HomeMy WebLinkAbout09 24 1985 CM 131 COUNCIL MEETING MINUTES September 24, 1985 Minutes of reqular council meeting held in the city municipal building, September 24, 1985. Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Councilwoman Becky A. Hopkins was excused. Meeting was called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of September 10, 1985. Councilman England moved to approve the minutes of September 10, 1985 as read. Councilman Nield seconded. All councilmembers present at the meeting voted in favor of motion. HEARING - Jackie B. Galloway, 190 Henry, has requested a hearing, Mrs. Galloway was present and has requested that her dog not be destroyed. Mrs. Galloway said that on September 13, 1985 her dog was picked up by the Police Department and taken to the pound because it was declared a dangerous animal. Mrs. Galloway said the dog is very protective and it will nip at children 6n their property. The dog is a pit-bull. Mrs. Galloway asked the Council if she could get the dog released from the pound and she would try to find it a home out of the City of Chubbuck. Chief Arnold Stone,stated there have been several complaints from the neighbors in the area sayin~ the doq is scarinq kids that get off the bus. Chief Stone said Frida~ the Police Department had recieved a report that a boy had been bit by the doq. Chief Stone said he felt the do~ was dangerous to have in the neiqborhood a~th6 dog should be taken to the pound, to be destroyed. Councilman Nield stated the £itv has had several complaints about different pit-bulls in the past. Councilman Nield moved to uphold Chief Stone's decision to have the doQ destroyed. Councilman England seconded. All councilmembers present voted in favor of motion. SWIMMING POOL PROPOSAL - Architect Pete Anderson was present to present further ideas in regards to the feasibility study for a Muni£ipal Swim, ina Pool.' Mr. Anderson gave further report on the feasibility study. Mr. Anderson stated the wave pool would require a higher gate price. Councilman Nield stated charging $4.50 per person would eliminate a lot of the residents usin~ the pool because of the high cost. Mr. Anderson presented area swimming pool admission fee schedules to Mayor Cotant and Council. Considerable discussion about how the bond would be paid. 133 SWIMMING POOL PROPOSAL - (Cont.) Mr. Anderson reviewed with Mayor Cotant and Council the options of sizes of the pool. After discussion Mayor Cotant suggested the Council appoint a committee of 10 to 12 residents throuqhout the City to study the swimming pool proposal. Mayor Cotant stated these people should be a good cross-section of the City. Mayor Cotant asked Kevin Richards, Idaho State Journal to put an article in the paper askinq residents of the City of Chubbuck to contact Chubbuck City Offices if they are interested in being on the committee. It was decided a committee should be appointed within the next two weeks. SEWER LINE - HOMESTEAD ROAD - Attorney Winmill stated John & Wenay Pnwell w~!l probably file suit against the City to require the City to extend the City sewer line on Homestead Road. After considerable discussion it was decided Attorney Winmill would research the matter and report to the Council at a later date. ORDINANCE - An ordinance providing for the regulation and licensing of auto wreckers; making a violation of this ordinance a misdemeanor; prohibiting the solicition of wrecker business at the scene of an accident; requiring licensure of all person or entities operating an emergency wrecker service; establishing procedures and fees for emergency wrecker licenses; establishing minimum requirements for licensed emergency wrecker operators; establishing standards and procedures for non-renewal, suspension and revocation of licenses. Attorney Winmill gave a report on how the ordinance is progressing. After discussion it was decided the ordinance would be presented at the October 8, 1985 Council Meeting. POCATELLO/CHUBBUCK CABLE COMMISSION MEMBERS - Mary Harker and Eldon Quinn was present to give a report on a Cable Commission Meeting held on September 24, 1985. Mary Harker stated the Pocatello League of Women Voters are sponsoring a debate session for the Chubbuck Mayor and Council canidates live on Channel 12. Mrs. Harker stated the canidates should contact Mrs. Harker as soon as possible. Mayor Cotant presented Mrs. Harker and Mr. Quinn Certificates of Appointment and thanked them for accepting the appointments. PROCLAMATION - CONSTITUTION WEEK - Mayor Cotant read the proclamation in full. Councilman Quick moved to direct Mayor Cotant to proclaim the week of September 17th through 23rd, 1985 as Constitution Week. Councilman Nield seconded. All councilmembers present voted in favor of the motion. ORDINANCE - An ordinance of the City of Chubbuck, Idaho, amending Ordinance #264 to provide a correct legal description of lands to be de-annexed pursuant to said ordinance. Ordinance will be read at the October 8, 1985 Council Meeting. 135 ORDINANCE - Amending Ordinance #251. Ordinance amending Ordinance #251 will be read at October 8, 1985 Council Meeting. ORDINANCE - An ordinance of the City of Chubbuck, Idaho providing for the licensing of security officers and private investigators; establishing standards for the issuance of licenses; limiting the authority of licensed security officers and private investigators; establishing procedures for the revocation of licenses granted pursuant to this ordinance. Ordinance will be read at the October 8, 1985, Council Meeting. CLAIMS - Handcheck claims presented to Mayor Cotant and Council. After discussion Councilman Nield moved to approve handcheck claims as read. Councilman England seconded. All councilmembers present voted in favor of the motion. FINANCIAL REPORT for month of August presented to Mayor Cotant and Council. At 9:55 p.m., Mayor Cotant requested the council go to an executive session meeting for the purpose of evaluation of employees, as authorized by Section 67-2345 (b). Councilman Nield made motion to move to an executive session meeting, for the purpose of evaluation of employees, as authorized by Section 67-2345 (b). Councilman Quick seconded. Roll Call Vote: Quick, yes; Nield, yes; England, yes; Hopkins, absent. 100% of councilmembers present voted in favor of the motion. No action or final decision was made in regards to evaluation of employees. Ron C. Conlin, City Clerk 190 Henry ~venue Chubhuek~ Z~ 83202 September 13, 1985 Chnbbuck City Council Attention: Ron Conlin Chubbuck,City Offices Chubbuck, ID 83202 Dear Mr. Mayor an~ City Councilmen: This letter is written to waiver a hearing before the city council and ~equest your permission to release my dog from the city pound. On September 12, 198S, the dog was picked up by the police chief because he was declared a dangerous animal as he had received complaints from my meighbors. He stated that the dog had nipped at a neighbor boy. This dog has been tied up at all times and has become very protective over our domicile. O= the ~n~tance he ha~nipped at the neiRhbor boy, the same boy comes over to play with my sons and likes tO pick on my smallest son. My children were home at the time the dog was given a tranquilizer and taken to the pound, when I arrived home from school (I am an ISU student) they informed me what took place and that I was to call the police and that e~en then the dog may not be released. As the dog is disturbing to others, I feel he is very beneficial to our family. We have had~ings stolen from our cars and in our yard, but since the dogs have been tied in our backyard the thieves have stayed away. I proposed to move the dog out of the community. M~husband is currently employed out of town and he can take him, and find him a suitable home. The dog has only been protecting his home inhis disturbing instances.
