December 14, 1982
Minutes of the regular council meeting held in the city municipal
building December 14, 1982.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney
B. Lynn Winmill, Public Works Director Steven M. Smart and
City Clerk Vera C. Armstrong.
Meeting called to order at 7:40 p.m. by Mayor Cotant.
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or additions
to minutes of November 9 and December 7, 1982.
Councilman Kinghorn moved to accept minutes of November 9 as written.
Councilman Quick seconded motion. Vote was unanimous in favor
of motion.
Councilwoman Hopkins moved to accept minutes of December 7 as
written. Councilman Nield seconded motion. Vote was unanimous
in favor of motion.
BEER AND WINE LICENSE APPLICATION - Charles M. Eichman, Vice-President
of Convenient Food Mart, has made application for a retail sale
of beer and wine license. Convenient Food Mart is located in
the Pine Ridge Mall development and plans opening their store
the first part of February. Police Department have approved both
license applications.
After reviewing, Councilwoman Hopkins moved to approve issuance
of a retail sale of beer and retail sale of wine license to Charles
M. Eichman, for the Convenient Food Mart. Councilman Kinghorn
seconded motion. All councilmembers voted in favor of motion.
LEASE APPROVAL ON FIRE TRUCK - City has requested quotes from banks
on lease payments in regard to the acquisition of a new American
LaFrance fire truck for the city. Idaho Bank and Trust Company
submitted the lowest quote on the lease payments. Fire Chief
Bart Parrish picked up the truck in ElMira, New York, Monday,
December 6 and arrived in Chubbuck Monday evening, December 13.
After thorough consideration, Councilwoman Hopkins moved that
the city enter into a Lease Agreement, with purchase option, with
Starline Equipment of Boise, Idaho, for the acquisition of a 1983
American LaFrance fire truck, Serial No. CE 17648 331 994 O, with
an original purchase price of $233, 176.00 The lease term shall
be for a period of nine (9) years, commencing upon acceptance
of the equipment by the City. The lease payments shall consist
of an original lease payment of $63,176.00 due upon acceptance
of the equipment, and additional annual lease payments of $30,812.50
due annually on the first day of February, commencing on February 1,
1984, and continuing thereafter until February 1, 1991. Upon

payment of the last annual lease payment, all right, title and
interest in said fire truck shall vest in the City. The terms
of the Lease Agreement shall be approved by the City Attorney,
and the City Attorney shall provide the City Council with an opinion
letter that the lease is in satisfactory form. The Mayor and
Clerk are authorized and directed to enter into the Lease Agreement.
Councilman Quick seconded motion. All councilmembers voted in
favor of motion.
FIRE DEPARTMENT SANTA CLAUS EXPENDITURE - Councilwoman Hopkins informed
council and mayor that she had talked with Assistant Fire Chief
Eldon Muir as to the cost of the Fire Department's tradition of
having Santa Claus visit the children of Chubbuck. Mr. Muir has
reported that $275.00 would cover the expense for the candy sacks.
Councilman Nield made motion to appropriate $275.00 for the Santa
Claus traditional visit to Chubbuck children. Councilwoman Hopkins
seconded motion. All councilmembers voted in favor of motion.
CALL AMERICA - Public Works Director Steven Smart explained the long
distance telephone service proposal. This would result in an
approximate 35 to 40 percent savings on long distance calls made
by the city.
Councilman Quick moved to approve the payment of $150.00 deposit
to make application for Call America service. Councilman Nield
seconded motion. Vote was unanimous in favor of motion.
PRESENTATION - Fire Chief Bart Parrish made a presentation to the
City of Chubbuck of a painting entitled "The New American LaFrance
is Here" by Norman Rockwell, depicting a new fire truck being
parked in an older type garage building.
PUBLIC HEARING with regard to the proposed revision of the City of
Chubbuck Land Use Ordinance No. 205. Mayor Cotant read the public
hearing notice in it's entirety. ·
Mayor Cotant called the public hearing to order at 8:15 p.m.
The ordinance was reviewed page by page.
Land Use Commission recommended to change Section 1-5, Definitions;
(y) "Vehicle Repair site" and (aa) "Vehicle temporary storage
site; to read less than sixty (60) days instead of thirty (30)
days. Councilmembers voiced same opinion on change.
Jerry Tydeman, 156 Hiway Ave., discussed with council, the definitions
of (y) "Vehicke repair site" , (aa) "Vehicle temporary storage"
and (q) "Salvage site".
Definition (d) "Child care center" - Councilman Kinghorn noted
this definition needs clarified so that meaning is not construed
to mean groups of four children can be cared for within one twenty
four (24) hour day.

Section 3:3 (k) page 21; Production Building Sales Office, considered;
to be discussed later.
(n) Salvage sites - Council in agreement to delete (2) Shall not
contain more than one (1) acre.
(c) Parking and storage of Certain Velicles - Delete sentence -
However, one (1) boat, one (1) travel trailer, and one (1) detached
camper may be stored in the side or rear yard.
Phillip King, Mingo Lane, questioned wording in (i) page 23. Mr.
King stated he has a large family of boys and has more vehicles
than is allowed in (i) and therefor, his household is presumed
to be used as a motor vehicle retail sale or repair business.
Council and mayor and attorney discussed at length and agreed
to delete (i), page 23.
Mayor Cotant said the hearing would be continued to the next regular
scheduled council meeting.
CLAZMS: Computer print-out claims and additional handcheck claims
presented to mayor and council.
After thorough review, Councilman Quick moved to approve the computer
print-out claims plus the two handcheck claims. Councilman Nield
seconded motion. All councilmembers voted in favor of motion.
Councilman Nield moved, Quick seconded, with full council approval
to adjourn meeting at 11:00 p.m.
