COUNCIL MEETING MINUTES
January 10, 1989
Minutes of a regular meeting held in the city municipal building,
January 10, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, Dwain A. Kinghorn, Attorney Thomas J. Holmes,
Public Works Director Steven M. Smart and City Clerk Ron C. Conlin.
Councilman David A. Landon was excused.
Meeting was called to order at 7:35 p.m. bv Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant.asked for additions or corrections
to the minutes of December 13, 1988 and Special Meeting Minutes of
January 3, 1989.
Councilman Quick moved to approve the minutes of December 13, 1988
as read. Councilman England seconded. All councilmembers pres~n['
voted in favor of motion.
Councilman Kinghorn moved to approve the minutes of January 3, 1989
as read. Councilman Quick seconded. All councilmembers present, voted
in favor of motion.
PUBLIC HEARING - A proposal by Sanaye Okamura, 107 Turaco, Pocatello,
for property at the Southeast corner of Siphon and Yellowstone Ave.,
for a change in Land Use District from Agriculture (A), to General
Commercial (C-2), upon requested annexation. -
Mayor Cotant declared the public hearing open.
Mayor Cotant asked if there was any opposition to the proposal.
There was no opposition. ~_
Mayor Cotant asked for comments. There were no comments.
Mayor Cotant closed the public hearing, and asked for comments from
the council.
Councilman Kinghorn expressed concern about a letter from Sanaye
and Paul Okamura requesting the annexation be null and void after
120 days if the land.is not sold.
Attornev Holmes stated the council could aDDrove the zoning change ~
and annexation, subject to the postal facility being built on the land
Councilman Kinghorn moved to approve zoning change proposal by
Sanaye &~!Paul Okamura on property at southeast corner of Siphon and
Yellowstone Ave. from Agriculture (A) to General Commercial (C-2)
upon requested annexation, subject to postal service facility being
built upon that site. Councilman England seconded. All council-
members present voted in favor of motion.
PROCLA~LATION - BIRTH DEFECTS PREVENTION - Mayor Cotant read the
proclamation in full.
Councilman Quick moved to direct Mayor Cotant to proclaim January
21, 1989 to January 31, 1989 as Birth Defect Prevention. Council-
Kinghorn seconded. All councilmembers present voted in favor of
motion.
CLAIMS - Computer print-out and handcheck claims presented to Mayor
Cotant and Council.
Councilman Kinghorn moved to approve computer print-out and hand-
check claims as read. Councilman England seconded. All council-
members present voted in favor of motion.
MOBILE HOME WATER AND SEWER RATES DISCUSSION - Public Works Director
Steve Smart gave a report on a water and sewer rate study, he pre-
sented the council at the December 13, 1988 Council Meetinq.
Public Works Director Smart said he felt that with the City having
approx. 25 mil~ of collector line, the City could support double or
triple the population we have now, at approx, the same cost.
Charlie Frasure said, with a mobile park only having one or two
hookups, he felt there would not be near the cost of several hook-
ups, therefore, there should be some discount.
Randy Hoffer, Bell Trailer Court, said the City of Pocatello rates
are lower than the City of Chubbuck. Public Work Director Smart
suggested Mr. Hoffer check for leaks in his court. Mr. Hoffer's
water useage is considerably more than other mobile courts, per
unit.
Sue Parrish stated the higher rate is not only affecting mobile
homes, but also apartment owners. Mrs. Parrish said she felt the
City is over charging on water and sewer rates.
Mayor Cotant stated, the high end of the water and sewer rate should
be reviewed, and maybe adjusted to accomodate the mobile home and
apartment owners.
Mayor Cotant told the Mobile Home Park owners, we realized their
problem, there will be continued review of water and sewer rates
for mobile home parks. Mobile Home Park~ownezs_will be notified
for input at future meetings.
RESOLUTION - ~1-89 - Whereas, Union Pacific Railroad has tendered to thc
City of Chubbuck a Pipline Crossing Agreement for an ~8" underground
water pipeline crossing at MP 139.09.
Mayor Cotant read Resolution #1-89 in full.
Mayor Cotant asked Public Works Director Smart what the $1,500.00
license fee the railroad is requesting.

Public Works Director Smart stat~the $1,500.00 is a license fee
for the crossing of Siphon Rd. This agreement requires an insurance
certificate, $1,000,000100 liability, Tom Nield is-working on.it.
Councilman England moved to adopt Resolution #1-89 as read.
Councilman Quick seconded. All councilmembers present voted in favor
of motion.
FIRE DEPARTMENT - Fire Chief,Cary Campbell gave a report on proposed
remodeling of the Chubbuck Fire Station. Chief Campbell said they
would like to get the training room started, as soon as possible.
Chief Campbell said there are some individuals that will donate
their labor on this project. Most of the labor will be donated,
with the exception of plumbing and electrical work. Chief Campbell
stated the project will cost approx. $5,000.00.
The cost of the project will come from some of the monies returned
to the City from State Insurance Co.
FINANCIAL REPORT for month of December presented to Mayor Cotant and
Council.
QUARTERLY FINANCIAL REPORT for 1st. Quarter presented to Mayor Cotant
and Council.
At 9~5 p.m., Councilman Kinghorn moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
