Cotant, Jr., Councilmembers Leroy S. Quick, Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and city Clerk Ron C. Conlin. Councilman S~even M. England was excused until 7:55 p.m. Meeting was called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to the minutes of April 11, 1989. Councilman Landon moved to approve the minutes of April 11, 1989 as read. Councilman Quick seconded. All councilmembers present voted in favor of motion. BUSINESS LICENSE APPLICATION - JoAnne Briscoe, 4849 Whitaker Rd. has applied to operate the sno-shack at Smith's Food King Parking Lot. Mrs. Briscoe stated she had purchased the business from previous owners. She said the sno-shack would be operated, same as in the past. Fire Chief Cary Campbell and Police Chief Arnold Stone approved the applica- tion. Councilman Quick moved to approve a business license to JoA~lne Briscoe, 4849 Whitaker Rd. to operate a sno-shack at Smith's Food King Parking Lot at 4845 Yellowstone Ave. Councilman Kinghorn seconded. All council- members present voted in favor of motion. BUSINESS LICENSE APPLICATION - Von Christensen, 4656 Targhee has applied for a business license to operate A Royalline Enterprises, selling toy birds retail. Von Christensen was present to explain how he planned to sell the toys. After discussion, Councilman Landon moved to approve a business license to Von Christensen~ A Royalline Enterprises to sell birds retail. Councilman Kinghorn seconded. All councilmembers present voted in favor of motion. PROCLAMATION - LAW DAY - Mayor Cotant read the proclamation in full. Councilman Kinghorn moved to direct Mayor Cotant to proclaim May 1, 1986 as "Law Day". Councilman Quick seconded. All councilmembers voted in favor of motion. PROCLAMATION - PROFESSIONAL SECRETARIES WEEK - Mayor Cotant read the pro- clamation in full. Councilman Landon moved to direct Mayor Cotant to proclaim April 23,-- April 29th, 1989 to be "Professional Secretaries Week". Councilman Quick seconded. All councilmembers present voted in favor of motion. 71 POSTAL SERVICE CENTRALIZED DELIVERY BOXES - Mayor Cotant said the postal system has a new method of providing centralized delivery boxes for each home, they are ganged in 4, 6 or 8 boxes, in one location. The boxes are installed at the expense of the Post Office. Mayor Cotant explained how the program worked. This system would get the mail boxes from the sidewalks, which would take care of a potential safety hazard. Mayor Cotant said the City is looking at an ordinance, that would phase this system into the City. All new subdivisions would be required to use the system. The main ques[ion willbe, which property will the box be installed. The Post Office will pour a 4' x 4' cement pad, which can be landscaped. Mayor Cotant asked residents to let the city know how they feel about the centralized delivery boxes. APPEAL - Richard H. Phillip, 151 Hiway presented a petition to request an appeal of the decision of the Land Use & Development Commission's decision on April 6, 1989, to allow a conditional use permit to Teton Cellular of Idaho, to erect a 300' tower, with support lines and hous- ing for switch gear, on property east of Alpine Trailer Sales, 5050 Yellowstone Ave. Councilman Dwain A. Kinghorn lives within 300' of the proposal, so he removed himself from his seat on the council. Mr. Rick Phillips was present and asked that the Council rescind a decision by the Land Use and Development Commission to issue a Condition- al Use Permit to Cellular Phone to install a 300' tower east of 5050 Yellowstone Ave. Mr. Phillips said he felt the proposal was very poorly advertized, and that is why they were not at the Land Use & Development Commission Meeting, April 6, 1989. All property owners within 300' did receive notice, of the meeting. Mr. Phillips said construction of the tower would lower his property values. Mr. Phillips was concerned about the lights on the tower flashing at night, keeping his family awake. Mr. Phillips said he did not fell the tower had to be built in the middle of the City. Mr. Phillips stated some reasons why he did not want the tower located at this location: 1. What will happen to TV reception. 2. Lowering values of property in area. 3. Satelite reception could be'effected. Concern about high concentration of microwave on health. ~[ Tower might tall and hit residences. Mr.~Phillips expressed concern of having a junk yard in his back yard. Lawrance Betty, 156 Hiway expressed concern of looking out and seeing a 300' tower. Kelvey McDaniels, Cellular Phone Co. gave a report on the project. Mr. McDaniel~- stated this site was picked because a U.S. West Direct Office is close, this will help the economics part of the proposal. Mr. McDaniels said all profits will stay in the area, rather than leaving the state. 73 APPEAL - (Cont.) Mr. McDaniels stated construction had been scheduled, based on the time of year. Considerable discussion about locating the proposal at a different locations. Mr. McDaniels said if there is any interference, the FCC would not allow the tower at that location. Mr. McDaniels said the tower would not fall straight over if it fell, it would collapse, then fall, there is no worry of the tower hitting any of the homes on Hiway Ave. Councilman Kinghorn said over the years, he has lost a lot of property value in his home, if the tower is allowed, it will be one more thing that will lower his property~value. Bob Anderson~ 5646 Sorrell Dr. said some businesses in the City are looking for a service like this, including himself. Mr. Anderson said this is a commercial area and a business like this should be allowed. Mr. Anderson stated the cleanup that needs do be done at Charlie Frasure place should be a separate issue than the conditional use permit for the tower. Councilman England stated in the future the homes on Hiway Ave. might be worth more as a commercial sale, rather than residential. Discussion about moving the location of tower to east of the current proposed site. Councilman Kinghorn suggested the neighbors on Hiway Ave. meet and talk about the proposal. It was Suggested an architectural~drawing be presented showing, what the tower and guidelines will look like. Mr. McDaniels"said he would get a drawing to individuals involved for review. After discussion, Council tabled the appeal until Wednesday, May 3, 1989 at 7:30 p.m. ANIMAL CONTROL COMPLAINT - Animal Control Officer Signe Peterson stated a pitbull at 4901 Yellowstone Sp 21 bit alittle boy, while he was going home, also it bit a little girl, April 21, 1989. The owner of the dog said, when a dog is provoked, it will attack. She felt the dog was not vicious. Vicki Springsteed, 4901 Yellowstone Ave. Space #63, mother of a little girl that got bit by the dog, said she felt the dog is vicious and dangerous. Animal Control Officer Signe Peterson was directed to follow the ordinance in determining, whether or not dog is vicious. Mrs. Wheatl~ was given a copy of the ordinance. CLAIM - JACK DRIEVER, 533 ALBATROSS - Mr. Driever said this winter, the city crew came to remove snow, while they were pushing the snow, the equipment was going down the sidewalk, at this time the sidewalk was ~rok~n. Councilman Landon moved to repair the sidewalk at Jack Driever's res- idence, 533 Albatross. Councilman Quick seconded. All councilmembers voted in favor of motion. UNDERBORE BID - Public Works Director Steve Smart gave a recap on the underbore bid. Under railroad tracks at W. Chubbuck and Siphon Rd. The Siphon Rd. Underbore is $15,375.00 for Total of $32,561.00 The Chubbuck Rd ...... $17,186.00 Councilman Kinghorn moved to accept Helm's & Sons bid of $15,375.00 for the Siphon Rd. underbore and $17,186.00 for the E. Chubbuck Road underbore for a total of $32,561.00. Councilman Quick seconded. All Councilmembers voted in favor of motion. WATERWORKS BID -Public Wor~Director Steve.Smart gave a recap on the the waterworks material bid. Pacific Water Works, Boise Norman Supply, Pocatello Water & Waste Water, Boise Waterworks Equip., Ogden $ 33,286.63 33,897.48 35,486.76 35,348.42 Mayor Cotant suggested consideration be given to the local bidderl If there is problem they are right here to handle. There is only $610. difference: between Pacific Waterworks, Boise and Norman's Supply, Pocatello. Councilman England moved to accept Norman Supply's, Pocatello bid of $33,897.48, subject to Attorney Holmes review. Councilman Landon second- ed. All councilmembers voted in favor of motion. LAWNMOWER BID - PWD Smart stated we received a bid from Stan Bonham Co. of $26,~5.00 with trade in. The lawnmower sells for $36,985.00 less $10,500.00 trade in on the ~350D lawnmower. Councilman England moved to accept the bid of $36,985.00 less $10,000. total $26,485.00 from Stan Bonham Co. Councilman Landon seconded. All councilmembers voted in favor of motion. CLAIMS - Computer print-out and handcheck claims presented to Mayor Cotant and council. 77 CLAIMS - (Cont.) Councilman Kinghorn moved to approve computer print-out and handcheck claims as read.
