Invocation given by B~shop Steven M. England, 39th Wards Chubbuck L.D.S. Stake Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Dwain A. Kinghorn, Thomas S. Nie]d, Attorney B. Lynn Winmill, Public Works Director Steven M. Smart, City Clerk Vera C. Armstrong. Councilman LeRoy S. Quick excused. Mayor Cotant asked for corrections or additions to minutes of January 26, 1982 and February 2. Councilman Kinghorn, Councilwoman Hopkins and Councilman Nield were of the understanding that a yearly review was requested, but was not in the council minutes. After discussion Councilman Kinghorn moved to amend minutes to require the conditional use permit granted to Peggy Stebbins to be reviewed yearly by the Land Use and Development Commission and also noted that the conditional use permit will not be transferable. Councilwoman Hopkins seconded motion. Vote was unanimous in favor of motion. Councilman Kinghorn moved to approve minutes of January 26 as amended. Councilman Nield seconded motion. All councilmembers voted in favor of motion. Councilman Kinghorn moved to approve minutes of February 2. Councilwoman Hopkins seconded motion. All councilmembers voted in favor of motion. RIGHT-OF-WAY EASEMENT to the proposed Denny's Inc. Restaurant. Fred Scheurman was present, The fifty foot easement into Pocatello Industrial Park has been granted to the State of Idaho. Fred Scheurman was present representing the present owners of the property proposed to be sold to Denny's Inc. to construct a Denny's Restaurant. The property that Denny's Inc. plans to build restaurant on will need to use this easement. City is concerned about requiring improvements to property that is owned by one party, easement held by another party, of which neither is the proposed Denny's 1nc. property. Council voiced opinion that it would be more logical for the fifty foot State of Idaho easement to be deeded to the city by the owners of the easement. Mr. Scheurman said he would be glad to make contact with owners of property that the State of Idaho fifty foot easement is upon and make this request for dedication to the city. 21 DESIGN REVIEW - Denny's Inc. - Roderick Parr of R. G. Parr & Associates, presented the design review of the proposed Denny's Restaurant, landscaping and for two new signs for the Denny's Restaurant area. Mr. Parr said the tower on the proposed sign for Interstate viewing was high because of the depressed area where Denny's is to be built. A lengthy discussion followed concerning easement and improvements to same. Mr. Parr was told by city that curb, gutter and sidewal~ would be required. Mr. Parr said there would be no problem with Denny's Inc. providing curb, gutter and sidewal~. They would even install on their own property if necessary. Councilwoman Hopkins moved to accept recommendations of Land Use and Development Commission with regard to the design review with the additional conditions that the acceptance would be subject to modification if necessary upon resolution of applicants to make improvements (including curb, gutter and sidewalk) within the easement for access now held by the State Highway Department, and also approval of the design reviews on the proposed new signs for Denny's Restaurant. Councilman Nield seconded motion, with all councilmembers voting in favor of motion. It was noted that the building permit would not be issued until the easement problem becomes resolved. BID OPENING - City has called for sealed bids for drilling, casing and test pumping a municipal well for the City of Chubbuck. Bids received were as follows: Jack Cushman Drilling, Inc., Blackfoot Drilling 0 - 150 ft. @95.50 150~- 350 ft. @90.00 Test Pump Setup @ $3500.00 Pumping Test Per Hour @ 120.00 Dan Pump & Service, American Falls Drilling O' - 150 ft. @104.60 150' - 350 ft. @ 97.87 Test Pump Setup @1500.00 Pumping Test Per Hour @ 110.00 High Plains Drilling, Rexburg Drilling O' - 150 ft. @$91.79 150' - 350 ft. @ 80.75 Test Pump Setup @3000.00 Pumping Test Per Hour @ 100.00 Bids were opened. The High Plains Drilling presented their bid bond to council tabl. e at 8:20 p.m. and it was not sealed in with the bid which was presented earlier in evening, prior to 8:00 p.m. Attorney Winmill reported their bid did not qualify because of the bid bond not being sealed in with the bid. 23 BID OPENING cont'd - After reviewing bids, Councilman Nield moved to reject the High Plains Drilling bid because the bid bond was not sealed in with the bid and that bids be taken under advisement subject to legal acquisition of designated property lot for the well. Councilwoman Hopkins seconded motion, all councilmembers voted in favor of motion. SANITATION SERVICE - Michael S. Page, Manager of North's Chuck Wagon Restaurant, has by letter to city, requested release of required sanitation services by the Chubbuck City. Mayor, council and engineer discussed rather the city could provide the service on weekends or not. Councilwoman Hopkins moved to deny request and direct city to inform North's Chuck Wagon Restaurant manager the city will provide refuse collection on Saturdays and Sundays. Councilman Nield seconded motion. Vote was unanimous in favor of motion. DESIGN REVIEW - Doug's Builder Sales, 4613 Yellowstone Avenue, Sign Design Review. Mr. Tanner plans to construct a temporary sign into a permanent sign to be placed within 15 foot setback area. Council discussed the strength of sign and design of sign. Councilman Nield voiced concern about type of post be used for sign, Councilwoman Hopkins voiced concern about design of the sign and asked that it be made as attractive as possible. Councilman Kinghorn moved to approve the design review of Doug's Builder Sales, 4613 Yellowstone, for placement of a permanent sign which falls within the fifteen setback area. Councilman Nield seconded motion, all councilmembers voted in favor of motion. CLAIMS TO BE PAID IN FEBRUARY presented to mayor and council. Councilman Nield moved to approve payment of claims as presented. Councilwoman Hopkins seconded motion. All councilmembers voted in favor of motion. FINANCIAL REPORT for month of January presented to mayor and council. GENERAL BUSINESS: Potential future city office space. ADDITIONAL CLAIMS - $22,000.00 to Clarence N and Sherrie E Welch for final lease-payment and purchase by City of Lot 14, Highway Acres Subdivision. $3,133.00 to Boyd Fullmer Insurance Company for fire insurance on City building and shop building, 5160 Yellowstone Avenue, Councilwoman Hopkins moved to approve the payment of $22,000.00 to Clarence N. and Sherrie E. Welch. Councilman Nield seconded motion, all councilmembers approved the motion. Councilman Kinghorn moved to approve claim of $3,133.00 to Boyd Fullmer Insurance Company. Councilwoman Hopkins seconded motion, vote was unanimous in favor of motion. Councilman Nield moved, Kinghorn seconded, with full council appr~al to ~djourn at 10:50 p.m. ~o~~ ~
