Cotant, Council members Leroy S. Quick, Steven M. England, David A. Landon, W. Dean Wood, Attorney Thomas J, Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the minutes of November 27, 1990. Councilman Wood moved to approve minutes of November 27, 1990 as read. Councilman Landon seconded. All council members voted in favor of motion. PUBLIC HEARING ORDINANCE ¢351 - An ordinance amending Chapter 18.14 (d) and 18.08.040 (b) of the Chubbuck Municipal Code to change the front yard setback areas in commercial and industrially zoned areas to 10 feet and to increase the required landscaping strip between the right of way and off street parking area vehicular use area or structure to 10 feet. Mayor Cotant read Ordinance ~351 by title. Mayor Cotant declared the public hearing open. There being no comments, for or against, Mayor Cotant declared the hearing closed. Councilman Quick moved to dispense with the rule of reading Ordinance ~351 on three separate days. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, absent; Landon, yes; Wood, yes. Councilman Landon moved to adopt Ordinance ¢351 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, absent; Landon, yes; Wood, yes. ORDINANCE ¢352 An ordinance adding Chapter 15.32, "Idaho Residential Energy Standards," to the Chubbuck Municipal Code. Mayor Cotant read Ordinance ¢352 if full. Councilman Wood said he talked to two builders that will be affected by this ordinance, the builders said builders in the City pretty much meet these standards now. 223 ORDINANCE ~352 - (cont.) Councilman Wood moved to dispense with the rule of reading Ordinance ~352 on three separate days. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, absent; Landon, yes; Wood, yes. Councilman Quick moved to adopt Ordinance ~352 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, absent; Landon, yes; Wood, yes. RENEWAL OF LIQUOR, WINE AND BEER LICENSES - for year of 1991. The Police Department have approved the renewal of licenses to present holders of liquor, wine and beer licenses. Councilman Quick moved to approve renewal of beer, wine and liquor licenses for the year of 1991, subject to the compliance of all requirements of the ordinance and statutes, as determined by the City Clerk. Councilman Landon seconded. All council members voted in favor of motion. ACCIDENT CLAIM - was hit by damage. Mr. Manual Saiz, 4640 Tahoe Place stated his vehicle a Chubbuck Po]ice Car, causing approx. $200.00 Saiz is asking the City to pay the damages. Asst. Chief of Police Jerry Rowland said the Chubbuck Police Officer was at fault, in causing the accident. Councilman England moved to turn the claim to City Insurance Co. for payment. Councilman Landon seconded. council members voted in favor of motion. All BUSINESS LICENSE APPLICATION - Gene Kelly, Banks, Oregon has applied for license to sell christmas trees at the Green Triangle Parking Lot. Police and Fire Departments approved the application. Councilman Wood moved to approve a business license to Gene Kelly, Banks, Oregon to sell christmas trees at the Green Triangle Parking Lot. Councilman Landon seconded. All council members voted in favor of motion. CLAIMS - Computer print-out and hand check claims presented to Mayor Cotant and Council. City Clerk Conlin stated the hand-check claims are a result of a bid received on an abandon vehicle. Denny Jones received the bid for $1,2OO.00. The tow & storage bill owed to Dennys Wrecker, is $939.50, with the remaining monies going to the State Abandon Vehicle Fund in Boise. CLAIMS - (cont.) 225 Councilman England moved to approve computer print-out and hand check claims as read. Councilman Landon seconded. All council members voted in favor of motion. ORDINANCE - An ordinance adding Chapter 15.32 to the Chubbuck Municipal Code providing for new commercial uses of property to comply with existing ordinances regarding curb, gutter, sidewalk, streets and landscaping; amending Section 18.14.O40 to bring it into harmony with Chapter 15.32. Mayor Cotant read ordinance in full for first reading. Councilman Wood expressed concern of cost to a potential business. Councilman Wood said the cost might discourage a business locating in the City. Councilman Landon stated the ordinance will improve looks of the City. After discussion, the Council decided to table the ordinance until the January 8, 1990 council meeting. CHUBBUCK PRIDE CERTIFICATE OF APPRECIATION AWARDS - Hayor Cotant presented Nate and LuAnn Palagi, Scott Street, Ralph and Connie Talbot, 627 Scott and Dale and Lanes Bybee, 586 Scott with Chubbuck Pride Jackets for christmas decorations on and around their house every year. Leonard and Linda Wickhorst were present to receive Chubbuck Pride Jackets for work on christmas decorations at City Hall. The Union Pacific Railroad donated material, Leonard welded the material to reindeer, sleigh, etc. Lamar and Lea Armstrong were present to receive Chubbuck Pride Jackets, for their participation in Chubbuck Days Celebration every year. The Armstrongs lend the City, the 1931 Model A Truck the City Council rides on, in the Chubbuck Days Parade. Chubbuck Pride Chairwoman Mary Harker said Christmas Lighting contest will be announced, the Idaho State Journal, December 20, 1990. the Chubbuck and printed in REPORT ON EPA IDAHO RADIONUCLIDE STUDY - PWD Smart passed to Mayor Cotant and Council an EPA update on the Idaho Radionuclide Study. PWD Smart said the EPA is reviewing the Study. PWD Smart said, it will be good if Mayor Cotant and Council take time to give comments to the Science Advisory Board on the review. 227 EPA IDAHO RADIONUCLIDE STUDY - (cont.) PWD Smart suggested the council make a motion to rescind the previous decision, to not use or permit use of slag in the city until the study is finally reviewed. Councilman England moved to rescind council decision, to not use, or permit use of slag on city streets, during winter months until such time the City gets a ruling from the EPA. Councilman Landon seconded. All council members voted in favor of motion.
