Cotant, Jr., Councilmembers Becky A. Hopkins, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C, Conlin? Councilman Leroy S. Quick was excused. Meeting called to order at 7:30 p,m? by Mayor Cotant, APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of May 14, 1985. After discussion Councilman Nield moved to approve the minutes of May 14, 1985 with the following change and addition: Page 63, Paragraph 4, Sentenae I (Should be "public record"instead of"park re~ord~, Page 63, Paragraph 4~ Sentence 3 (Added "Mr, Parrish stated he understood the city does not feel the land west of Bistline Park would revert to Land Investments, Inc., if contestedV Councilman England seconded, Roll Call Vote: Nield, yes; England, yes; Hopkins, Absent on May 14, 1985,; Quick, Absent, CHUBBUCK BAPTIST CHURCH - Tom Hicks, Pastor of Chubbuck Baptist Church was present. Pastor Hicks stated the~Chubbuck Baptist Church currently has 140' frontage on Lucky Street and 1401 frontage on Adams Street which is adequete for 30 parking spaces. Pastor Hicks said they are planning an addition on the back of their building, but he does not feel they would ever need the parking spaces required by ordinance. Pastor Hicks stated that the buildinqwiththe addition, would have an occupancy of 400, which would require 85 parking spaces and Pastor Hicks did not feel the Chubbuck Baptist Church would ever have ahywhere near 400 people, therefore the Chubbuck Baptist Church would never need 85 parking spaces. Pastor Hicks asked the Council to waive the requirement of the 85 parking spaces and require the 30 parking spaces they have at this time. Pastor Hicks also asked the Council to let the Chubbuck Baptist Church postpone the paving of the parking spaces that is currently there. Councilman Nield moved to: 1) Adjust the off street parkinq requirements to 3n instead of the 85 required by ordinance to the Chubbuck Baptist Church. 2) Waive the requirement for the pavinq of the parkinq spaces at this'time. The street parking requirements and the paving of the parking area for the Chubbuck Baptist Churchwillbereviewed in a year. If it is determined at the annual review a change has to be made in the required parkinq spaces and that the parkinq spaces will need to be paved, the waiver would lapse. The Chubbuck Baptist Church is not acquiring any riqht except for a year to .year exemption, if the exemption no longer applies the Chubbuck Baptist Church will have to come to immediate compliance or the City would have the right to pursue legal action, Councilman England seconded. WINE LICENSE APPLICATION - Triangle Service, Hardy Enterprises has applied for a Wine License to sell wine at 403~ Yellowstone Ave. After discussion Councilman England moved to approve a wine license to Triangle Service to sell wine at 4030 Yellowstone Ave. Councilwoman Hopkins seconded, All Councilmembers present voted in favor of motion. 69 KASISKA PRELIMINARY PLAT - 6 MONTH EXTENT~ON - Engineer Smart stated the Final Plat has not come to the City as of yet. Engineer Smart said that Scott Rhead had contacted him and asked for an answer in regards to a 6 month extention on the Kasiska Preliminary Plat. After discussion the Council decided not to extend the Kasi~ka Preliminary Plat approval for a 6 month period. ORDINANCE #264 - HERITAGE WEST DE-ANNEXATiON ORDINANCE - An ordinance of the City of Chubbuck, excluding from the boundaries of the city a portion of the territory heretofore annexed into the citypurmant to Ordinance #2!2~ providinq that deannexation shall not leave any territory excluded from the limits of the city from its liability on account of any outstanding bonded or other indebtedness of the city; providing the territory so excluded from the limits of the city shall be and remain under jurisdiction of the city for the purpose of collecting any such indebtedness; providing that this ordinance shall be filed in compliance with the provisions of Idaho Code Section #63-2215. , Attorney Winmill read Ordinance #264 by title only. Councilman England moved to waive reading Ordinance #264 on three separate occasions and waive the requirement to read Ordinance #264 in full, Councilwoman Hopkins seconded. Roll Call Vote: Hopkins, yes; Nield, yes; England, yes; Quick, Absent, Councilwoman Hopkins moved to adopt Ordinance #264. Councilman Nield seconded. ORDINANCE #265 - An ordinance of the City of Chubbuck, amending Chubbuck City Ordinance #233 by modifying section 9.20.021 of the Chubbuck Municipal Code relating to the control of dogs; providing for a new schedule of annual license fee for dogs; providing for the term of said annual license. Mayor Cotant read Ordinance #265 in full. Councilman Nield moved to dispense with the rule requiring Ordinance #265 read on 3 separate occasions. Councilwoman Hopkins seconded. Roll Call Vote; Hopkins? yes; Nield, yes; England, yes; Quick, Absent. Councilman Nield moved to adopt Ordinance #265 as read. Councilman England seconded. ORDINANCE #266 - An ordinance of the City of Chubbuck, providin~ for a chan~e in the Land Use District with respect to certain lands more particularly described as Lots 1, 2, 3, 4 and 5 Block I of the Leslie Homes Subdivision within the boundaries of the City of Chubbuck, from General Residential (R-2) to ~eneral Commercial (C-2); declaring that the City Council find such re-zoning consistent with the Land Use Pattern prescribed in the City's Comprehensive Plan. Mayor Cotant read Ordinance #266 by title. ORDINANCE #267 - An ordinance of the City of Chubbuck, providing for a change in the Land Use District with respect to certain lands more particularly described as the easterly 255.0 feet of Lot 2, Bonnie Brae Acres Subdivision, within the boundaries of the City of Chubbuck, from Industrial (I) to General Com- mercial (C-2); declaring that the City Council find such re-zoning consistent with the Land Use Pattern prescribed in the city's comprehensive plan. Mayor Cotant read Ordinance #267 by title. Councilwoman Hopkins moved to dispense with the rule of reading Ordinance #267 on three separate occasions and to dispense with the rule of readin~ Ordinance #267 in full. ORDINANCE #268 - An ordinance of the City of Chubbuck, providi'ng for a change in the Land Use District with respect to certain lands more particularly described as the westerly 239.04 feet of the northerly 333.40 feet of Lot 1, and the easterly 10.0 feet of Lot 2, Bonnie Brae Acres Subdivision, within the boundaries of the city of Chubbuck, from ~ndustrial (I) to General Commercial (C-2); declaring that the City Council find such re-zoning consistent with the Land Use Pattern prescribed in the City's Comprehensive Plan. Councilman England moved to dispense with the rule of reading Ordinance #268 on three separate occasions and dispense with the rule of reading Ordinance #268 in full. Councilman Nield seconded. ORDINANCE #269 - An ordinance of the City of Chubbuck, providing for a change in the Land Use District with respect to certain lands more particularly described as the westerly 545.0 feet of Lot 18, Block 1 of the Paradise Acres Subdivision, within the boundaries of the City of Chubbuck, from Aqricultural (A) to ~eneral Residential (R-2); declaring that the City Council find such re-zoninq consistent with the Land Use Pattern prescribed in the City's Comprehensive Plan. Mayor Cotant read Ordinance #269 by title only. Roll Call Vote; Hopkins, yes; Nield, yes; England, yes; Quick, Absent. 73 ORDINANCE #270 - An ordinance of the City of Chubbuck, providing for a change in the Land Use District with respect to certain lands located in Section 11~ Township 6 South, Range 34 E.B.M.~ within the boundaries of the City of Chubbuck, from Agricultural (A) to Limited Residential (R-l) and General Residential (R-2); declaring that the City Council find such re-zoning consistent with the Land Use Pattern prescribed in the City's Comprehensive Plan. Mayor Cotant read Ordinance #270 in full. Councilman Nield moved to dispense with the rule of reading Ordinance #270 on three separate occasions. Councilman England seconded. BUSINESS LICENSE APPLICATION - Chubbuck Lions Club presented an application to Mayor Cotant and Council asking to operate a Circus at 4708 Yellowstone Ave. After discussion Councilman England moved to approve the business license to the Chubbuck Lions Club to operate a Circus at 4708 Yellowstone on July 8, 1985. Councilwoman Hopkins seconded. All councilmembers present voted in favor of the motion. ORDINANCE - An ordinance of the City of Chubbuck, providing for the licensing of security officers and private investigators; Establishing standards for the issuance of licenses. Mayor Cotant read the ordinance ~y title for the second reading. MORITORIUM - Attorney Winmill stated he is in the process of preparing an ordinance for the Land Use Development's review on the June 6, 1985 Land Use Development Commission Meeting. HANDCHECK CLAIMS - Handcheck claims have been presented to Mayor Cotant and Council. After discussion Councilman Nield moved to approve handcheck claims as presented. Councilman England seconded. All Councilmembers present voted in favor of the motion. GENERAL DISCUSSION 1) Waiver of Sanitation Charge to LittleTree Inn - Enqineer Smart gave a report on the costs the LittleTree Inn is paying for dumpster pick-up and what they would save by going to a compactor. Engineer Smart stated that Pocatello would be willing to contract with the City of Chubbuck on the compactor pick-up to provide the service to the businesses.
