COUNCIL MEETING MINUTES
May 23, 1989
Minutes of a regular meeting held in the city municipal building,
May 23, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Steven ~
England, David A. Landon, Dwain A. Kinghorn, Attorney Thomas J.
Holmes, Public Works Director Steven M. Smart and City Clerk Ron C.
Conlin. Councilman Leroy S. Quick was excused.
Meeting was called to order at 7:32 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to
the minutes of May 16, 1989.
Councilman Kinghorn moved to approve the Special Meeting Minutes of
May 16, 1989. Councilman Landon seconded. All councilmembers present
voted in favor of motion.
CLAIM - L.V. Hageman, 162 W. Chubbuck Rd. presented a claim to Mayor
Cotant and Council stating, in the summer of 1988 he had a patio and
driveway poured. Last winter the City plowed the snow from N. Afton
and blocked the drainage for the street in front of the driveway and
patio, which made the water run under ~he newly poured patio. He said
he asked them at the time they were plowing to plow the snow to the
other side of the street, so when it melts it would drain properly
He said they ignored his request.to plow it to the otherside of the
street so when the snow melte~ the water ran under his patio, which
lifted it up and cracked it.
Councilman Landon moved to turn the claim to Tom Nield, Insurance De-
signers. Councilman England seconded. All councilmembers voted in favor
of motion.
ANNEXATION FEE FOR HERITAGE WEST SUBDIVISION - Mike Bird, American Heritage
was at the May 16, 1989 Council Meeting and asked the Council to con-
sider waiving the remaining annexation fees for Heritage West Sub-
division.
Mayor Cotant expressed concern of waiving the annexation fee because
it costs the City to provide services, when homes are added to the
subdivision, ~so there are lots inside the City that needs to be dev-
eloped.
Councilman Landon said he was in favor of at least keeping the portion
of the annexation fee for parks, but, he is against requiring the full
$540.00 annexation fee.
Mrs. Jeanne McCracken, 4847 Independence called and expressed concern
the Council might discontinue the annexation fee to American Heritage.
Mrs. McCracken asked if all the American Heritage lot owners will re-
ceive a refund for the $540.00.
Councilman England stated, a lot of ~time was put into the reasoning
behind installing the annexation fees, we should look at the reasons
and possibly the annexation fee could be reduced.

Public Works Director Smart stated, the over all commitment for Heritage
West Subdivision was $100,000.00, of this $28,000.00 cash in lieu of
park land dedication, $49,000.00 was for additional water demand and
$23,000.00 was for other services.
It was stated most of the building going on in the City at this time
is going at Heritage West Subdivision.
After discussion, Councilman England moved to table the agenda item,
and invite American Heritage representatives to the next meeting to
discuss the request. Councilman Landon seconded. All councilmembers
voted in favor of motion. Councilman Landon suggested if the meeting
can be called earlier, that we call before the next regular scheduled
meeting.
BUSINESS LICENSE APPLICATION - Sam G. Wadsworth, 55~Pershing, Pocatello,
doing business as Sam's Ice Cream has applied for a license to sell
ice cream from a vending cart on city streets.
Sam's Ice Cream was issued a business license the past three years,
with no complaints or problems from city residents. Any safety problems
have been corrected and the business has been good with children.
Councilman Landon moved to grant Sam Wadsworth, 55~Pershing,,Pocatello
a business license to sell ice cream. Councilman England seconded.
All councilmembers present voted in favor of motion.
CLAIMS Computer print-out and handcheck claims presented to Mayor Cotant
and Council.
After discussion, Councilman Landon moved to approve computer print-out
and handcheck claims as read. Councilman England seconded. All council-
members present voted in favor of motion.
FIRE DEPARTMENT - Fire Chief Cary Campbell stated he would like to send
six ~volunteer firemen to State Fire School this year. The cost will be
$234.00 per fire fighter.
Councilman Kinghorn moved to approve a claim of $1,404.00 to send six
volunteer firemen to State Fire School. Councilman Landon seconded.
All councilmembers present voted in~ favor of motion.
GENERAL[DISCUSSION -

Mayor Cotant asked for suggestions for committee members for the
Centennial Committee, and a Parks and Recreation Committee. Mayor
Cotant said to give suggestions to City Clerk Ron Conlin.
2) Jim Weatherby, AIC Executive Director has resigned as of July 1,
1989.

At 8:15 p.m., Councilman England moved, Councilman Landon seconded, with
full council approval to adjourn meeting.
