Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 6:10 p.m. by Mayor Cotant. PURPOSE OF SPECIAL MEETING shall be the following: 1) Review of a proposed moratorium on any approval of duplexes, 3 plexes, 4 plexes and apartment complexes in the City of Chubbuck. 2) To consider an ordinance finding the need for capital contributions by persons developing property within the city limits. ORDINANCE - CAPITAL IMPROVEMENT - An ordinance finding the need for capital contributions by persons developing property within the city limits; stating a short title and the purpose of the ordinance; setting forth the scope of the ordinance; imposing development impact fees on new development within city limits; establishing tables for calculation of said development impact fees. Engineer Smart gave a report on the proposed capital improvement ordinance. After considerable discussion it was decided the council would study the proposed capital improvement ordinance and the proposed capital improvement ordinance would be on the November 26, 1985 Council Meeting Agenda. PUBLIC HEARING - ORDINANCE #274 - An ordinance finding that an imminent peril to to the public health, safety or welfare requires adoption of a moratorium upon the issuance of selected classes of permits; establishing such a moratorium on the issuance of building permits or conditional use permits involving duplexes, three-plexes, four-plexes, and apartment buildings. Mayor Cotant read Ordinance #274 in full. Mayor Cotant declared the public hearing open. Mayor Cotant asked if there was any opposition to Ordinance #274. R. Jay Henderson, Moonglow Lane, Rte 2, North, was present~amd~.asked why the moratorium was imposed and exactly what the moratorium would do. Councilman Nield stated the Land Use Development Commission has proposed to the City Council an adoption of amendment to Ordinance #241 which would limit multiple household dwellings to a predetermined percentage of total residential stuctures within a selected Land Use District. Councilman Nield stated this ordinance would be before the City Council at a.~egular scheduled meeting on November 26, 1985. Attorney Winmill stated the moratorium is imposed upon the issuance of any building permits or conditional permits for any multiple household dwellings for the period of one hundred twenty (120) days. 163 PUBLIC HEARING - ORDINANCE #274 - (Cont.) Mayor Cotant declared the public hearing closed. Councilman Quick moved to dispense with the rule of reading Ordinance #274 on three separate occasions. Councilman Nield seconded. Roll Call Vote: Hopkins, yes; Quick, yes; Nield, yes; England, yes. Councilwoman Hopkins moved to adopt Ordinance #274 as read. Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; Nield, yes; England, yes. At 7:10 p.m., Councilman Nield moved, Councilman England seconded, with full council approval to adjourn the meeting. Ron C. Cot~ant, Jr., Ma~or CALL OF SPECIAL MEETING CITY OF CHUBBUCK Pursuant to Idaho Code Section 50-706, the undersigned Mayor of the City of Chubbuck, Idaho, hereby calls a special meeting of the City Council to be held at the Chubbuck City Municipal Building, 5160 Yellowstone Ave., at the hour of 6:00 p.m., on the 19th of November, 1985. The object of the special meeting shall be the following: 1) Review of a proposed moratorium on any approval of duplexes, 3 plexes, 4 plexes and apartment complexes in the City of Chubbuck. 2) To consider an ordinance finding the need for capital contributions by persons developing property within the city/l~mits.
