April 13, 1982
Minutes of the the regular council meeting held in the city municipal
building April 13, 1982.
Meeting called to order at 7:10 p.m.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney B. Lynn
Winmill, Public Works Director Steven M. Smart, and City Clerk Vera
C. Armstrong.
Invocation given by Bishop Steven M. England, 39th Ward, Church of Jesus
Christ of Latter Day Saints, Chubbuck Stake.
Approximately fourteen scouts were present at meeting and Ryan Wilson led the congregation in the pledge of allegiance to the flag.
Mayor Cotant asked for corrections or additions to minutes of March 23 and April 6.
After reviewing, Councilman Kinghorn moved to approve minutes of
March 23 council meeting. Councilman Nield seconded motion, vote
was unanimous in favor of motion.
Councilman Quick moved to approve council meeting minutes of April
6. Councilman Kinghorn seconded motion. All councilmembers voted
in favor of motion.
AMENDMENT TO ORDINANCE #180, Fireworks Ordinance. Assistant Chief Eldon
Muir represented the fire department in making the request to amend
ordinance to require an ABC type fire extinguisher. Assistant Chief
Muir also requested the additional amendment requirement of having
a fifty five (55) gallon drum of water on hand to douse any small
fire that may be accidentally started.
Councilman Nield moved to direct Attorney Winmill to prepare an amendment
to Ordinance #180, Section 6, Sub-paragraph 4, to require that each
stand shall be provided with two (2) two and one-half (2½) pound
ABC Dry Chemical type fire extinguishers and easy accessible for
use in case of fire, also to add a separate paragraph that each stand
shall provide a fifty five (55) gallon barrel, which shall be kept
full of water, together with a bucket to extinguish fires, unless
such requirement be waived by the Fire Chief. Councilman Quick
seconded motion. All councilmembers voted in favor of motion.
LICENSE PERMIT APPLICATION - Afton M. Heath, Managerof Circle K Store,
has applied for a license to hold a white elephant sale as a fund
raising for muscular dystrophy at their parking lot, 5059 Yellowstone
and also requested fee be waived as the fund raising is non-profit.
After considerable discussion, Councilman Kinghorn moved to grant
license and to waive fee providing the store or management does not
charge for their lot and services and that the license permit would
be for a one-time function only. Councilwoman Hopkins seconded motion.
Roll call vote: Hopkins, yes; Kinghorn, yes; Quick, yes. Councilman
Nield abstained from voting.

OVERCROWDED RESTAURANTS AND BARS IN THE CITY - Mayor and council discussed
this with Assistant Fire Chief Eldon Muir, with suggestion that research
be done on what the Uniform Fire Code requirements are, figure out
the capacity, post the bars and reataurants to this effect and check
the establishments with head counts as a periodic follow-up.
Mayor Cotant asked that Councilwoman Hopkins, councilperson over
the fire department follow through on this and Councilman Kinghorn
check with the police on the parking at these locations.
Mayor and council discussed a procedural plan to follow. Attorney
Winmill said he felt the Uniform Fire Code should have enforcement
provisions.
Assistant Fire Chief Muir said he would make a report to council
on April 27th.
FINANCIAL Statement for month of March presented to mayor and council.
CLAIMS to be paid in April were reviewed by mayor and council.
Councilman Kinghorn moved to pay the computer print-out claims together
with the additional claims as listed on council agenda. Councilman
Nield seconded motion, all councilmembers voted in favor of motion.
LAND USE ORDINANCE DRAFT was studied by mayor and council. Attorney
Winmill reviewed several provisions and it was decided the hearing
on this ordinance would be held by the Land Use and Development Commission
on May 6.
Councilman Nield moved, Quick second~, with full council approval to
