HomeMy WebLinkAbout004-6-04s LAND USE AND DEVELOPMENT COMMISSION April 6, 2004 Minutes of the regular session of the Land Use and Development Commission held at Chubbuck City Offices, 5160 Yellowstone April 6, 2004. Present: Chairman Pete Anderson; Commission Members: DeLoy Stuart, Mary Harker, Jason Mendenhall, Michelle Christy, Michelle Miller, Gayle Anderson, Lee Merrill; City Staff. Steve Smart, Sean Harris, Larry Kohntopp, Attorney: Tom Holmes; and Secretary Myrna Crapo Chairman Anderson called the meeting to order at 7:00 p.m. Chairman Anderson asked if any member of the Commission had a conflict of interest. There was none. Chairman Anderson asked for approval of the minutes of March 2, 2004. Jason Mendenhall moved to approve the minutes as mailed, Gayle Anderson seconded; all voted in favor. PUBLIC HEARING: 1. An application by Keith Rasmussen - Rasmussen properties, 1396 Satterfield Drive, n Pocatello, Id, 83201, for a Planned Unit Development, (PUD), together with its Preliminary Development Plan. Property is located at Briscoe Road adjacent to 159 Belva Lane and 219 Briscoe. Property is presently zoned Limited Residential (R -2). Andrew Hubbard, 5959 Joel, represented Keith Rasmussen. He is proposing to build three duplex's off of Briscoe and Belva Lane. They will extend Belva Lane and connect it to Briscoe. It will be ADA housing with 5 year contracts. They have tried to work through the concerns of the neighbors. Traffic is an issue with them. It is in agreement with the comprehensive plan. It will beautify the property around it and will improve the neighborhood. A privacy fence will be put in place. The road will be 25' wide. When they visited Jackie Wallace she had concerns for her trailer, her trailer is set close to the road. She thought the road was on her property. They also visited Mr. Whited and he requested a privacy fence for safety reasons to keep children off of his equipment. Mrs. Whited was concerned with the traffic along that one side in front of lots 1, 2 and 3. and wanted a privacy fence. Commission discussed: 1. There will be three townhouses. 2. Fences that would be built 3. Units will be single story units. 4. How this project is being interpreted as a P.U.D. ="\ Land and Development Commission April 6, 2004 Page 2 The meeting was opened for public comments: Jackie Wallace, 159 Belva Lane, the trailer hitch of her trailer is in that 25' road. The traffic is already congested and there is no parking for company except on the street. Younger families have children and bought their home because they wanted a quite neighborhood with little traffic. Ardith Whited, 207 Briscoe Road is concerned with the driveway that is on the west side of her property being 18' wide. People living there now have to back out of the driveway and can't get in and out of there without using her driveway. Children have no place to play with this development. They want a privacy fence to keep children off of her property. Don Curtiss, 224 Briscoe, how are they going to get a garbage truck in there. At different times there will be three vehicles parked at the south end of the drive and a couple of vehicle off the south end of the duplex. They have been parking out in the road lately. Emergency vehicles wouldn't have much room in there. The play area is not there. They will have to play in the road. Ray Coles, 227 Briscoe, all building that have been put in have had to have full width drive ways not partial. This road should be as wide as Briscoe Road. He agrees what has been said about the children safety. Lisa Smith, 210 Briscoe, there is no place for people to put there vehicles. When she back out of her driveway she about gets hit because people backing out can't see her. Paul Sorensen, 147 Belva, There is a narrow spot where Belva's road is 16' wide and there is a blind spot on the road. He has been in close calls right there. The area is a place where neighbors can plant their roots and they don't want to see it changed. Duplex's are a problem. The security of the kids is a concern. Adding duplex's will create way to much traffic. If it gets approved they want a condition that Rasmussen provide speed humps on Belva before the construction is built and let the residents decide where they would be put them. Mr. Rasmussen needs to built single dwelling homes. Kevin Smith, 210 Briscoe, how are people going to pass each other. They need to take a look at the street itself. The public hearing was closed. Andrew Hubbard 5959 Ruth, Jackie Wallace addressed parking as she parks on the street on the end of Belva Lane. She could park on the side of her house. The road in front of property 1, 2, and 3 is a concern. If Rasmussen needs to take the asphalt 2' wider Rasmussen would be willing to do that. The housing that will be built will be nice houses. The townhouses will be nice places, with landscaping, trees, grass, etc. Land Use and Development Commission April 6, 2004 Page 3 Chairman Anderson noted for the record that the city received a petition signed by 17 residents on Belva in opposition. Commission discussion: 1. The duplex's being for ADA contracts and the problem on the size of the streets. People with disabilities would require a lot of traffic brought in this little section; with people who are there to offer assistance coming to the home and needing to park their cars. 2. The size of the duplex's running east and west with parking to the north. They are set back fairly deep on the property with 4 parking spaces in front of each unit. 3. If ADA compliant the provision being set aside for those kind of vehicles that are required for handicapped needing extra room to get in and out of there vehicles. 4. The street was originally put in as a driveway. 5. The staff would require a 25' roadway if this is approved. 6. Lane for units 1 and 2 was built for a driveway. Mary Harker moved that we table this request and that we asked for Mr. Hubbard to get detail for this particular aspect that we are concerned about including scale of the building that will be put in and the questions answered concerning speed bumps, fences, etc. Michelle Miller seconded. Lee Merrill asked that we add to the motion that there be some kind of indication where the parking would be for the buildings, once the existing road is expanded to 25'. Mary Harker and Michell Miller agreed to the amendment. Roll call vote. The motion has been approved to be tabled until the next land use meeting or until the application can prepare a submission for us. 2. Land Use and Development April 6, 2004 Page 4 3. An application by Avalon Park Limited Partnership, 4110 Easton Avenue, Suite A, Caldwell, ID 83607 for a Planned Unit Development (P. U. D.) together with its Preliminary Development Plan. Property is located at 5200 block Yellowstone, West side. Property is presently zoned Limited Residential (R -2). Commission Discussion: 1. How long before Park Lane Drive will connected to Yellowstone. Gary Hall, 4110 Eaton Avenue, Caldwell, Idaho; It will consist of 13 units per acre. They believe this is a good use for this property. The commission discussed: 1. The spots south of the development usage. They are only purchasing the northern area. They will have a tot lot adjacent to the community building and will have 2 six Plex's. There will be 2, 3 and 4 bedroom units with 4 town homes on the ends. This is a affordable housing complex. 2. Privacy fencing hasn't been decided yet. 3. They will be plating the whole piece. Mr Hall passed out pictures of previous units they had build to the commission. They are a non - profit organization. They will improve the road just to where the fire lane is and will have a full time resident manager. The fire access road will be an all weather 20' lane. They would put a chain up so active traffic would not go through there. Earl Romriell, 600 Marie, he owns the adjacent property. This development will land lock his property so he won't have access. Dell Bunce, 1375 Residential Place, Boise, Idaho, with Bunce, Alder and Bunce they have a 50 foot right of way from the seller to develop at a later date. They want to put together a development somewhat similar to the one approved several years ago. They would be glad to sell to Earl Romriell so they could have access. They felt the best thing would be to put the road where it could be used for future development. The commission discussed: 1. Access easement across the property - the other individuals paying their share. Land Use and Development April 6, 2004 Page 5 Alan Romriell, 1264 Palmer Lane they want to do something with their property. They don't know if Adams will come across to the Park Lawn intersection. They want a provision that will give them access. They would be willing to participate financially and would like to do it on a percentage of usage basis. They oppose the subdivision unless they can get access. Bob Middleton, 5164 Mesquite, will it be maintained, cedar fences do not last. Earl Romrell, 600 Marie, He can't afford to buy the property or build the street. He doesn't want to be landlocked and he would like to have it taken care of the same way as before. John Alder, 38095 Teton Road, Island Park, what will the city do with the 100' they bought to put in the street, what will they do with the additional space. Earl Romriell, it is in a family trust and hard to determine what would happen. Dell Bunce, 5075 N. Mansfield Place, Eagle, Idaho they don't want to give free access. They want to have others participate. The public hearing was closed. The applicant Gary Hall addressed any concerns raised in the public hearing. The maintenance will be done by their property management company. They will maintain the properties for 15 years; it is long term development. They want to be a good neighbor. Deloy Stuart moved to recommend to the city council approval of an application by Avalon Park Limited Partnership, 4110 Easton Avenue, Suite A, Caldwell, ID 83607 for a Planned Unit Development (P.U.D.) together with its Preliminary Development Plan. Property is located at 5200 block Yellowstone, West side. Property is presently an R -2. Michelle Miller seconded. Roll call vote: DeLoy Stuart, yes; Mary Harker, yes; Jason Mendenhall, yes; Michelle Miller, yes; Michelle Christy, yes; Gayle Anderson, yes; Lee Merrill, yes; Pete Anderson, yes. 4. An application by Avalon Park Limited Partnership, 4110 Easton Avenue, Suite A, Caldwell, ID 83607 for a preliminary plat. Property is located at 5200 block Yellowstone West side. Property is presently zoned Limited Residential (R -2). City staff: IDT required the city to connect to Adams and close Adams to Yellowstone. The meeting was opened for public comment: Alan Romriell, they don't want a free access Land Use and Development Commission April 6, 2004 Page 6 Earl Romriell, Severs didn't have a clear deed to this property so they cleared the property because he wouldn't. That was a condition for them to purchase the property. Gordon Anderson, 357 Watertower, Meridian, Idaho, he worked on the design and requested that if a condition be placed on it that the condition not prohibit the project from getting started. It may be hard to get everyone together. The public hearing was closed and brought back to the commission. The commission discuss: 1. The city make an effort to get all the parties together and discuss the Park Lane drive and access, prior to going to the city council. 2. Bunce and Romriell should first get together to see if they can work it out before getting together with the city staff. 3. Tabling this item DeLoy Stuart moved to recommend to the city council that the application of Avalon Park Limited Partnership, 4110 Eaton Avenue, Suite A, Caldwell, ID 83607 for the preliminary Plat located at 5200 block Yellowstone West side be approved condition upon a reasonable and a workable solution for the access either through the City of Chubbuck land swap or through a private agreement between the Romriell's and Bunce's and that the Adams Street be plated to be pushed through. Mary Harker seconded. The commission discussed including all property owners in the motion. DeLoy Stuart and Mary Harker agreed to the amendment. An application by Merle Atkinson, 4434 Deer, Chubbuck, Idaho 83202 for a Conditional Use Permit for a basement apartment. Property is zoned Limited Residential (R -2). Merrill Atkinson, 4434 Deer Avenue, he had the space and rooms to do an apartment in the basement. There won't be any additions to the house. The basement apartment was already built. The additional parking space will be put at the side of the house. He had only planned for one additional parking spot but could put in two if they were required. He will be living upstairs. The meeting was opened to public comment for and against. Matt Carr, 628 Sequoia, he bought his home thinking the area was for single family dwellings. This would set up a precedence for the area. It will impact the traffic flow. He thinks someone has already moved in the apartment. The covenants are set up for single family dwellings. Land Use and Development Commission April 6, 2004 Page 7 Dan Maccluer, 4465 deer, they lived near six duplex before and that is one of the reasons why they moved. The neighborhood covenants was for single family. Derrick Northrup 4473 Fox Court when the designated geographic area was set up it was for four twin lots for Alpine by the freeway. All of those four lots are single dwelling homes now. He has someone already move into his home before the meeting. He didn't wait until the Land Use made a decision before they move in. Gary Bishop, 4435 Deer, across the street. The neighborhood is great. The subdivision is complete in structure. If we change it, will it change it for the worse. The neighborhood is out in force tonight. Robb Dye, 770 Redman, he agrees with what has been said. They need to maintain the integrity and feel of the community. Valerie Lisby 638 Sequoria, she wanted a single dwelling home, She wanted to move into a good neighborhood and doesn't want this in the neighborhood. She mentioned the petition that was signed and brought in Monday. Matt Carr 628 Sequoia, the majority should rule. The public hearing was closed and brought back to the application. Merle Atkinson, 3444 Deer, There use to be 3 cars at the residence prior and renters would add 3 cars, making no difference. He doesn't require any change in the neighborhood. He has already let someone move into the apartment. It was brought back to the commission for a discussion. 1. What is allowed in R -2 2. The differences in the address one on Deer and one on Sequoia 3. A conditional use permit doesn't transfer Jason Mendenhall moved that the application by Merle Atkinson, 4434 Deer, Chubbuck, Idaho 83202 for a Conditional Use Permit for a basement apartment be approved with the following condition 1. Off Street (2 parking lots) be paved 2. Comes for review in 1 year Michelle Miller seconded. Land Use and Development Commission April 6, 2004 Page 8 Lee Merrill asked if we could amend to read one car and that the people living be related like a family. Lee Merrill asked to amend to read one car with the total 36' parking. Jason Mendenhall corrected his motion to read: Approve the application with the condition that the additional parking space be added to his existing driveway up to the length required by city code and that this application comes up for renewal in one year. Michelle Miller seconded the motion. Roll Call vote: DeLoy Stuart, yes; Mary Harker, no; Jason Mendenhall, yes; Michelle Christy, no; Michelle Miller, no; Gayle Anderson, yes; Lee Merrill, no; Pete Anderson, yes. Motion dies because of a tie vote. The commission then discussed: 1. The reason for wanting it or not wanting it. 2. The reason why this came before the commission if it is an allowable use. Jason Mendenhall moved that the application by Merle Atkinson, 4434 Deer, Chubbuck, Idaho 83202 for a Conditional Use Permit for a basement apartment for properties currently zoned R -2 be denied. Michelle Miller seconded. Roll Call vote: DeLoy Stuart, no; Mary Harker, no; Jason Mendenhall yes; Michelle Christy, yes; Michelle Miller, yes; Gayle Anderson, yes; Lee Merrill, yes; Pete Anderson, no. 6. An application by Darris Ellis /Park Meadows, 13560 N. Hawthorne Road, Pocatello, Idaho 83202 for a annexation and zone changes from Agricultural (A) to Planned Unit Development (P.U.D.) for residential use with subordinate commercial uses; contingent upon requested annexation. Property is located south of Galena and east of Sawtooth. Darris Ellis, 13560 N. Hawthorne Road, when the engineers filled out the application they left off some numbers so they are doing it now. The meeting was opened for public comment. Jeff Butikofer, 962 Homerun, the twin homes that are going in there, he wanted to make sure that the same type of building structures are going to be maintained. He wants the same standards of buildings. They have some sinking on Homerun that needs to be addressed. What type of commercial businesses are going to be going in. Speed bumps and fencing do they have a say in it. They have a swale in each yard and they are getting a lot of mud tracked in from their construction zones, it comes into their yard and they have to take care of it. Derrik Northrup 4473 Fox Court, he would like to see that the adjacent subdivision be similar and in the same catagory. He feels it should be zoned for that. If zoned for twin homes it will create a lot more traffic in Kasika Subdivision. He would like to see it restriced to an R -1 subdivision. Pete Anderson explained that this is a P.U.D. that was approved previously. The public hearing was closed and brought back to the commission for discussion. Gayle Anderson moved to recommend to the city council to approved the application by Dam's Ellis/Park Meadows, 13560 N. Hawthorne Road, Pocatello, Idaho for a annexation and zone changes from Agricultural (A) to Planned Unit Development (P.U.D.) for residential use with subordinate commercial uses; contingent upon requested annexation. Property is located south of Galena and east of Sawtooth. DeLoy Stuart seconded. GENERAL BUSINESS: 7. Ordinance amending the schedule of general controls of Land Use Distribution. Mary Harker moved to take this to a public hearing at our next land use meeting. Jason Mendenhall seconded. All voted in favor. 8. Discussion of Planning and Zoning workshop in Pocatello. Michelle Miller: Appreciated the information that was provided. She learned that the City can change the wording of the Comprehensive Plan as often as we want. We can only change the map every 6 months. They told us to find a vision for your community for 5 to 15 years. DeLoy Stuart was embarrassed that we didn't have better participation. Lot of cities had more people in attendence.
