HomeMy WebLinkAbout11 12 1985 CM155 COUNCIL MEETING MINUTES November 12, 1985 Minutes of regular council meeting held in the city municipal building, November 12, 1985. Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Councilmember Becky A. Hopkins was excused. Meeting was called to order at 7:50 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of October 22 and the Special Meeting Minutes of November 7, 1985. Councilman Quick moved to approve the minutes of October 22, 1985 as read. Councilman Nield seconded. All councilmembers present voted in favor of the motion. Councilman Quick moved to approve the minutes of November 7, 1985 as read. Councilman England seconded. All councilmembers present voted in favor of the motion. PUBLIC HEARING - A proposal by Hal Overdorf for a change of zoning from General Residential (R-2) to Industrial (I) on property located at 4534 Burley Drive. Mayor Cotant declared the public hearing open. Mayor Cotant asked for comments from those in favor of the proposal. Hal Overdorf was present and explained to Mayor Cotant and Council his plans. Mr. Overdorf stated he planned on opening a cabinet shop at 4534 Burley Drive. Mr. Overdorf said he would like to start construction on a metal building in the spring. Mr. Overdorf presented building plans to the council and said he will be working with the City Building Inspector. Mr. Overdorf said he would like to change the zone on 250' of the 500' property. Engineer Smart read a letter from the property owner, Mrs. Dean G. Overdorf stating; I Dean G. Overdorf join with my son Hal L. Overdorf in the zoning change necessary for the cabinet work he plans to do on this property. Mayor Cotant asked for comments opposed to the zoning change. There was none. Mayor Cotant declared the public hearing closed. Councilman England moved to approve the change of zoning from General Residential (R-2) to Industrial (I) on property located at 4534 Burley Drive. Councilman Nield seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, absent. PROCLAMATION - CELEBRATE READING WEEK - Mayor Cotant read the Proclamation in full. Councilman Nield moved to direct Mayor Cotant to proclaim the week of November 11 through November 16, 1985 as Celebrate Reading Week. Councilman Quick seconded. All councilmembers present voted in favor of the motion. 157 ORDINANCE #273 - An ordinance expressing an intent to sell, convey or exchange certain described real property owned by the city; directing that said parcels first be appraised; authorizing sale for cash or terms said parcels by public auction to the highest bidders for amounts equaling or exceeding the appraisals; reserving to the city the right to reject any or all bids on any parcel. Mayor Cotant read Ordinance #273 in full. Councilman Nield moved to dispense with the rule of reading Ordinance #273 on three seperate occasions. Councilman England seconded. Roll Call Vote: Quick, yes; Nield, yes~ England, yes; Hopkins, absent. Councilman Nield moved to adopt Ordinance #273 as read. Councilman England seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, absent. CITY STREET FINANCE REPORT - City Clerk Ron C. Conlin has prepared the city street finance report. Idaho Code requires approval of street finance report by Council and certification by Mayor Cotant. Councilman Nield moved to approve the street finance report and authorize certification of the same by Mayor Cotant. Councilman Quick seconded. All councilmembers present voted in favor of motion. FUND TRANSFER - City Clerk Ron Co Conlin explained to Mayor Cotant and Council that the following transfers are needed to balance the year end budget expend- itures with the budget. Councilman Nield moved to transfer the following: GENERAL FUND: To: 10-4199-999 = $ 41,076.00 10-4319-999 = 1,830.38 10-4320-999 = 1,546.68 Total General Govenrment Total Highway, Streets and Roads Total Engineering FROM: 10-4904-900 = $ 41,076.00 GA Fund Balance 10-4904-900 = 1,830.38 " " 10-4904-900 : 1,546.68 " " Councilman England seconded. All councilmembers present voted in favor of motion. FINANCIAL STATEMENT for month of October presented to Mayor Cotant and Council. CLAIMS - Computer print-out and handcheck cl, aims have been presented to Mayor Cotant and Council. After review Councilman Quick moved to approve the computer print-out and handcheck claims as read. Councilman England seconded. All councilmembers present voted in favor of motion. GENERAL DISCUSSION - 1) Mayor Cotant stated on November 13, 1985 at 2:30 p.m., Governor Evans will be at the Pine Ridge Mall to give a commendation to David Bleak, a Medal of Honor recipient of the Korean War. 159 GENERAL DISCUSSION - (Cont.) 2) Cowboy Hitching Post-Chubbuck Pro Wash has invited Mayor Cotant and Council to a open house on November 15, 1985 at 3:15 p.m. 3) Bicycle City is having a Grand Opening November 15, 1985. ORDINANCE - Amending Ordinance #241 by establishing additional residential land use districts and modifying the schedules of general controls to account for such new land use districts. After discussion it was decided to put the ordinance on the November 26, 1985 Council Meeting Agenda. ORDINANCE - CAPITAL IMPROVEMENT - An ordinance finding the need for capital contributions by persons developing property within the city limits. After discussion it was decided Mayor Cotant and Council would study the Capital Improvement Ordinance and call a Special Meeting on the 19th of November, 1985, at 6:30 p.m. to adopt the ordinance. MORATORIUM - It was stated the moratorium on building duplexes, 3-plexes, 4-plexes and apartment complexes that was put in place throughout the City on April 1985 expired on October 9, 1985. After discussion it was decided to give notice of a public hearing for review of=a proposed moratorium on any approval of duplexes, 3-plexes, 4-plexes and apartment complexes in the City of Chubbuck at a special meeting on November 19, 1985 at 6:00 p.m. At 9:08 p.m., Councilman England moved, Councilman Quick seconded, with full council approval to adjourn meeting.
