HomeMy WebLinkAbout08 08 1989 CM123 COUNCIL MEETING MINUTES August 8, 1989 Minutes of a regular meeting held in the city municipal building, August 8, 1989. Present: Mayor John O. Cotant, Jr., Councilmembers Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Leroy S. Quick was excused. Meeting called to order at 7:40 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to the minutes of July 25, 1989. Councilman Landon moved to approve minutes of July 25, 1989 as read. Councilman Kinghorn seconded. All councilmembers present voted in favor of motion. PASTURE ON EAST CHUBBUCK ROAD - Nancy Lowe, R. J Evans, Ann Evans, John R. Valenty and Cassie Valenty were present to discuss with council, the potential pasture on East Chubbuck Road. Mr. Valenty expressed concer~ horses will be allowed to pasture on the land. Public Works Director Smart suggested we review the livestock ordinance to see what is allowed. After discussion, it was decided the livestock ordinanoe should be reviewed, to see what is allowed. Mr. John Valenty will be contacted, and told what is allowed in the area. BUDGET REQUEST BY AID FOR FRIENDS - Anna L. Lloyd was present to request the City of Chubbuck assist in the support of Aid for Friends homeless shelter in the amount of $1,000.00. Mrs. Lloyd gave a report on what the Aid for Friends provides. After discussion, Mayor Cotant stated the council would consider the request, on the 1989-90 budget discussions. PUBLIC HEARING - A proposal by Gary Ratliff, 4970 Apache for a change of Land Use District from Limited Residential (R-2) to General Com- merical (C-2) at 201 W. Linden. Mayor Cotant declared the public hearing open. Mayor Cotant asked for comments, for or against the change of Land Use District. There were no comments. Mayor Cotant closed the public hearing. Attorney Holmes stated the Land Use & Development Commission approved the zoning change, but, tabled the Conditional Use Permit Mr. Ratliff 125 PUBLIC HEARING - ZONING CHANGE - (Cont.) applied for. Councilman England moved to approve the Land Use iDist~ict zone ~. change at 201 W. Linden fro~ (R-2) to (C-2), subject to the conditional use permit, Mr. Ratcliff applied for, to]build ~sto~age sheds, being granted. Councilman Landon seconded. All councilmembers present voted in favor of motion. PUBLIC HEARING - ORDINANCE #320 - An ordinance providing a conditional use permit is issued to an applicant; correcting technical drafting errors. Mayor Cotant declared the public hearing open. Mayor Cotant asked for comments for or against the ordinance. There were no comments. Mayor Cotant closed the public hearing. Mayor Cotant read Ordiance ~320 in full. Councilman Landon moved to dispense with the rule requiring Ordinance ~320 to be read on three separate days. Councilman England seconded. Roll Call Vote: Quick, absent; England, yes; Landon, yes; Kinghorn, yes. Councilman England moved to adopt Ordinance #320 as read. Councilman Landon seconded. Roll Call Vote: Quick, absent; England, yes; Landon, yes; Kinghorn, yes. PUBLIC HEARING - ORDINANCE - A proposal by the City of Chubbuck to amend the Chubbuck Land Use Ordinance to provide for screening of commercial products stored outdoors. Attorney Holmes explained the Land Use and Development Commission made such extensive changes in the proposed ordinance, that they felt it should be republished for public hearing. ORDINANCE - PROPERTY MAINTENANCE - An ordinance adding Chapter 8.24 to the Chubbuck Municipal Code providing for the maintenance of property within the City of Chubbuck. Mayor Cotant read the ordinance by title for the first reading. Council was concerned with being able to enforce the ordinance. After discussion, it was decided the council will review the ordinance and discuss at the August 22, 1989 Council Meeting. BUSINESS LICENSE APPLICATION - Robert Kopiez, Jr., Las Vegas, Nevada, Union Circulation, has applied for a business license to sell magazine subscriptions door to door in the City. 127 BUSINESS LICENSE APPLICATION - UNION CIRCULATION - (Cont.) Mr. Kopiez, Jr. was not present at the meeting. Asst. Police Chief reported there was complaints on Union Circulation last year. After discussion, Councilman England moved to table the business license application to Union Circulation until a back ground check can be made. RESOLUTION #5-89 - A resolution authorizing the Mayor to cause material constituting a nuisance located on property within the city to be removed, with the cost of such removal to be levied as a special assessment against the property whereon the nuisances are situation. Pursuant to Chubbuck Code 9.12.020, Mr. R. Jay Henderson was notified that he was to remove and abate the following nuisance on or before August 7, 1989: On property described as 4600 Hiline, Space 102 in the Briarwood Trailer Court, you are to remove or abate the nuisance created by the vacant, open mobile home trailer. Mayor Cotant read Resolution #5-89 in full. Councilman Kinghorn moved man England seconded. Ail motion. to adopt Resolution #5-89 as read. Council- councilmembers present voted in favor of ORDINANCE VIOLATION - Attorney Holmes stated Mr. Capell, 5795 Moses has several cars that need repaired in his driveway, front and back yard. Attorney Holmes and Officer Ji~?- Phelps have been trying to get the property cleaned up for several weeks. Mr. Capell's attorney said he would have some of the cars out by the middle of July, and nothing has been done. Officer Phelps wanted the council to kno~ we should proceed with a law suit. Attorney Holmes, Officer Phelps and Mayor Cotant will drive by the property after staff meeting. CLAIMS - Computer print-out and handcheck claims have been presented to Mayor Cotant and Council. After discussion, Councilman England moved to approve payment of comp- uter print-out and handcheck claims as read. Councilman Landon seconded All councilmembers present voted in favor of motion. FINANCIAL REPORT for month of July, 1989 presented to Mayor Cotant and Council. 1989-90 FISCAL YEAR, TENTATIVE BUDGET - City Clerk Ron C. Conlin presented a proposed tentative budget and reminded Mayor Cotant and Council the 1989-90 Tentative Budget should be adopted tonight and a time set for 129 1989-90 TENTATIVE BUDGET - (Cont.) the public hearing. Council decided to call a Special Meetin~to discuss budget, Tuesday, August 16, 1989 at 6:00 p.m. Councilman England moved to adopt the 1989-90 Fiscal Year Tentative Budget as read, and set the Public Hearing date and time for August 22, 1989 at 7:30 p.m., at City Council Chambers. Councilman Landon seconded. All councilmembers present voted in favor of motion.
