January 26, 1982
Minutes of the regular council meeting held in the city municipal building
January 26, 1982.
Present: Mayor JOhn O. Cotant, Jr., Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney B. Lynn
Winmill, Public Works Director Steven M. Smart and City Clerk Vera
C. Armstrong.
Invocation given by Reverend Robert D. Hyden, Church of God of Prophecy.
Meeting called to order at 7:06 p.m. by Mayor Cotant.
After reviewing, Councilwoman Hopkins moved to approve minutes of
January 12 as written. Councilman Nield seconded motion, vote was
unanimous in favor of motion

Councilman Nield seconded motion, vote was unanimous in favor of motion.
PUBLIC HEARING ITEM - Peggy Stebbins, 582 Chickadee, has requested a
conditional use permit to act as a Commission Mailer and a Beauty
Consultant from her home which is zoned General Residential (R-2)
zone.
Mr. and Mrs Stebbins were present and Mrs. Stebbins explained that
there would be no increase in parking, one delivery to home per week,
and that all sales were made by telephone or away from her residence.
Mayor Cotant noted city had received a letter from John Boyle stating
an objection to permit because of parking. ,
There were no other objections.
Councilman Nield moved to grant the conditional use permit for Peggy
Stebbins, with the provision that Mrs. Stebbin~ complies with the
Land Use ~ecommendations that if parking problems should arise, the
conditional use permit would need to be reviewed. Councilman Quick
seconded motion. All councilmembers voted in favor of motion.
DESIGN REVIEW - DENNY'S INC. - New Construction and New Sign Review -
R. G. Parr and Associates have applied for the design review. The
new Denny's Restaurant to be built on the southeast corner of ~-86
and Yellowstone Avenue.
Councilman Quick moved to table the Design Review of Denny's Inc.
until such time as additional information that has been requested
from city is received. Councilwoman Hopkins seconded motion. Vote
was unanimous in favor of motion.
TELLO BUS TRANSIT SYSTEM - Mayor and Council have requested citizen input
concerning the transit system for the handicapped in Chubbuck. One
Chubbuck resident wrote a letter favoring transit system for handicapped,
one resident wrote letter favoring transit system for the senior citizens,
and one telephone call received was in favor of transit transportation
for handicapped, one resident Was present at meeting and was in favor
of regular transit transportation, one other resident present voiced
objection to system for handicapped, giving poor service of the Tello
Bus System as the reason.
Consensus of council after lengthy discussion was that not enough
interest was shown to warrant the expenditure of funds to provide
the handicapped servi~e at this time. All councilmembers wanted to
review this again before budget time.

BUSINESS LICENSE APPROVAL - Monte Jones and Myrle Thorp, 4430 W. Burnside,
has applied for a business license to sell firewood from Mr. Jones
home at 4430 W. Burnside.
After some discussion, Councilman Nield moved to approve the application
for license of Monte Jones and Myrle Thorp to sell firewood. Councilman
Quick seconded motion. All councilmembers voted in favor of motion.
FIRING RANGE - Mayor Cotant informed council that the firing range near
the National Guard Armory is fenced but the request has been made
by Bannock County that an 8 ft. chain link fence with three barbs
on top be constructed completely around the range. The city would
need to participate in the total cost of fence, which is estimated
to be about $4500.00.
It was suggested by Reverend Hyden that they allow the National Rifle
Association or public to use the firing range as a means of additional
revenue.
ADDITIONAL CLAIMS - Councilwoman Hopkins moved to approve the following
claims; 1) $40.00 to Kraft Food as a bid offer on a file case,
2) $175.00 to Post Academy for tuition for Chief Stone and Assistant
Chief Rowland to attend two schools in Boise the week of February 8.
and that Chief Stone and Assistant Chief Rowland make a report on
the school upon their return. Councilman Quick seconded motion. All
councilmembers voted in favor of motion.
GENERAL BUSINESS:
1) Chubbuck Days - Dates set are June 25 and June 26th.
2) Water damage and law suit concerning water damage of merchandise
stored at Parrish Company warehouse at 5164 Yellowstone.
3) Bids - Councilman Nield asked if the city could have the council
approve bid specifications prior to the specifications being put out
for bid. Discussion followed with an agreement that council would
review and approve specificiations on bid items prior to putting
bids out.
Councilman Nield moved, Quick seconded, with full council approval that
meeting adjourn at 10:10 p.m.
