REMAIN IN EFFECT; AND PROVIDING WHEN THIS ORDINANCE
IS EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. The following amendment are hereby adopted:
10.08.050: SPEED LIMITS:
A. The health, safety and welfare of the inhabitants of the city, as well as of persons visiting
the city, require that reasonable limits be imposed upon the speed at which vehicles may
be operated within the city. After appropriate traffic surveys and with the advice of the
city's public works director and other staff the following limitations are adopted:
1. Thirty five (35) miles per hour or such other limit as the Idaho department of
transportation or its successor may establish, upon any thoroughfare within the city which
is part of the highway system maintained by the Idaho department of transportation or its
successor agency.
2. Thirty five (35) miles per hour oD Poleline Road as it extends from the intersection
with Yellowstone Avenue to the southerly boundary of the city.
3. Thirty (30) miles per hour on thoroughfares which are designated as "arterial
thoroughfares" except for the following limits:

"Arterial thoroughfares" are East and West Chubbuck Road, Hawthorne Road, Hiline
Road and Siphon Road.
4. Fifteen (15) miles per hour on all streets lying within the Rachel's Rainbow
Townhouse Development according to the subdivision plat thereof on file with the
Bannock County Recorder, including streets known as Raindrop Drive, Rachel's Run,
Annie's Ave. and that portion of Ramsgate Drive 1 dung within the Rachel's Rainbow
Subdivision. Additionally, due to the narrowness of these streets, no on street parking is
allowed on these streets that are designated as fifteen mile per hour speed limit streets.
5. Fifteen (15) miles per hour in the roundabout located at the intersection of Hiline
Road, Mountain Park Road and Mallard Street.
4 6. Twenty (20) miles per hour on all thoroughfares not classified in this section.
B. The chief of police and public works director are authorized to post or cause to be posted
the speed limits set forth in this section upon thoroughfares within the city, consistent
with the standards for traffic control devices prescribed by Idaho Code.
C. It is unlawful and punishable as an infraction for any person to operate a vehicle upon any
public thoroughfare, including any street, highway, vehicularway or other thoroughfare, at
a speed greater than is reasonable and prudent under the conditions having regard to the
actual and potential hazards then existing. In every event, speed shall be so controlled as
may be necessary to avoid colliding with any person, vehicle or other conveyance on or
entering the thoroughfare in compliance with legal requirements and the duty of all
persons to use due care. Where no special hazard exists that requires lower speed for the
purpose of compliance with this subsection, the speed of any vehicle not in excess of the
limits specified in subsection A of this section shall be lawful, but any speed in excess of
such limits shall be prima facie evidence that the speed is not reasonable or prudent and
that it is unlawful.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City and any provision of the Municipal Code which are in conflict with the provisions of this
Ordinance are repealed to the extent of such conflict. All other sections of Chapter 10.08 not

herein amended shall remain in effect.

Section 2. Severability. The sections of this ordinance are severable. The invalidity of a
section shall not affect the validity of the remaining sections.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is dispensed with, and this Ordinance shall become
effective upon its passage, approval and publication.

SUMMARY OF ORDINANCE NO. 682
An ordinance of the City of Chubbuck, a Municipal Corporation of the State of Idaho,
amending Section 10.08.050 to provide for a fifteen mile an hour speed limit in the Rachel's
Rainbow Subdivision and in the roundabout at Hiline Road and. Mountain Park Road and a 35
mile per hour speed limit on Siphon Road between Yellowstone and Hiline; providing for the
repeal of conflicting ordinances; providing that all other provisions of Chapter 10.08 not
amended shall remain in effect; providing for the severability of the provisions of this ordinance;
providing that this ordinance shall be in effect after its passage, approval and publication.
