Cotant, Council members Steven M. England, W. Dean Wood, Attorney Thomas J. Holmes, Steven M. Smart and City Clerk Ron C. Conlin. Councilman Leroy Quick excused. Meeting was called to orde~ at 5:18 p.m. by Mayor John O. Cotant. PURPOSE OF MEETING shall be to discuss utility rates to support 1990-91 Fiscal Year Budget. UTILITY RATE DISCUSSIONS I Mayor Cotant received a letter on issues raised at the meeting of the two Councils. Pocatello City Council believes that the rate differential between in-city and out-of-city users is a fair and reasonable charge, and will bill the City of Chubbuck $.81 per thousand gallons for sewer delivered at the sewer plant. Attorney Holmes reported on the costs of litigation, should the Council decide to use the court, to settle the matter. If the council does decide to use the courts, the first thing required would be a rate study that could be quite expensive. Attorney Holmes stated there might be a potential conflict with his law firm, because one of the attorneys does some work for the City of Pocatello. Attorney fees will be high. Councilman Wood expressed concern the City of Pocatello might raise the rates in the future, anytime they feel like it. Discussion about hiring an arbitrator to settle the matter. PWD Smart outlined procedures for getting the 4% monies to build a plant. PWD Smart said the city will be required to hold a Revenue Bond Issue Election. If a feasibility study is approved by the State, and shows a recommendation for Chubbuck to build a plant, then the State will buy the bonds. These steps are required to get the monies. PWD Smart said the State and EPA should be approached to get their feeling on Chubbuck building a plant. If all these things are go, then we have to get approval to expand the feasibility planning study, which involve public hearings. PWD Smart stated it would be approx. September, 1991 before we would have the election. PWD Smart stated a mechanical plant will be the most feasible way to go. The cost of a mechanical plant will be approx. $.96 per thousand gallons. PWD Smart stated a lagoon plant will require a lot of land, more than what is available. UTILITY RATE DISCUSSIONS - (cont.) Council was in agreement, Pocatello should get a return on their investment, but, Chubbuck residents should not be required to pay $41,000.00 per year from now on. Council directed Mayor Cotant and PWD Smart to find out what the State and EPA reaction will be on Chubbuck building a mechanical sewer plant. Mayor Cotant stated he will talk to Mayor Angstadt, and ask him to explain the large difference between in-cgty rates, and out-of-city rates. At 6:30 p.m., Councilman England moved, Councilman Landon seconded, with fulq council approval to adjourn meeting. Ron C.
