HomeMy WebLinkAbout07 09 1985 CM93 COUNCIL MEETING MINUTES July 9, 1985 Minutes of regular council meeting held in the city municipal building, July 9, 1985. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and addition to the minutes of June 25, 1985. Councilwoman Hopkins moved to approve the minutes of the regular council meeting of June 25, 1985 as written. Councilman Quick seconded. All councilmembers present at the June 25th, 1985 council meeting voted in favor of the motion. PARK IN HEIGHTS SUBDIVISION - Mary Harker, 783 Boyd Street was present and expressed her views about the park in Heights Subdivision. Mrs. Harker stated that she had talked to many residents in the area and the general feeling is, they would like to see the park improved. Mrs. Harker offered the following suggestions: 1) More trees. 2) Would like the park named. 3) Suggested naming the park after a lady. 4) Upgrading picnic facilities. 5) Restroom facilities. 6) Ballfield for younger kids. Mrs. Harker stated she felt the park was not kept up a well as some of the other parks. Mayor Cotant stated the City is planning to install a sprinkling system and grass more of the park this fall. Discussion about what playground equipment would be suitable in the park. Mrs. Harker stated small children equipment would be most suitable. Mrs. Harker said she would provide the City with names of residents in the subdivision that would help with labor in the park. TRAFFIC HAZZARD ON WEST CHUBBUCK ROAD - Mr. Wilbur Chitwood, 639 W. Chubbuck Road, presented to Mayor Cotant and Council a petition stating the residents on West Chubbuck Road are concerned about the number of accidents and near misses which have occurred in the area. Mr. Chitwood stated the residents of the area feel the accidents and near misses might be prevented with better traffic control or new restrictive speed limits. Mr, Chitwood suggested three ways to make Chubbuck Road safer: 1) Speed limit during non-school hours be reduced to'25 ~ph:~2) A~no-~assing~zone~Be.-established from the intersection of Chubbuck Road and the west edge Of the city limits. 3) Truck limitations should be re-established as to maximum speed and weight. After discussion it was decided to make all of Chubbuck Road a no passin~ zone and to lower the speed limit to slow traffic. SEWER HOOK-UPS ON WEST CHUBBUCK ROAD OUTSIDE CITY LIMITS - Mayor Cotant stated that we should get everyone on the sewer system we can. Discussion about starting a Capital Improvement Fund for a future collector trunk. 95 SEWER HOOK-UPS ON WEST CHUBBUCK ROAD OUTSIDE CITY LIMITS - (Cont.) Engineer Smart stated he has had several requests along West Chubbuck Road to hook-up to the sewer system. Mayor Cotant suggested having a hook-up fee instead of a per acre fee. Discussion about the City entering into a contract with each individual home owner. After discussion it was decided that Engineer Smart and Attorney Winmill would prepare a contract agreement and report at the July 23 Council Meeting. RESOLUTION #3-85 - A resolution adopting the 1985 edition of the Uniform Building Code. Mayor Cotant read the resolution in full. Councilman Quick moved to adopt Resolution #3-85 as read. Councilman England seconded. All councilmembers voted in favor of the motion. RESOLUTION #4-85 - A resolution adopting the 1985 edition of the Uniform Fire Code. Mayor Cotant read the resolution in full. Councilman Quick moved to adopt Resolution #4-85 as read. Councilman Nield seconded. All councilmembers voted in favor of the motion. SIGN CODE - Cary stated that the Council adopted the Sign Code in 1979, but there has not been a resolution to update the code. After discussion it was decided that Attorney Winmill would prepare a resolution to adopt the up to date Sign Code. MECHANICAL CODE - Building Inspector Cary Campbell stated he would like to have some quidance from the Council in regards to the Mechanical Code. After discussion the Council directed Attorney Winmill to draft an ordinance to adopt the Mechanical Code and present at the July 23, 1985 Council Meeting. ISSUANCE OF BUILDING PERHITS - Attorney Winmill sent Building Inspector Campbell a letter to request that he not issue building permits on behalf of the City of Chubbuck, where the plans and specifications have been submitted to him in apparent violation of Idaho Code § 54-310. Attorney Winmill gave a report on the letter he had sent to Building Inspector Campbell in regards to the issuance of building permits for commercial structures without plans prepared by a licensed architect. After discussion Councilman Nield moved to direct Building Inspector Campbell to not issue building permits that is in apparent violation of the Architector's Law until the City of Chubbuck recieves an opinion from the Attorney General's Office as to whether or not the City is empowered or not to issue licenses under those circumstances. Councilman Quick seconded. All councilmembers voted in favor of the motion. 97 GENERAL DISCUSSION - 1) Police Department Discussion about the Police Department issuing press releases warning motorists that certain areas in the City are problem areas and they are being watched closer at certain times. 2) Chubbuck Days discussion. 3) Engineer Smart stated the waterline has been install on Homestead Road. CLAIMS - Computer Print-out and Handcheck claims have been presented to Mayor Cotant and Council. After discussion Councilwoman Hopkins moved to approve the computer print-out and handcheck claims, with the approval of Little League umpiring checks subject to Councilman England approval when the checks are presented. Councilman Quick seconded. All councilmembers voted in favor of the motion. At 10:20 p,m., Councilman Quick moved, Councilwoman Hopkins seconded, with full council approval to adjourn the meeting.
