COUNCIL MEETING MINUTES
April 11, 1989
Minutes of a regular meeting held in the city municipal building,
April 11, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney Thomas
J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C.
Conlin.
Meeting called to order at 7:34 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to
the minutes of March 28, 1989.
Councilman Kinghorn moved to approve the minutes of March 28, 1989
Council.Meeting as read. Councilman Quick seconded. All councilmembers
voted in favor of mo~ion.
PROCLAMATION - NATIONAL CONSUMERS WEEK - Mayor Cotant read the proclam-
ation in full.
Councilman England moved to direct Mayor Cotant to proclaim the week
of April 23, 1989 through April 29, 1989 as "Consumers Week". Council-
man Quick seconded. All councilmembers voted in favor of motion.
ORDINANCE ~317 - An ordinance amending Chapter 9.12, Chubbuck Code to
provide when an unscreened storage area constitutes a nuisance, to pro-
vide for other nuisances.
Attorney Holmes presented two ordinances, one would provide for a
change in the Land Use Ord.inance, which deals with Chubbuck Code
18.12.030 (J), the other ordinance amends Chapter 9.12 Chubbuck Code
to provide ~hen~'.an-unsc~eened storage area constitutes a nuisance.
Mayor Cotant stated we have received several complaints about the
railroad ties on E. Chubbuck Road. There will be several_thousand more
railroad ties put around the city. Mayor Cotant suggested there be
some type of control, to protect residents that live around the areas,
in view of the ties.

Councilman Landon suggested setting a time, the ordinance .would require
properties, ~o be brought into compliance.
Mayor Cotant read Ordinance ~317 in full.
Councilman Landon suggested Mayor Cotant meet with Rodney Parrish in-
regards to the railroad ties, tell him there have been several com-
plaints, and make the following suggestions:
1. Maybe set time limit for ties already ther~ to be removed.
2. Possibly restrict ad~t~d~al~t~e~ ~0ming in.
3. Straightening ties.

The following additions were made to Ordinance 31~:
5. Any junk i~ems or reclaimed items items kept adjacent or
in close proximity to private grounds of another, pedestrian
or vehicular thoroughfares, or premises open to the public,
unless such items are enclosed within a solid structure or
other sufficient visual screen; "junk items" include, without
limitation, abandoned or inoperative motor vehicles, abandoned
or reclaimed mobile homes, trailers or production dwelling,
inoperative applicances or fixtures, dismantled or discarded
furniture or equipment, scrap metal or lumber, ropes, rubber,
glass, rags, paper or bagging, and other salvage or refuse
articles.
Councilman England moved to dispense with the rule requiring
Ordinance $317-to be read on three separate days. Councilman
Quick seconded. Roll Call Vote: Quick, yes; England, yes;
Landon, yes; Kinghorn, yes.
Councilman Landon moved to adopt Ordinance #317 as read, with changes
reflected above in paragraph 5. ~ouncilman England seconded. Roll Call
Vote: Quick, yes; England, yes; Landon, yes; Kinghorn, yes.
An ordinance amending Chubbuck Code Section 18.12.030 (j) to provide
for screening of commercial products stored outdoors; to provide
for screening of outdoor storage in industrial areas; to provide
for a phase in oeriod when these amendments shall govern existing
situatio~ willie presented to the Land Use and Development Commission.
FINANICAL REPORT for the Month Of March, 1989 was presented to Mayor
Cotant and Council.
QUARTERLY REPORT for the Second Quarter, 1988-1989, was presented to
Mayor Cotant and Council.
CLAIMS - Computer print-out and handcheck claims presented to Mayor
Cotant and Council.
Councilman Kinghorn moved to approve computer print-out and handcheck
claims as read, subject to review of Robert's TBA invoice in the
amount of $3,446.92 in Staff Meeting. Councilman England seconded.
All councilmembers voted in favor of motion.
The Robert's TBA invoice was discussed in Staff Meeting the following
day, Dennis Stone stated the tir~ are purchased through Robert's TBA,
billed to th~ City at Don Andra's request. The claim was okayed to
pay.
GENERAL DISCUSSION -
1. Discussion about trees purchased from a Twin Falls Nursery. Trees
planted are doing quite well.

Kent Kearns, 4831 Elizabeth said he received a complaint about
the building owned by Rodney Parrish just off the 1-86 Ramp, on
the north-east side. Attorney Holmes said this was on the S~aff
Meeting Agenda, in the morning.
PROPOSAL BY TETON CELLULAR OF IDAHO, LIMITED PARTNERSHIP was
approved by Land Use & Development Commission by a decision of
3 to 2. Councilman Kinghorn stated he felt for good planning,
and aesthetics in the City, this should not have been allowed.
At 8:55 p.m., Councilman Landon moved, Councilman England seconded, with
full council approval to adjourn meeting.
